If any work associated with this project requires the placement of dredged or fill material, and any excavation associated with a dredged or fill project, either temporary or permanent, in waters of the United States at this site,this office should be notified by a proponent of the project for proper Department of the Army permits or changes in permit requirements pursuant to Section 404 of the Clean Water Act. Waters of the U.S. includes ephemeral, intermittent and perennial streams their surface connected wetlands and adjacent wetlands and certain lakes and ponds that have a nexus to interstate commerce. I wish to inform you of an on going Environmental Protection Agency(EPA) enforcement action concerning the existing mining activity by Hall-Irwin associated with this proposed amendment. Box 296 - Brighton, Colorado 80601 - Phone 659-7004 April 4, 2001 CASE NUMBER: 2ndAmUSR-1172 PROJECT: Site Specific Development Plan and Special Review Permit for a Gravel Mining Operation for Hall-Irwin (Baseline Site) PLANNER: Lauren Light NRCS REPESENTATIVE: Andrea Leonard, Soil Conservationist In consultation with the Natural Resources Conservation Service (NRCS), we have reviewed the above referenced case and have the following comments (these comments were also sent to the Weld County Department of Planning Services): SOILS/LIMITATIONS: No additional buildings or sanitary facilities will be needed. PRIME FARMLANDS: This land is not considered prime farmland. SOIL EROSION POTENTIAL: Most of the soil covered by this application is considered highly erodible and should be protected. Mining or construction on this soil should be planned so as to disturb as little soil as possible at any one time, and measures should be taken to prevent soil movement offsite. OTHER: The application failed to address a number of items: • The applicant needs to contact Ron Broda, Vegetation Weed Management Specialist with the Weld County Public Works Department at(970) 356-4000 X 3770 to develop a weed management plan. A weed management plan developed in concurrence with Weld County is recommended as a means of controlling noxious and other weeds. • The choice of species for revegetation appears to be adequate, however, there is no mention of establishment methods. If these species are not planted and cared for in the right way, they will have a poor chance of being successfully established. The applicant should complete a revegetation plan that includes this information if this has not already been done. • There is no mention of how topsoil would be treated or stockpiled during mining operations. Topsoil should be saved to assist in revegetation and should be protected from erosion until revegetation occurs. The NRCS can be contacted if the applicant needs technical information to assist in developing a more complete revegetation plan or information on stockpiling topsoil. The District welcomes the opportunity to review and comment on proposals such as this. Conservation and wise use of out natural resources are foremost in our goals and objectives. Included in the use by special review packet, is a section concerning proposed water supply and water source. We note that a substitute water supply plan and well permit process have been initiated by Rocky Mountain Consultants, Inc. This is the correct process to obtain the necessary permits from this office. However, without the Division of Minerals and Geology' identification number, for instance "M90123", we cannot assess the status of the permits. Our database is based upon these "DMG" file numbers. Should you desire further status from this office on the review of the above referenced project, please include the DMG file number. Our comments and requirements are as follows: COMMENTS: WCR 2 is designated on the Transportation Plan Map as an arterial status road,which requires a 100-foot right-of- way at full build out. There is presently a 60-foot right-of-way. This road is not maintained by Weld County. The applicant has entered into a Road Maintenance and Improvements Agreement with Adams County for the haul route. A copy was supplied to the Department of Planning Services as a requirement of the amended USR-1172 in December of 1999. REQUIREMENTS: Improvements Agreement: A note shall be placed on the plat which states the applicant shall enter into a Road Maintenance and Improvements Agreement with the Board of County Commissioners if, at any time in the future, `maintenance of WCR 2 becomes the responsibility of Weld County. WCR 2 (168"' Street) has been designated as the haul route from the facility. We have no objections to the proposal,however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be incorporated into the permit as"development standards": 1. The facility shall operate in accordance with the approved dust control plan submitted April 25, 2001. The facility shall have sufficient equipment available to implement dust control as required by the Weld County Department of Public Health and Environment. 2. The facility shall operate in accordance with the rules and regulations of the Air Pollution Control Division of the Colorado Department of Public Health and Environment at all times. 3. All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a"solid waste" in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 5. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 6. Fugitive dust shall be controlled on this site. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. 8. Adequate toilet and handwashing facilities shall be provided for employees. Water for sanitary facilities shall be provided by the onsite well. 9. The applicant shall remove,handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 10. The operation shall comply with all applicable rules and regulations of the Colorado Division of Minerals and Geology. EXHIBIT X1 2n°AMUSR Hall-Irwin(Baseline Site) Page 2 11. The applicant shall comply with the Occupational Safety and Health Act(OSHA). 12. The applicant shall comply with the Mine Safety and Health Act(MSHA). 13. All fuel tanks, septic tanks, temporary buildings, and any other hazardous items that might wash away during flooding shall be securely anchored and adequately flood proofed to avoid creation of a health hazard. 14. Portable toilets may be utilized on sites that are temporary location of the working face and portable processing equipment, etc. for up to six months at each location. 15. The septic systems that serve the scale house and shop/office shall comply with the Weld County I.S.D.S Regulations. 16. The facility shall utilize bottled water for the employees and public. Hello
