HomeMy WebLinkAbout20013248.tiff WELD COUNTY 199 CODE ORDINANCE NO. 2001-7 IN THE MATTER OF REPEALING AND RE-ENACTING, WITH AMENDMENTS, CHAPTER 20, ROAD IMPACT FEES, OF THE WELD COUNTY CODE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld, including the codification of all previously adopted ordinances of a general and permanent nature enacted on or before said date of adoption, and WHEREAS, the Department of Planning Services staff and Southwest Service Area Road Impact Fee Board have recommended a reduction in the service area and corresponding fee reduction of 28 percent be made in Chapter 20, Road Impact Fees, of the Weld County Code, specifically, changes to Table 20.2 and Appendices 20-C, 20-D, and 20-E, copies of which are attached hereto and incorporated by reference, and WHEREAS, the Weld County Planning Commission has recommended changes only to the Southwest Service Area, and WHEREAS, pursuant to Section 29-20-104.5(3), C.R.S., the County Attorney has recommended the addition of Sections 20-1-80 and 20-2-80. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County of Weld, State of Colorado, that a reduction in the service area and corresponding fee reduction of 28 percent be made in Chapter 20, Road Impact Fees, of the Weld County Code, specifically, that Table 20.2 and Appendices 20-C, 20-D, and 20-E of the Weld County Code be, and hereby are, repealed and re-enacted. BE IT FURTHER ORDAINED by the Board that the Sections 20-1-80 and 20-2-80 as written below, be, and hereby are, added to the Weld County Code CHAPTER 20 ROAD IMPACT FEES Section 20-1-80. No Requirement to Provide Any Site Specific Dedication or Improvement. No individual landowner within the Windsor Service Area is required to provide any site specific dedication or improvement to meet the same need for capital facilities for which the road impact fee is imposed pursuant to the terms of this Article. BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is, directed to arrange for Colorado Code Publishing to supplement the Weld County Code with the amendments contained herein, to coincide with chapters, articles, divisions, sections, and sub-sections as they currently exist within said Code; and to resolve any inconsistencies regarding capitalization, grammar, and numbering or placement of chapters, articles, divisions, sections, and sub-sections in said Code. BE IT FURTHER ORDAINED by the Board if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. The above and foregoing Code Ordinance Number 2001-7 was, on motion duly made and seconded, adopted by the following vote on the 26th day of November, A. D., 2001.
