R f Greeley, CO 80631 Re: Case Number USR-1300 Dear Kim: This letter is in response to the request for a Special Review Permit for R.V. Storage and Dog Grooming Business at 3240 47th Avenue,Weld County. Staff has reviewed the proposed request and finds that it does not comply with Evans Comprehensive Plan. Per the Coordinated Planning Agreement adopted by Evans and Weld County on October 4, 1999, Evans Future Land Use Map, Exhibit A, identifies this area as low density residential. South of the subject property the area is zoned R-3,Multifamily Residential, and to the East R-1, Single- family Residential. Also, Evans is aware an existing USR for R.V. Storage exists north of the subject parcel. The Tuscany Subdivision,which is adjacent to the subject parcel provides for a 30-35'open space/trail buffer along the east and south sides of the property. Thus, if mitigating techniques are required,the proposed use could be compatible with the surrounding land uses. Staff recommends the following conditions of approval for your consideration: • Vehicular access, circulation areas, and parking spaces should be paved or at least covered with at least 6 inches of compacted road base. • No dumping stations be permitted. • All lighting should be installed so it does not adversely affect surrounding property owners. • Drainage Study to address detention and drainage from site. • Street improvements along 47th Avenue. • The storage yard should be screened on the east and south sides. Any trees used for screening purposes should consist of coniferous plant materials. • To ensure compatibility with the surrounding property owners,the City of Evans request the opportunity to review the landscaping plan. This project falls under the purview of the Weld County Use by Special Review Standards. Our comments and requirements are as follows: COMMENTS: 47th Avenue between U.S. Highway 34 Bypass and 37th Street has split jurisdictions with the City of Greeley and City of Evans. The Weld County Public Works Department has no maintenance responsibility on this section of road. There is a shared access between adjacent parcels at this location. The 20-foot access easement accommodates both lots. The existing north lot has an RV storage business in place and is utilizing this access. The proposed USR shall utilize the same access easement. REQUIREMENTS: The approach to the access gate and storage facility lot shall be graded with adequate gravel and drained to provide an all-weather access to the facility. Circulation: Directly east of the access gate, there is an existing tree adjacent to the barn. The applicant identified additional storage area where the existing tree is located. I recommend that the tree remain and the additional storage that is identified on the plat is eliminated. This would accommodate an adequate turning radius through the access gate to the facility. The two storage spaces at the east end of the center island shall be removed to provide adequate circulation between and around the facility. The approach and access gate shall be widened to accommodate wider and longer vehicles. The tree is adjacent to the access gate shall be trimmed to accommodate the widening. Storm Water Drainage: The storm water retention facility shall be provided on site that are designed to retain water run-off from a fully developed site based on the 100-year storm or as otherwise required by the Weld County Public Works Department. A drainage facility shall be designed to release the retained water at the quantity and rate based on a five-year storm disbursement on an undeveloped site. All parking and vehicle storage shall be provided on the site. Parking shall not be permitted within any public right- of-way. Our department recommends approval. The following conditions are recommended to be part of any approval: 1) All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-101, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects surface and groundwater contamination. 2) No permanent disposal of wastes shall be permitted at this site. 3) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4) Fugitive dust shall be controlled on this site. 5) The maximum permissible noise level shall not exceed the residential limit of 55 db(A) as measured according to 25-12-103 C.R.S. as amended, Colorado Revised Statutes. 6) The facility shall utilize the existing the existing water supply. (Greeley Water). 7) Adequate toilet facilities shall be provided for the public. The public shall be allowed to use the toilet facilities located in the residence. 8) The existing septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. Proper building permits shall be obtained prior to any construction, remodeling, demolition or excavation. 2. Separate building permits are required for all monument or advertisement signs. Signs shall adhere to Section 42 of the Weld County Zoning Ordinance and Section 2.8 of the Weld County MUD Ordinance as applicable. Engineering may be required. 3. Electrical permits are needed for any site lighting or additional wiring for the dog grooming area. Any wiring for the dog grooming area shall be suitable for damp or wet locations as applicable. All electrical work shall conform to the 1999 National Electrical Code (NEC). All work shall be performed by a licensed Colorado electrical contractor. 4. Any future buildings used to enclose vehicles will require building permits and shall meet all the requirements of the current adopted codes of Weld County. 5. All hair, dander, etc. from the dog grooming area shall pass through an approved separator designed to prevent the discharge of such items into the septic system. A permit and approvals are required for the installation. All plumbing work shall be performed by a licensed Colorado plumbing contractor. 6. Any future buildings used for office space will be classified as a Group B Occupancy. As such, all adopted building code requirements for a Group B shall be satisfied.
