HomeMy WebLinkAbout20012755.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST SELECT MATERIALS C/O ROBERT OMAN FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Select Materials, do Robert Oman, VI #0100041, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 1st day of October, 2001, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Select Materials do Robert Oman was represented by Todd Hodges, Todd Hodges Design, LLC, at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until November 30, 2001, to allow adequate time for the property owners to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. I have scheduled a meeting with the Board of County Commissioners on October 1, 2001, at 9:00 a.m.,to consider the violations occurring on the property. The above mentioned property is in violation of the following Section(s) of the Weld County Code: Chapter 23,Article Ill, Div I "A(Agricultural)Zone District" Section 23-3-20 "Uses allowed by right." The uses permitted on this site shall include the extraction of sand as described in the application materials and all other uses permitted by right in the Agricultural Zone District. 4.) The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion,fugitive dust and growth of noxious weeds. The site shall be maintained in such a manner as to present a neat and well kept appearance. 8.) No stockpiling shall be allowed on the Special Use Permit area which would cause damage to adjacent properties or county road right-of-way by altering the historic drainage pattern. 9.) The Special Use Permit shall be limited to the plans shown hereon and governed by the Operation Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Operation Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Operation Standards shall be permitted. Any other changes from the plans and/or Operation Standards shall be filed in the office of the Department of Planning Services. 10.) The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. No excavation or processing of materials shall be permitted nearer than ten (10) feet tot he boundary of adjacent property, easement or irrigation ditch or right-of-way, nor nearer than 125 feet to any existing residence, unless by written agreement to the owner of owners of such adjacent property consent to a lesser distance and the Planning Commission approves such lesser distance. 3. All extraction operations shall be conducted during the hours of daylight, except incases of public or private emergency, or to make necessary repairs to equipment. This restriction shall not apply to the operation of admin- istrative and executive offices or repair facilities if located on the property. 4. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust and growth of noxious weeds. Existing trees and ground cover along public road frontage and drainage- ways shall be preserved, maintianed and supplemented if necessary, for the depth of the setback in order to protect against and/or reduce noise, dust and erosion. 6. Insurance - The operator shall furnish evidence he is insured to the extent of not less than $100,000.00 against liability for any negligent act or omission by the operator from the operation, maintenance, extraction, and/or production of the sand and shall include all activities connected with or incidental thereto. 7. All phases of the operation shall comply with all applicable County, State and Federal Health Standards and Regulations and other applicable rules and regulations of governmental bodies having jurisdiction on the premises. 8. Box 758 Greeley, Co. 80632 Dear Mr. Barker, It has come to my attention that Select Materials is operating a composting facility on WCR 12 east of WCR 35 on parcel #147101000035. That parcel is permitted for sand mining by SUP #460. The pennit does not allow for them to be importing material to that site. I am aware they are in the process of applying for a USR permit to operate the composting facility. As the president of the Buffalo Ridge Home Owner's Association, I would like to request they be served with a cease and desist order until after the commissioners have made a ruling on the permit application. We are opposed to having another facility of this type thrust on our community. We feel that the entrance to our neighborhood is being transformed from an agricultural area to an industrial area. We already have Weld County Waste Disposal, a Superfuid cleanup site, on the east side of WCR 35; BOSS Composting on the other side of WCR 35; a trucking company operating out of a property at the corner of WCR 35 and WCR 12 and a towing company with extensive on-site storage on the east side of WCR 35 between HWY 52 and WCR 12. We have 22 homes either occupied or under construction. We will eventually have 52 families living in our subdivision. At the moment WCR 35 is our only access. The truck traffic on WCR 35 is a safety hazard for all who travel that road. We paid a significant portion of the cost of paving WCR 35 and we have concerns what the long-term impacts of the truck traffic will be, not only on traffic safety, but on the integrity of the pavement. This issue must be decided by the County Commission. In the mean time Select material is operating in violation of Weld County Ordinances and we insist they be made to stop. Thank you, Mitchell L.
