HomeMy WebLinkAbout20010745.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST SAUL AND PAULINE ENCINIA FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Saul and Pauline Encinia, VI #0000331, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 20th day of March, 2001, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Saul and Pauline Encinia were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until April 20, 2001, to allow adequate time for the property owners to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. He said that one of the mobile homes is his brother's. He said that it was suppose to be gone this last May, but his brother never came and got it. He asked for a 30 day extension to remove the mobile home. The other mobile home he is going to get a "Temp during construction" zoning permit and building permit. He asked me to mail that to him. He is going to demolish his old house and restore a new one. He also acknowledged the other issues that we (DPS) addressed in our letter. I infouned him that as long as I could see improvement, I would continue the violation.
