Subject: Intergovernmental agreements with school
districts
Dear Commissioners:
Milliken and Johnstown have responsibly joined the
ever growing list of Weld County municipal governments
committing themselves to intergovernmental agreements
with school districts. These agreements will assure
there is funding for necessary new school sites and
site facilities as Weld County/Es rapid growth I.50
continues. They will ensure that at least some of the J Q

burden of school financing will be born by those 01`)

moving into new homes in the County and thus adding to
the schools/E student loads. Neighboring counties and
their municpalities have almost without exception
entered into such agreements with their school
districts.
If new home construction only took place within the
municipalities in the county, the agreements between
them and the school districts would be sufficient to
cover new residential construction. However, as we are
all aware residential construction is also taking
place on unincorporated County land. As an example, in
the MUD district the Weld Comprehensive Plan [P3-17]
has projected a population of 30,000 people in 13,500
dwellings on unincorporated Weld land which would not
be covered by an IGA with the St. Vrain Valley School
District.
It is difficult to comprehend the past opposition of
Weld County Commissioners to such an urgently needed
agreement. Are the 10 Weld County school districts all
erring in requesting Weld government to negotiate
IGAs? Can the adjacent counties and many Weld
municipalities be wrong in making these agreements?
As it stands, in some cases, Weld County Planning
Services staff requests an agreement for land or
cash-in-lieu between the developer and the school
district. Wording such as: oThe applicant shall

District and provide written evidence to the Dept. of
Planning Services that an agreement has been madeo
[Meadow Vale II] and oEvidence shall be submitted to
the Dept. of Planning Services that the requirements
of the Thompson School District R2-J have been metao
[Markham PUD] are typical.
Commendably, The Board has sponsored intergovernmental
agreements with County municipalities to coordinate
development in their environs [it is to be hoped that
much needed ones can be successfully negotiated with
the Cities of Greeley and Longmont]. IGAs with school
districts would serve the purpose of standardizing and
formalizing school requirements for land or cash in
lieu throughout each school district. We have an
opportune moment to discuss negotiations as a part of
the meeting tomorrow with officials of the St. Vrain
Valley School District as a part of Comprehensive Plan
discussions.
