The Station will have the capacity to compress and dehydrate 80,000,000 cubic feet per day (80 MMCFD) of raw natural gas from the Applicant's Wattenberg Gathering System. The Station will be capable of delivering gas to the Applicant's gas processing plant located within the 35 acre parcel, NARCO's processing plant located immediately to the North across WCR 22 via existing pipelines, BP-Amoco's Wattenberg Processing plant located near I-70 and E-470 via existing pipelines and Duke's Spindle Processing Plant located at WCR 19 and WCR 14.5 via existing pipelines. The proposed location of the Station was selected because of its proximity to other existing natural gas compression and processing facilities, thus making it compatible with existing uses. Specifically, the site is located immediately east of and adjacent to Applicant's Fort Lupton Gas Compressor Station situated on Weld County Road 22 and Applicant's Fort Lupton Processing Plant located immediately southwest of the proposed compressor station. Additionally,North American Resources Corporation operates its Fort Lupton Gas Compressor Station just to the north of the compressor station, on the north side of Weld County Road 22. A vicinity map is included on the Special Review plat map. The proposed site offers the further advantage of being on land that has not been cultivated and, while zoned Agricultural, is undeveloped range and grazing land. No additional water, sanitation or utility services are required because the facility will be operated as an adjunct to Applicant's existing Compressor Station and those needs will be met by existing facilities and services at the Compressor Station. The Station will operate 365 days per year, 7 days per week, 24 hours per day and will be designed so that it may be operated unattended. The Station will be operated by the same personnel who operate the Applicant's compressor station and processing plant, so it is not anticipated that there will be any material increase in local traffic. Page 1 of2 H\group\land\wason\usrapplicationforms\ftlupton0701\execsumm An automated emergency shut down system will constantly monitor conditions at the Station and shut it down in an emergency. In addition,the compressor building will be equipped with fire detectors and combustible gas monitors which will automatically shut down the compressors should either a fire or the escape of combustible gas be detected. A call-out system, operated on an uninterruptible power supply, will notify Applicant of Station shutdowns or any operational problems. Construction is expected to begin within two weeks from the time Applicant obtains its building permits and the Station will be operational approximately six months after construction begins. The number of persons involved in the construction is not anticipated to exceed fifty (50). Construction personnel will work from 7:00 a.m. to 5:30 p.m., Monday through Saturday. Construction equipment shall include backhoes and small(15T to 25T)cranes. Large cranes(80T to 110T) will be used for one day to set the compressors. This Application is the result of a comprehensive analysis of existing and projected future production of natural gas from the Wattenberg Area. The Wattenberg Gas Gathering System currently transports approximately 235 MMCF of natural gas per day to four primary Processing Plants for further treatment and compression of the gas. These Stations include the Applicant's Fort Lupton Processing Plant(120 MMSCFD),the BP-Amoco Wattenberg Gas Processing Plant(155 MMCFD),the NARCO Gas Processing Plant(55 MMCFD) and the Duke Spindle Gas Processing Plant(5 MMCFD). With the additional capacity of the applicant's Processing Plant,the gathering system is currently under utilized because of compression constraints. This results in some producers and operators being unable to sell and market their gas. This,in turn,adversely affects the efficient and economic recovery of gas as well as the economic life of some of the wells in the county. The projected increase in demand for natural gas,both locally and regionally,requires that additional capacity be provided and it is Applicant's belief that this Station can provide that additional capacity with minimal impact on neighboring property and owners,and in a manner that is consistent with existing uses and the objectives of the Weld County Comprehensive Plan. Explain, in detail, the proposed use of the property. HS Gathering, LLC, (the "Applicant")proposes to construct and operate a Natural Gas Compressor Station(the "Station") that will have the capacity to compress and dehydrate 80,000,000 cubic feet per day (80 MMCFD) of raw natural gas from the Applicant's Wattenberg Gathering System. The Station will be capable of delivering gas to the Applicant's gas processing plant located within the 35 acre parcel,NARCO's processing plant located to the immediately to the North across WCR 22 via existing pipelines, BP- Amoco's Wattenberg Processing plant located near I-70 and E-470 via existing pipelines and Duke's Spindle Processing Plant located at WCR 19 and WCR 14.5 via existing pipelines. Public Service Company of Colorado will provide fuel gas to the Station utilizing existing facilities for use in connection with Applicant's existing Fort Lupton Gas Compression Station and Gas Processing Plant. Likewise,the Station will take advantage of existing restroom and drinking water facilities at the compressor station so there will be no additional domestic water or sanitation needs. The Station will operate 24 hours per day, 7 days per week, 365 days per year and will be designed to be unattended for approximately 16 hours per day. A safety shutdown system will shut down the Station if required for safety reasons and will notify operators during unattended operations. The emergency shut down system will utilize automated valves to shut off gas into and out of the Station and to vent the gas contained in the compressor building. The compressor building will be equipped with fire detectors and combustible gas monitors which will automatically shut down the compressors in emergencies. A twenty (20) foot perimeter road will be installed on the property to provide access to the fire department and other emergency services. Ordinary debris,trash and waste will be disposed of by commercial dumpster services. Other waste, such as compressor lube oil and rags that have been contaminated with lube oil or NGL's,will be transported from the property to approved disposal facilities using certified transporters. Because of its proximity to existing, similar facilities and the avoidance of any encroachment on agricultural, residential, or other incompatible land uses, this proposal comports with the intent and stated goals of the Weld County Comprehensive Plan (the "Plan"). The Plan states that one of the most important considerations in land-use planning is the way the land is presently used. As noted elsewhere herein, the existence of Applicant's compressor station , the Applicant's gas processing plant and NARCO's gas processing plant within the immediate vicinity of this location means that similar uses can be assembled in a consolidated and coordinated manner. Utilities, services and roads already exist so there is no need for the expansion or extension of new facilities and services into areas where they do not already exist. In particular,this proposal avoids any interference with the operation of prime farmland within the County or encroachment upon residential or other potentially incompatible land uses. It will also contribute to the expansion of the County's industrial economic base by providing an essential function in the compression and dehydration of natural gas produced in the County. The Station will not be a consumer of water, thereby contributing to the goals of water conservation and maintenance of water quality. The proposal is also consistent with one of the overriding themes of the Plan,which is that new developments, projects and facilities are to "pay their own way." The operation of the Station will not impose any new burdens or costs upon the County and will be a self-sustaining operation. 3. Explain how this proposal is consistent with the intent of the Weld County Zoning Ordinance and the zone district in which it is located. Section 24.1 of the Weld County Zoning Ordinance ("Ordinance") contemplates and specifically provides for circumstances in which a particular land use is determined to be more intense or to have a potentially greater impact than uses otherwise allowed. That is the purpose of the Use by Special Review. In this case, the proposed location of the Station is in the Agricultural Zone District and,therefore, additional consideration is necessary to ensure that it is established and operated in a manner that is compatible with existing and planned uses in the neighborhood. In this case, compatibility with existing uses is assured because the Station will be located adjacent to an operating natural gas compressor station, adjacent to an operating gas processing plant and immediately south of an existing gas processing plant. No currently productive agricultural lands or residential areas will be impacted. Page 2 of 6 Mgroup\land\wason\usrappl icationforms\ftlup0701\questionnaire The compression, treatment and processing of natural gas produced in Weld County is a necessary component of marketing this valuable resource. Providing additional capacity to accomplish this will not only foster the development of an important economic base (Ordinance Sec.4.1.7)but, in so doing, will contribute to the convenience and general welfare of the present and future residents of the County (Sec. 24.1.1). The Station will contribute to the County's tax base (Sec. 4.1.5) with little or no adverse impact in terms of additional roads (Sec. 4.1.1) or other governmental expenditures (Sec. 4.1.6). In short,the Applicant believes the proposed Station is ideally suited to be located at the site that has been proposed, notwithstanding the fact that the zone district for that location will not permit its construction as a Use Allowed by Right. Because it is not being utilized as agricultural land, and there is no foreseeable reason that it would be so utilized, this proposal presents an ideal circumstance in which to permit a Use by Special Review. 4. What type of uses surround this site? Explain how the proposed use is consistent and compatible with surrounding land uses. The Station is proposed to be located in a remote, rural area in the vicinity of an existing natural gas compressor station and an existing natural gas processing plants. As such, it is consistent and compatible with those land uses. The subject property and the remainder of the surrounding land is undeveloped range land. The soil for the property is composed of Valent sand with limited potential for agricultural development due to its sandy texture and high permeability. The nearest residential property is located approximately 3960 feet from the site and it is not anticipated that operations at the Station will have any material impact on that residential property. Pictures of the proposed site and the adjoining compressor station are attached. 5. Describe,in detail,the following: a. How many people will use this site? Employees, maintenance personnel, contractors and representatives of other companies may be present at the site from time to time, but normally the Station will be unattended. A maximum of 10 people may be at the site at one time. b. How many employees are proposed to be employed at this site? Two operators currently operate the compressor station for 8 hours per day. c. What are the hours of operation? The Station will operate 24 hours per day, 7 days per week, 365 days per year. d. What type and how may structures will be erected(built) on this site? Major equipment to be installed at the site includes: 3 - Gas Compressors in a building, approximately 60' X 180' 1 - Tri-Ethylene Glycol regeneration skid, approximately 10'X 25' 1 -30' X 20 building to house electrical equipment and for storage 1 —Thermal Oxidizer Skid to limit air emissions, approximately 10' X 20' 4-2000 gallon bulk storage tanks 1 —trim cooler skid, approximately 9' X 30' The process skids are portable skids supporting the process equipment. The building housing the compressors will be similar in design and will be the same color as the existing buildings at the compressor station and gas plant located adjacent to the proposed Plant. e. What type and how may animals, if any, will be on this site? None. f. What kind(type, size, weight) of vehicles will access this site and how often? Operating personnel will use pickups to access the site each day. g. Who will provide fire protection to the site? The proposed Station is located within the Fort Lupton Fire Protection District. The compressor building will be equipped with combustible gas monitors and fire detectors. The fire detectors will shut down the Station and close inlet and outlet block valves. h. What is the water source on the property? (Both domestic and irrigation) There are no domestic or industrial water requirements for the proposed Station. There is an existing potable water system at the Applicant's adjacent Compressor Station. i. What is the sewage disposal system on the property? (Existing and proposed) There are no sewage disposal needs at the Station and there will be no system installed for that purpose. There is an existing septic system at the Applicant's adjacent Compressor Station. j. If storage or warehousing is proposed, what type of items will be stored? Four, 2,000 gallon storage tanks will be installed to store antifreeze, used antifreeze, lube oil and used lube oil. 6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal. There is no landscaping proposed for the site. Unused areas will remain undeveloped range land. 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. Applicant will remove all above ground equipment,buried and above ground piping and any concrete structures within 18 inches of the land surface. The site will be graded to match the contours of the surroundings properties. 8. Explain how the storm water drainage will be handled on the site. Applicant will utilize collection ponds and silt fences as necessary to control erosion both during construction and final operations in accordance with a Stormwater Discharge Plan and permit which Applicant will obtain from the Colorado Department of Health. Construction is expected to begin within two weeks of obtaining the required building permits. The Station will be operational approximately 6 months after construction begins. The maximum workforce for the Station construction is estimated to be 50 construction personnel. 10. Explain where storage and/or stockpile of wastes will occur on this site. There will be no storage and/or stockpile of wastes at this site.Normal waste including paper trash will be disposed of utilizing commercial dumpster services. Other waste from the Station will include: 1.) Used compressor lube oil 2.) Lube oil or hydrocarbon liquid contaminated rags 3.) Used antifreeze Used lube oil and antifreeze will be transported away from the site using certified transporters. Any spill reporting or remedial actions will be the responsibility of HS Resources, Inc.'s Environmental Affairs Manager. Contaminated rags will be transported off site to approved disposal. Applicant selected the proposed site location for reasons that include proximity to applicant's existing compressor station that negates the need for additional gathering and distribution pipelines and infrastructure, ownership of the property, compatibility with adjacent land uses, non-disturbance of irrigated agricultural land and impact on nearby rural residential properties. The Applicant also noted that the proposed site location was away from U.S. Highway 85 and the Platte River Corridor that is more heavily populated and has a greater infrastructure located around it than the area where the site was selected. NEED FOR THE COMPRESSOR STATION The Wattenberg Gathering System (Gathering System) currently moves approximately 235 MMCF of gas per day to four primary receipt points for further processing. The receipt points include the applicant's Fort Lupton Gas Processing Plant(120 NMMSCFD), BP/Amoco's Wattenberg Gas Processing Plant(155 MMCFD),NARCO's Gas Processing Plant(55 MMCFD) and Duke's Spindle Gas Processing Plant (5 MMCFD). Applicant, as operator of the Gathering System, has found that the Gathering System is experiencing constraints in being able to move gas to the various receipt points because more wells are being drilled and connected to the Gathering System, and the Gathering System is already operating at maximum compressor capacity. Further, there currently exists more processing capacity than the existing compressor capacity can support. Applicant performed a study to determine the most economical way to get more gas through the Gathering System and to market. A conclusion from the study was that additional compression was necessary to move gas through the Gathering System. SITE EVALUATION Applicant identified four separate alternatives as site locations for facilities to increase compression for the Gathering System that included 1)the existing Platteville Compressor Station site; 2)the existing Hambert Compressor site; 3) a location near the midpoint of a pipeline where the Gathering System was experiencing major constraint; and 4)the proposed site location. Page I of 2 H\group\land\wason\usrappl icationfonns\itl up0701\siteselection Applicant evaluated each alternative to determine the optimal location for the installation of the compression station based on criteria that included 1)the hydraulics of existing pipelines; 2) the impact on adjacent land uses; 3)the time it would take to get a compression system on line, including obtaining air permits for the station; and 4) costs to install the station. Applicant determined based on the criteria it applied that the proposed compressor site was the most reasonable cost effective alternative. The proposed compressor site was the optimal location from a cost standpoint because the Applicant owns the proposed site which contains a natural gas processing plant and operates the adjacent ten acre site (under Power of Attorney from KN Wattenberg Transmission Limited Liability Company)which contains a natural gas compressor station. Because of this proximity, the Applicant can utilize existing infrastructure including pipelines, roads, water and electrical power. Applicant determined based on the criteria it applied that the proposed compressor site would least impact adjacent land uses. The site is due east of applicant's Fort Lupton Compressor Station, due northeast of Applicant's Fort Lupton Gas Processing Plant and due south(across WCR 22) of NARCO's Ft. Lupton Gas Processing Station. Due south and east of the site is non-irrigated rangeland. The conclusion was that the site was adjacent to significant other oil and gas uses, no irrigated agricultural land is taken out of production and the impact to other rural residential uses or rangeland will be minimal. Lupton Compressor Station. The site is approximately 35.5 acres in size. The Weld County Soil Survey indicates the soil types as Valent sand Valent loamy sand in this general area. Objective To implement a natural vegetative barrier to reduce wind erosion on the site and to screen the facility from the south. Methods HS proposes to gravel the ground surface of all disturbed areas to reduce wind erosion potential. HS has an agreement with the adjoining landowner to the south to keep a 50-foot buffer with no facility construction along the south and east property borders of the facility. This Landscape Plan is based on recommendations in a December 6, 2000 letter from Mr. Norman J. Wells, Jr., District Conservationist at the National Resources Conservation Service (NRCS) of the U.S. Department of Agriculture. Where possible the natural vegetation will not be disturbed. Gravel will be used as appropriate on exposed areas within the facility to reduce wind erosion potential of exposed soils. The buffer zones discussed above will also aid in reducing windblown soils from leaving the facility. A cover crop of sorghum and a combination of native grasses, as recommended by the NRCS (see list below), will be planted around the south and east borders of the facility to assist in reducing wind erosion and help screen the facility in those directions. The seeded areas will be covered with approximately 4000 pounds of hay or straw to help retain moisture and prevent erosion until the grasses can become established, as recommended by the NRCS. The use of native grasses was chosen as the preferable alternative as irrigation in this area would be impractical and the grasses can survive without irrigation. Lupton Compressor Station. The site is approximately 35.5 acres in size. Objective To control undesirable plants on the subject property, the following Weed Management Plan is proposed. Plants identified through the Colorado Weed Management Act(CRS §35-5.5-101, et seq.) as undesirable and designated for management on-site include CanadaThistle, Musk Thistle, Diffuse Knapweed, Russian Knapweed, and Dalmation Toadflax. The site is consistent in topography and vegetation. None of the designated noxious weeds were identified at or near the subject site. However, if any of the noxious weeds listed above are identified in the future the following methods can be used to control them. Methods of Control The methods of control are cultural, mechanical, biological, and chemical. These methods are defined as follows: Cultural—The method or management practices that encourage the growth of desirable plants over undesirable plants. Mechanical—The method or management practices that physically disrupt plant growth including but not limited to tilling, mowing, burning, flooding, mulching, hand-pulling, and hoeing. Biological—The use of organisms such as sheep, goats, cattle, insects, and plant diseases to disrupt the growth of undesirable plants. Chemical -The use of herbicides or plant regulators to disrupt the growth of undesirable plants. An integration of one or more of these methods can be applied to this site. Weed management of undesirable weeds for the site is as follows: 1. Canada Thistle A. Mechanical and Chemical Control—Mowing can occur throughout the growing season in order to keep the plants from going to seed. Mowing should be terminated in late August followed by a herbicide treatment during late September through October, before a hard frost. Page 1 HS Resources, Inc. Weed Mgt. Plan Ft. Cultural and Chemical Control—Use a short residual herbicide followed by a seeding with a competitive grass such as western wheatgrass or other sod forming species (natives preferred). C. Chemical Control Only—Herbicide applications can be applied from rosette to bud stage and if needed, retreated in the fall. 2. Musk Thistle A. Mechanical and Chemical Control —Mowing to occur throughout the summer to address the bud stage of the thistle. Apply an herbicide in October to new rosettes and any bolted plants. B. Mechanical Control Only—Conduct multiple mowings during the summer(two to four) to keep seeds from being produced. C. Chemical Control Only—Herbicides can be used in the spring and fall when the plant is in the rosette stage. Only the herbicides labeled for the site intended will be used. 3. Diffuse Knapweed A. Cultural and Chemical Control—Apply herbicide in early summer when knapweed is in the rosette through bolting stage. Reseed area with competitive perennial sod forming grasses. Another herbicide application utilized the following year as needed to prevent plants from going to seed. B. Mechanical and Chemical Control—During the growing season, mow when the knapweed is in the bud stage to prevent seeding. If necessary, an herbicide application to any plants that have re-bolted will be made in the fall. C. Mechanical Control Only—To prevent seed set, mow throughout the summer season. D. Chemical Control Only—The herbicide application is to be made during the rosette stage (spring or fall) and while bolting. 4. Russian Knapweed A. Cultural and Chemical Control—An herbicide application, using short residual herbicides can be used followed up by seeding the area with a competitive grass such as western wheatgrass or other sod forming species. B. Mechanical and Chemical Control—Mowing can be carried out throughout the summer with the first and successive mowing cycles carried out at the bud stage. An herbicide treatment can then be made in October. C. Chemical Control Only—Herbicide applications can be made to the toadflax during the early flower stage and in the fall if necessary. Conclusion Weed management by cities and counties is becoming more common in Colorado and through this type of management undesirable plant species have been reduced. Not unlike other parcels along the Front Range, this development has varying landscapes and site conditions. With this in mind, this plan was formulated and by implementing one or more of the above applications, weeds can be managed and reduced at the Fort Lupton Compressor Station II.
