RE: APPROVAL OF DRAINAGE IMPROVEMENTS AGREEMENT WITH TOWN OF
LA SALLE AND AUTHORIZATION FOR CHAIRMAN TO SIGN SAME
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Town of La Salle desires to install drainage
improvements along the north side of First Avenue from Fifth
Street approximately 630 feet to the west, and
WHEREAS, approximately 20 percent of the project is along
Weld County Road right-of-way, and
WHEREAS, the estimated cost of said project shall be
$30, 690. 00 with Weld County to pay 20 percent of said cost, up
to a maximum of $6, 500. 00 and the Town of La Salle shall be
responsible for the bidding, construction inspection and other
related contract administration duties, and
WHEREAS, the Town of La Salle shall provide Weld County
with documentation indicating that they have taken competitive
bids for said project, and
WHEREAS, the Board. of County Commissioners of Weld County,
Colorado has studied said agreement, attached hereto and incor-
porated herein by reference, and deems it advisable and in the
best interest of Weld County to approve said agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the drainage improvements
agreement with the Town of La Salle be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be,
and hereby is, authorized to sign said agreement.

DRAINAGE IMPROVEMENTS AGREEMENT
THIS AGREEMENT, made and entered into this O day of c, �r.�---' ,
1982 , by and between the Town of LaSalle, hereinafter ref rred to
as the "Town" , and the County of Weld, hereinafter referred to as
the "County" :
WHEREAS, the Town desires to install drainage improvements along
the north side of 1st Avenue from 5th Street approximately 630 feet
to the west, and,
WHEREAS, approximately 20 percent of the project is located outside
of the Town limits and being along County Road right-of-way, and,
WHEREAS, the drainage improvements will improve Town streets and
County roads, and,
WHEREAS, the drainage improvements have been estimated to cost
$30 ,690 . 00,
NOW, THEREFORE, it is agreed as follows :
1. The County agrees to pay 20 percent of the cost
of the drainage improvements up to a maximum of
$6 ,500. 00.
2 . The Town will be responsible for the bidding,
construction inspection, and other related
contract administration duties for the installa-
tion of the drainage improvements .
3 . The Town will provide the County with documentation
indicating they have taken competitive bids for
installation of the drainage improvements .
IN WITNESS WHEREOF the municipality, by resolution duly adopted by
its governing body, caused this Agreement to be signed by its mayor
and attested by its Clerk , and the County of Weld, by the County
Board of Commissioners has caused these presents to be subscribed
by the Chairperson of said board and the seal of said Board to be
affixed thereto and attested by the clerk of said Board, all on
the day and year first above written.

Dear Mr. Carlson,
RE : First Avenue , La Salle , Colorado Storm Drainage Problem.
Thank you for your letter dated March 30, 1979 . We were , however,
disappointed to find that you feel the problem is primarily the
Town of La Salle ' s .
If we were to merely solve our problem, the drainage within our
limits , we would create a serious problem for the County. Because
of this we are anxious to work with the County to solve the problem
for all concerned.
While we understand that the County cannot assist in the planning
of the project , we do feel that the County and the Town could
share in the problem since a large portion of the work to be done
is outside the corporate limits of La Salle .
We feel a more equitable solution would be to work together on
the project , the Town would pay the costs incurred to our limits
and the County would pay the costs incurred from that point on.
Your prompt attention to this matter would be greatly appreciated
as we are anxious to come to an agreement .

Subject: Drainage on First Street
Dear Mr. Clement:
The First Street drainage problem has been studied by the County
Engineering Department. Although the Commissioners are of the
opinion that this is primarily a town problem, we had done some
engineering and are forwarding our old preliminary plan and a
current cost estimate for your use.
It is recommended that you obtain the services of a consultant to:
a) . Review and modify the enclosed plan to discharge the drain
into the Union Ditch.
b) . Prepare a plan and specification to bid the job on contract.
c) . Obtain drainage easement across the private property.
d) . Obtain discharge permit from Union Ditch Company.
The cost estimate for accomplishing this work is $30,000. If the
Town of LaSalle will contract this work out, Weld County will be
willing to share 20% of the cost, based on the fact that part of
the drain system is outside the City Limits.
I do regret that the County can not offer more assistance in planning
this project. Our Engineering Staff is already committed to com-
pleting several urgent County Projects that are scheduled for this
summer.

RE: FIRST AVENUE, LA SALLE STORM DRAINAGE PROBLEM
Thank you very much for meeting with us on August 21 , 1978 concerning
the above problem. We sincerely appreciate your attention to this pro-
ject and hope we can continue working together to reach a solution.
Because over a month has expired since our meeting we are curious about
the progress of the project and wonder if further information and/or
assistance is needed to proceed further. If this is the situation
we are eager to participate as fully as needed at any time in order to
expedite the process.
