Vanhooser 13059 East Parkview Avenue, Suite 110 Centennial, CO 80111 Subject: Substantial Change Determination (AmUSR-477) Dear Mr. Vanhooser, The Department of Planning Services and Public Health and Environment have reviewed your submitted materials regarding the addition of a Crude Oil Storage Tank on your existing facility located in the NW/4, Section 20, T2N, R66W, 6th P.M., Weld County, Colorado. Weld County Planning Staff has determined that the proposed addition of a single crude oil storage tank, of the approximate volume of the existing tank, is not a substantial change to the existing Use by Special Review. Any future changes, deemed substantial, will require an amendment to your USR. In addition to adherence to the Development Standards outlined in USR-477A, please note the following: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. Last year CPL submitted a proposal to the Weld County Planners to construct a new crude oil storage tank across Weld County Road 20 from our existing facility. Due to concerns about this construction, we withdrew our request and have been researching other options. Our plan now is to construct another storage tank inside our existing facility boundaries. All the associated piping, dikes and other appurtenances will be located on our existing property,covered by the subject USR. This new tank, once it is in service, will allow us to take the existing tank out of service and perform some maintenance work on it. Once that is accomplished, we will then have the capability to use both tanks,if needed,and will be able to limit our use to one tank if any repairs need to be done on the other. We request your approval of this project as a "Non-Substantial" change to our existing USR I have enclosed drawings showing our facility and the location of the new tank.
