The submitted materials are in compliance with the application requirements of Section 23- 2-260 of the Weld County Code. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 23-2-220 of the Weld County Code as follows: a. Section 23-2-220.A.1 -- The proposed use is consistent with Chapter 22 and any other applicable code provisions or ordinances in effect. Section 22-5-80.8.1 Platte Sand 8 Gravel,LLC-USR 1306,page 3 (CM.Goal 2) states, "Promote the reasonable and orderly development of mineral resources." The proposed use would be compatible with surrounding properties which include agricultural uses to the east, north and south. The South Platte River is adjacent to the property to the west. Further, no prime farm land will be taken out of production with this proposal. b. Section 23-2-220.A.2 -- The proposed use is consistent with the intent of the A (Agricultural) Zone District. Section 23-3-40.A of the Weld County Code provides for Mineral Resource Development facilities including a Concrete,Asphalt and Pre- cast Batch Plants and Gravel Mining as a Use by Special Review in the A (Agricultural) Zone District. c. Section 23-2-220.A.3--The uses which will be permitted will be compatible with the existing surrounding land uses. The proposal will be compatible with existing surrounding land uses which include agricultural lands with scattered rural residences in the general area. d. Section 23-2-220.A.4 -- The uses which will be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with the future development as projected by Chapter 22 of the Weld County Code and any other applicable code provisions or ordinances in effect, or the adopted Master Plans of affected municipalities. The surrounding land uses are primarily agriculture. There are scattered rural residences in the area. To the north is the Union Pacific railroad line,to the east is irrigated crop land; to the south is river bottom land including riparian lands. The west is bordered by the South Platte River, the land across the river is river bottom lands and some crop land. There are five houses within five hundred (500)feet of the permit area, three are owned by the land owners associated with this application. The remaining two are located outside of the permit area. The Town of Milliken is immediately north of and adjacent to the permit area, with the Town of Platteville southeast of the property. The area to be mined is outside of the Urban Growth Boundary areas for both of these municipalities. The Town of Platteville in a referral dated January 11, 2001 voted unanimously against this proposal as "the Commission feels that this does not comply with [the] Comprehensive Plan. The Comprehensive Plan designates land up to WCR 36 as Low Density, Low-Medium Density and High Density residential areas." Weld County Planning Staff notes that this area is limited by flood plain and may be unsuitable for residential development as outlined in Section 22-5-50.A.2.a specific to open space, parks and recreation goals and policies. In a referral received January 31, 2001, the Town of Milliken voted 6-1 to recommend denial of this request on the basis that the Town of Platteville recommended denial based on inconsistencies with the Town of Platteville Comprehensive Plan. Board members expressed concerns about noise, dust, hours of operation and maintenance of the area road system. Planning Staff concurs that, with the endorsement of the Conditions of Approval, contained in this recommendation,the approval of this use will not jeopardize the health, safety and welfare of the surrounding property owners. Platte Sand&Gravel,LLC-USR 1306,page 4 e. Section 23-2-220.A.5 -- The application complies with Section 23-5 of the Weld County Code. The proposal is located within the Flood Hazard Overlay District area as shown on FIRM Community Panel Map #080266-0750C dated September 28, 1982. Conditions of Approval and Development Standards address the issue of the flood plain. Section 22-5-80.E.2.d (CM.Policy 5.4)states"the operation will comply with the County flood hazard regulations...." Further,Section 22-5-80.B.1 promotes the reasonable and orderly development of mineral resources. f. Section 23-2-220.A.6—The applicant has demonstrated a diligent effort to conserve prime agricultural land in the locational decision for the proposed use. The subject site has a limited amount of prime agricultural land. A majority of the property lies within the one hundred (100) year flood plain that limits the agricultural productiveness of the site. The area within the flood plain has historically been utilized as pasture land. g. Section 23-2-220.A.7 -- The Design Standards (Section 23-2-240, Weld County Code), Operation Standards (Section 23-2-250, Weld County Code), Conditions of Approval,and Development Standards ensure that there are adequate provisions for the protection of health, safety, and welfare of the inhabitants of the neighborhood and County. h. Section 23-4-250--Additional requirements for Open-mining have been addressed through this application and the Development Standards will insure compliance with Section 23-4-250 Weld County Code. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Department of Planning Services'staff recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review Plat prior to recording. The completed plat shall be delivered to the Weld County Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 30 days of approval by the Board of County Commissioners. (Department of Planning Services) 2. Prior to scheduling a Board of County Commissioners hearing: A. Section 22-5-100.A of the Weld County Code states "oil and gas exploration and production should occur in a manner which minimizes the impact to agricultural uses and the environment and reduces the conflicts between mineral development and current and future surface uses." Section 22-5-100.B of the Weld County Code states "...encourage cooperation, coordination and communication between the surface owner and the mineral owner/operators of either the surface or the mineral estate." Finally, Section 22-5-100.6.1 of the Weld County Code states "new development should be planned to take into account current and future oil and gas drilling activity to the extent oil and gas development can reasonably be anticipated." Platte Sand&Gravel,LLC-USR 1306,page 5 The applicant shall either submit a copy of an agreement with the property's mineral owner/operators stipulating that the oil and gas activities have been adequately incorporated into the design of the site or show evidence that an adequate attempt has been made to mitigate the concerns of the mineral owner/operators. The plat shall be amended to include any possible future drilling sites. (Department of Planning Services) B. The applicant shall submit a letter from the United States Department of Interior, Fish and Wildlife Service indicating if surveys will be required for threatened or endangered plants and animals as outlined in a letter from the Colorado Natural Heritage Program dated December 22,2000. If a survey is required,the survey will be conducted and submitted to the Department of Planning Services. (Department of Planning Services) C. The applicant shall submit a signed copy of an agreement with the Western Mutual Ditch Company regarding the requirements and concerns as outlined in the letter from their legal counsel dated January 26, 2001. Evidence shall be submitted to the Weld County Department of Planning Services for review and approval. (Department of Planning Services) D. The applicant shall submit a letter or provide evidence that an adequate attempt has been made to mitigate the concerns of the Colorado Division of Wildlife indicating that their concerns have been addressed as outlined in the letter dated August 18, 2000 and February 7, 2001 specific to the riparian vegetation and trees along the river; the threatened or endangered plants and animals, i.e., Preble's meadow jumping mouse, Ute Ladies'-tresses orchid,the numerous prairie dog colony(s),the habitat for the western burrowing owls; and the Colorado butterfly plant. If a survey and/or evaluation is required and is performed, the survey will be conducted and submitted to the Department of Planning Services. (Department of Planning Services) E. The applicant shall submit a letter or provide evidence that an adequate attempt has been made to mitigate the concerns of Public Service Company of Colorado (Xcel Energy)indicating that their concerns have been addressed as outlined in the letter dated February 6, 2001, specific to the twenty-four (24) inch high pressure gas transmission line that traverses the property southwest to northeast. Second, the issue of the 44kV and 230kV electric transmission lines shall be addressed relative to the areas to be mined on the property. Evidence shall be submitted to the Weld County Department of Planning Services for review and approval. (Department of Planning Services) F. This development will increase the traffic on Weld County Roads 23, 36 and 40 above the EPA guidelines. These are all gravel roads. A traffic impact study with proposed mitigation will be required. Evidence of approval shall be submitted to the Weld County Department of Planning Services. (Dept. of Public Works, CDOT) G. The applicant represents that the intended life of the Mineral Resource Development facilities, including a Concrete,Asphalt and Pre-cast Batch Plant and Gravel Mining,will not exceed 40 years. Reclamation may continue beyond the 40 Platte Sand&Gravel,LLC-USR 1306,page 6 year time frame permit and post mining uses will be allowed so long as they are consistent with uses allowed by the Weld County Code in the Agricultural Zone District as it exists at the time of expiration of this permit. Notwithstanding the foregoing, neither the applicant nor his successors are precluded from applying for an amendment to this permit which amendment shall be reviewed and considered under the provisions of the Weld County Code and other applicable law in effect at the time of application for amendment. Applicant has waived any claim that the Weld County Code or the Vested Property Rights Provisions of the Colorado Revised Statutes, C.R.S.§§24-68-101 et seq and other statutory or Constitutional provisions preclude the Board of County Commissioners from applying the Weld County Code as it exists at the time of the amendment. Prior to or concurrent with the Board of County Commissioners hearing, applicant and sand and gravel owners on behalf of the shareholders of Platte Sand and Gravel, LLC and their heirs and successors in interest, shall enter into a written development agreement with the Board of County Commissioners pursuant to C.R.S. § 24-68-104(2). This agreement, in pertinent point, shall provide that any vested rights created by statute would be modified by the terms of the agreement, that the term of the Mineral Resource Development facilities special review permit shall not exceed 40 years and that any amendment to this permit shall be reviewed and considered under the provisions of the Weld County Code and other applicable law in effect at the time of application for amendment. Furthermore, a failure to abide by the terms and conditions of the permit will result in a forfeiture of vested property rights. Such approval of the permit and site specific development plan shall be subject to all rights of referendum and judicial review and subject to any voter initiated Weld County Home Rule Charter amendments imposing new or additional requirements on the operation of the Mineral Resource Development facilities. As consideration for the agreement, the Board of County Commissioners agrees that the property rights designated in C.R.S. 24-68-101 et seq. As modified by this agreement, shall be extended to run for a period of 12 years from the notice of approval. 3. Prior to recording the plat: A. The plat shall be amended to delineate the following: 1) The post mining reclamation plan shall adhere to the recommendations of the Colorado Division of Wildlife as outlined in their referral letter dated August 18, 2000 specific to the irregular shorelines and the construction of a minimum of two islands per pond. Shorelines and island shapes including depth of the pond shall include shallow waters enabling a diversification of plant, aquatic plant and animal species to be established. (Department of Planning Services, Division of Wildlife) 2) A minimum of ten (10) feet of clearance from any existing power line or future power line shall be maintained at all times as outlined by State Statute and as outlined in the referral from Excel Energy dated January 12, 2001. (Xcel energy) Platte Sand&Gravel,LLC-USR 1306,page 7 3) The location of the twenty-four(24) inch high pressure gas line and electric transmission lines that transects the site. (Department of Planning Services, Xcel Energy) 4) The location of any on-site signs. (Department of Planning Services) 5) The approved Landscape,Screen and Berm Plan. (Department of Planning Services) 6) The location of the Bald Eagle roost approximately 1/2 mile above the confluence of the South Platte and St. Vrain Rivers shall be delineated on the plat. Further,as recommended by the Division of Wildlife in their referral dated April 26, 2001, a one eighth mile buffer around the periphery of this roost shall be delineated on the plat. (Department of Planning Services, Division of Wildlife) 7) The location of the 20-25 acre conservation easement as agreed to in principle with the Division of Wildlife as stated in their letter of April 26,2001. (Department of Planning Services, Division of Wildlife) B. The applicant shall remove or anchor any tires that may be washed downstream if high water occurs in the river. The applicant shall provide written photographic evidence to both the Weld County Departments of Planning Services and Public Health and Environment that this item has been completed. (Department of Public Health and Environment, Code Compliance) C. The applicant shall remove and properly dispose all tires not being anchored for erosion control and any other miscellaneous debris, i.e., appliances that exist on site. The applicant shall provide written receipts and photographic evidence to both the Weld County Departments of Planning Services and Public Health and Environment that this item has been completed. (Department of Public Health and Environment, Code Compliance) D. An Air Pollution Emission Notice(A.P.E.N.)and Emissions Permit application must be submitted to the Colorado Department of Health and Environment, Air Pollution Control Division, Colorado Department of Public Health and Environment for emissions from the mining operations. The site shall operate in accordance with all applicable rules and regulations of the Air Pollution Control Division. (Department of Public Health and Environment) E. The applicant shall submit a NPDES Permit to the Water Quality Control Division of the Colorado Department of Public Health for proposed discharge into State waterways.Evidence of approval shall be submitted to the Weld County Department of Planning Services. (Department of Public Health and Environment) F. A Dust Abatement Plan shall be submitted to the Weld County Department of Public Health and Environment, Environmental Health Services Division. Evidence of approval from the Weld County Public Health and Environment shall be submitted Platte Sand&Gravel,LW-USR 1306,page 8 to the Weld County Department of Planning Services. (Department of Public Health and Environment) G. Environmental Health Services Division was unable to locate septic permits for the septic systems within this USR boundary. The systems will require a Statement of Existing and an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). The review shall consist of observation of the system and an evaluation of the system(s) ability to handle the proposed hydraulic load. In the event the system(s)is found to be inadequate,the system(s)must be brought into compliance with current I.S.D.S. Regulations. (Department of Public Health and Environment) H. The septic system proposed for the office ranch complex shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public health and Environment. In the event the system is found to be inadequately sized or constructed,the system shall be brought into compliance with current Regulations. (Department of Public Health and Environment) The facility shall submit a written plan and engineered design of a vehicle washing area to the Weld County Department of Public Health and Environment for review and written approval. The washing area shall be designed and constructed to capture all effluent from drum washing and washing of vehicle exteriors. The plan should address how water generated from the drum washing and washing of vehicle exteriors will be recycled and any other information necessary to demonstrate that the facility will be adequately constructed and operated to prevent discharges of waste water. Evidence of approval shall be submitted to the Weld County Department of Planning Services. (Department of Public Health and Environment) J. The applicant shall submit a Landscape Plan identifying the number, size and species of all plant material to the Weld County Planning Department for review and approval.This plan shall include specifications of any proposed berm's, if required. The proposed berm's will be extended to mitigate impacts to surrounding properties and adjacent road rights-of-way. Any berm placed in the one hundred (100) year flood plain of the South Platte River can not obstruct passage of flood flows. The applicant shall use breaks in the berm with landscaping to fill the void, culverts, or some other method that will allow water to flow freely. (Department of Planning Services) K. Further, the Landscape Plan shall be prepared in accordance with the recommended trees, shrubs, conifers, grasses and legume species as outlined in the referral dated August 18, 2000 from the Colorado Division of Wildlife. (Department of Planning Services) L. The applicant shall apply for and be approved for a Flood Hazard Development Permit for any development that will increase or decrease the base flood elevation in the flood plain as delineated on FIRM Community Panel Map#080266 0750 C, dated September 28, 1982. (Dept. of Planning Services) Platte Sand&Gravel,LLC-USR 1306,page 9 M. The applicant shall obtain a Flood Hazard Development Permit for any new structures including parking areas. (Dept. of Planning Services) N. Weld County Road 23 and Weld County Road 36 are both identified on the Weld County Transportation Plan Map as local gravel,chemically stabilized roads. Weld County Road 23 had an average daily traffic(ADT)count of 145 vehicles,and Weld County Road 36 had an ADT count of 173 vehicles. Both traffic counts were taken in November 1999. Weld County Road 32.5 is the nearest paved road south of the facility and it had an average traffic count 982 vehicles taken in May 1999. This development will increase the traffic on Weld County Roads 23, 36 and 40 above the EPA guidelines. These are all gravel roads. A traffic impact study with proposed mitigation will be required. Evidence of approval shall be submitted to the Weld County Department of Planning Services. (Dept. of Public Works) All new commercial development that exceeds the ADT of more than 200 vehicles will be required to submit a traffic study as a part of the review process. The study shall include a description of the project,vehicle traffic generation and distribution, verification of adequate acceleration, deceleration and storage facilities at all impacted intersections, review of bridge capability, intersection level of service, analysis for existing and proposed conditions, recommendation for the needs and upgrades to transportation infrastructure to support the development. (Dept. of Public Works) O. The designated haul route will impact both U.S. Highway 85 and State Highway 66; therefore, the Colorado Department of Transportation (CDOT) shall review the traffic impact study to determine any additional needs that may be required. Further,the port-of-entry weigh station is within the five-mile radius of the proposed facility. CDOT may require additional permits as the main designated haul route bypasses the port-of-entry. Evidence of CDOT approval shall be submitted to the Weld County Department of Planning Services. (Dept. of Public Works) P. The Weld County Public Works Department will require an Off-Site Road Improvements Agreement for the designated haul routes. The Improvements Agreement shall be reviewed by the County; collateral shall be tendered to cover the improvements and the Improvements Agreement shall accepted by the Board of County Commissioners. The traffic impact study will determine the proposed haul routes,improvements,and maintenance requirements to mitigate the proposed roadway use. (Dept. of Public Works) Q. The applicant shall attempt to address the concerns of the Weld County Sheriff's Office as outlined in their letter dated January 15, 2001. Evidence of Weld County Sheriff's Office approval shall be submitted to the Weld County Department of Planning Services. (Dept. of Planning Services) R. The applicant shall submit evidence that a Plan is in place to eradicate the noxious weeds(Leafy Spurge, Russian Knapweed, Diffuse Knapweed, Spotted Knapweed, Platte Sand&Gravel,LLC-USR 1306,page 10 Canada Thistle, Musk Thistle,Scotch Thistle and Field Bindweed,etc.)and all other noxious plants have been eradicated from the property. The applicant should contact Ron Broda of the Department of Public Works to schedule a time to address this issue. Evidence of Weld County Department of Public Works approval of an Eradication Plan addressing the eradication of all on-site noxious weeds shall be submitted to the Weld County Department of Planning Services. (Dept.of Planning Services) S. The applicant shall attempt to address the issues and concerns of the Town of Platteville as stated in their referral dated January 9, 2001. Evidence of approval shall be submitted to the Weld County Department of Planning Services. (Dept. of Planning Services) T. The applicant shall address the issues and concerns of the Town of Milliken as stated in their referral dated January 11, 2001. Evidence of approval shall be submitted to the Weld County Department of Planning Services. (Dept.of Planning Services) U. The applicant shall provide evidence from Union Pacific railroad that the activities associated with mining will not impact the existing rail line that transects the northern property. Further, the applicant shall provide evidence that Union Pacific railroad will permit a spur rail line and loading yard to be constructed adjacent to the existing rail line. Evidence of approval from Union Pacific shall be submitted to the Department of Planning Services. (Dept. of Planning Services) 4. Prior to operation: A. The applicant shall provide evidence to the Department of Planning Services receipt of the Division of Minerals and Geology Permit,Mined Land Reclamation Permit 112 to conduct surface extraction of construction materials and reclamation of said lands as identified in File Number M-2000-158 and per letter from the Division of Minerals and Geology dated December 27, 2000. Proper building permits shall be obtained in accordance with the referral response from the Weld County Building Inspection Department dated December 26, 2000, prior to any construction, demolition, or excavation. Part of the permit application process includes a complete plan review. (Dept. of Building Inspection) C. Site drawings shall be submitted to the Milliken and Platteville-Gilcrest Fire Protection District. Evidence of attempt to comply with Fire District requirements shall be submitted to the Weld County Department of Planning Services. (Dept. of Building Inspection) D. The applicant shall provide evidence that all issues involving water rights, including a water court approved plan for augmentation or substitute water supply plan has been approved by the State of Colorado, Division of Water Resources. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. The Site Specific Development Plan and Special Use Permit is for Mineral Resource Development facilities including a Concrete,Asphalt and Pre-cast Batch Plant and Gravel Mining in the A(Agricultural)Zone District, as indicated in the application materials on file and subject to the Development Standards stated hereon. (Department of Planning Services) 2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld County Code. (Department of Planning Services) 3. Platte Sand&Gravel,LLC and/or their successors shall be permitted to operate the Mineral Resource Development facilities including a Concrete, Asphalt and Pre-cast Batch Plant and Gravel Mining for a period not to exceed forty(40)years for the mining of the site from the date of approval by the Board of County Commissioners under this permit. All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination.(Department of Public Health and Environment) 5. No permanent disposal of wastes shall be permitted at this site. (Department of Public Health and Environment) 6. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,blowing debris,and other potential nuisance conditions. (Department of Public Health and Environment) 7. Fugitive dust shall be controlled on this site.(Department of Public Health and Environment) 8. The site shall operate in accordance with all applicable rules and regulations of the Air Pollution Control Division. (Department of Public Health and Environment) 9. The facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone District as delineated in 25-12-103, C.R.S. (Department of Public Health and Environment) 10. Adequate toilet facilities shall be provided for the employees and visitors. (Department of Public Health and Environment) 11. The facility shall utilize bottled drinking water for the employees. (Department of Public Health and Environment) Platte Sand&Gravel,LLC-USR 1306,page 13 12. The facility shall operate in accordance with the approved dust abatement plan at all times. The facility shall have sufficient equipment available to implement dust control as required by the approved Dust Abatement Plan. (Department of Public Health and Environment) 13. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. (Department of Public Health and Environment) 14. The operation shall comply with the Occupational Safety and Health Act (OSHA). (Department of Public Health and Environment) 15. The operation shall comply with the Mine Safety and Health Act (MSHA). (Department of Public Health and Environment) 16. The operation shall comply with all applicable rule and regulations of the Colorado Division of Minerals and Geology. (Department of Public Health and Environment) 17. Portable toilets may be utilized on sites which are temporary locations of the working face and portable processing equipment, etc., for up to six months at each location. (Department of Public Health and Environment) 18. In the event that five (5) or more acres are disturbed during the construction and development of this site,the applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and Environment. (Department of Public Health and Environment) 19. All operations on said described parcel shall be in conformance with the Weld County Flood Regulations including: a. No fill, berms,or stockpiles shall be placed in the one hundred(100)year flood plain of the South Platte River which would obstruct passage of flood flows. (Dept. of Planning Services) b. All fuel tanks,septic tanks,temporary buildings,and any other hazardous items that might wash away during flooding shall be securely anchored and adequately flood proofed to avoid creation of a health hazard. There shall be no discharge of waste water from the washing of vehicles on the facility. All vehicles shall be washed in the approved vehicle washing area. All water, concrete and aggregate generated from the washing of vehicles should be recycled in the concrete mixing process. (Department of Public Health and Environment) 21. The operation shall comply with all applicable rules and regulations of the Federal Emergency Management Agency including a Letter of Map revision if determined to be applicable. (Dept. of Planning Services) 22. "No Trespassing" signs shall be posted and maintained on the perimeter fence to clearly identify the boundaries of the site. Lighting provided for security and emergency night operation on the site shall be designed so that the lighting will not adversely affect surrounding property owners. (Dept.of Planning Services) 24. Section 23-4-290.6 of the Weld County Code limits the hours of operation for sand and gravel operations to the hours of day light except in the case of public or private emergency or to make necessary repairs to equipment. Hours of operation may be extended with specific permission from the Weld County Board of County Commissioners.This restriction shall not apply to operation of administrative and executive offices or repair and maintenance facilities located on the property. Existing trees and ground cover along public road frontage and drainage ways shall be preserved, maintained, and supplemented, if necessary, for the depth of the setback in order to protect against and/or reduce noise, dust, and erosion. (Dept. of Planning Services) 26. Where topsoil is removed,sufficient arable soil shall be set aside for re-spreading over the reclaimed areas. (Dept. of Planning Services) 27. Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180. (Dept. of Public Works) 28. The plant material on site shall be maintained in accordance with the approved weed eradication plan. (Dept. of Planning Services) 29. If any work associated with this project requires the placement of dredge or fill material,and any excavation associated with a dredged or fill project, either temporary or permanent, in waters of the United States which may include streams, open water lakes and ponds or wetlands at this site, the Department of the Army, Corp of Engineers shall be notified by a proponent of the project for proper department of the Army permits or changes in permit requirements pursuant to Section 404 of the Clean Water Act. No mining shall occur during the months of November(14) through March (16)within the 1/8 mile radius of the Bald Eagle roost as delineated in the referral from the Colorado Division of Wildlife dated April 26, 2001. The property owner or operator shall be responsible for complying with the Operation Standards of Section 23-2-250, Weld County Code. 34. Personnel from the Weld County Departments of Public Health and Environment and Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County regulations. 36. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 37. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. Wildlife habitat adjacent to the river with eagles flying/roosting overhead. River corridor area is scenic and beautiful. Prairie dog colony(s) are numerous and located in southern area of property near Krystals Lake. Access to property: WCR 36 is gated at WCR 23. Access is gained to property at north end near WCR 42.5 or so. All points of access have cattle guards as the bottomland land has longhorn steers. St. Vrain Historical monument and grounds are within area to be mined. The granite monument is slated to be on the historical registered places for both state and national directories. In time the Platteville Historical Society will maintain grounds and fixtures. WCR 23 and 36 are chemically treated two lane roads 60 feet ROW.
