TOWN OF MILLIKEN RESOLUTION NO 01-08 BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF MILLIICEN, WELD COUNTY, COLORADO THAT: 1. At the regular meeting of the Board of Trustees on 25th, of April, 2001, the Petition for Annexation for Sparrow Annexation was submitted to the Board of Trustees by the Clerk as a communication pursuant to Section 31- 12-107(1)(f),C.R.S. The location of the property described in the petition is set forth on Exhibit "A" attached hereto and incorporated herein by reference. 2. The Board of Trustees has reviewed the petition and finds that the requirements set forth in Section 31-12-107(1)(f), C.R.S. have been substantially complied with. 3. Bridge St. Brighton, CO 80601 303/659-8546 Annexation and the Town of Milliken State statutes require that any municipality annexing property must provide"urban level services" (i.e. water, wastewater, police, recreation, schools, and other services) to those areas they intend to annex. The Town of Milliken recognizes this responsibility and can successfully provide these services to those under consideration by the Town. Additionally, Weld County also recognizes the responsibilities for said services and land valuation, however the responsibility does not occur until the Land Use changes. The Town of Milliken has adopted a Comprehensive Plan and Community Development Code that both describe and require future development within the Town to meet standards that will provide the same level of service to new areas as it is currently providing within the existing town. To accomplish orderly, controlled growth in terms of annexation,Milliken will rely on the Town's Development Code and Comprehensive Plan to provide a basic guideline for future development We believe these documents will allow the Town to achieve controlled, orderly and efficient growth management. . Water Rights Information 3 1/4 shares of Lake Loveland Water and '/2 share of Greeley-Loveland Water are connected to the property and will be transferred to the Town (per the Town's ordinances) at the time the final plat is completed and development agreement is recorded with Weld County. As additional water rights are required; addition22a1 shares will be purchased by the Developer to satisfy the water demand requirements of the project prior to the filing of the final plat. These water rights shall be purchased either on the open market or from the Town if the Town has shares available at the time of development or the requirement may also be satisfied by purchasing additional water shares for transfer to the Town as currently allowed in the Town ordinance. Existing and Proposed Infrastructure There is to existing development on the property. The Owner requests approval of the annexation and zoning designation of A-Agriculture until future mixed used development in general accord with the Comprehensive Master Plan warrants a change of zone and Preliminary/ Final Plat with development agreement to the Town of Milliken. -2- Financing of Municipal Service Expansion The Town of Milliken will require that the Developer bear the cost of any required expansions to the Town's utilities and roads at the time of development. The developer may enter into a cost sharing (reimbursement) agreement with the Town that allows for the Developer to be reimbursed for any improvements that benefit other properties as these properties develop and connect into these improvements. The developer will most likely finance the improvements and expansions through private funds and construction loans secured by the property. Existing Land Use The current zoning is - Weld County A-Agricultural The current land use is Agricultural. Project Concept/Proposed Land Use and Zoning The proposed zoning is A-Agricultural Project Concept The Owner proposes to Annex the parcel into the Town of Milliken and maintain the existing land use as agricultural for a limited period of time. This parcel meets the criteria for annexation to the Town of Milliken. The owner wishes to work with the community in support of the Towns Comprehensive Master Plan and facilitate the desire of the Town to annex parcels adjacent to town. Natural and man-made Site Features The land is flat on the upper portions. Along the western and southern boundaries it slopes steeply to the south. The upper portions are devoted to agricultural use while the sloping portions are in a natural state. This property has no additional features. The property is bound on the south and west by the Town of Milliken with a residential subdivision on the west and bound on the north and east by agricultural land. Proposed Land Use Summary The project comprises a total of 294.20 acres of which approximately two-thirds is existing agricultural farmland. The development concept for the Sparrow Annexation is a uniquely identifiable mixed use community with the major focus on a high quality residential community oriented along the natural bluffs and offering a spectacular view of the high plains and Rocky Mountains while presenting a unique architectural vista to those passing by the development on Colorado State Highway 257. The neighborhood will be made up of two sub neighborhoods which are defined by a shared open space park and internal parkway. Both sub neighborhoods will offer a variety of housing types while maintaining a high level of design quality and consistent architectural character. Additionally, the sub neighborhood adjoining Colorado State Highway -3- 257 will provide a small commercial area capable of supporting a local convenience store and a limited number of other retail structures. Architectural controls will require that the commercial developments remain at a scale and style which compliments the residential development. Public Use Dedication The proposed annexation will dedicate the respective road right-of-way as required by the Town of Milliken as well as public spaces and access trails. Development Phasing and Schedule The owner at this time is processing an annexation and zoning application and has not established a plat or projection to completion of processing and construction at this time. It is realized that complete development of the project could take three to five years or longer with the desire to begin the first phase within one year. Fiscal Impact The proposed development, when complete, will have significant financial impact upon both the cost of services provided by the Town of Milliken and the revenue generated for the Town of Milliken. Although not even preliminary plans have been completed, an average density of 3.5 Dwelling Units (DU) per acre on the developable portions of the property could yield between 650 and 700 DU's. Additionally, some commercial development is anticipated providing both sales tax revenue and employment opportunities for the Town. Ultimately, the Town will receive a developed parkway providing an additional entrance to the Town, extended utility systems, developed public park land, and a hiking/biking trail system. Pre-Annexation Agreements At the current time, there are no drafts or pre-annexation agreements with or between the owner and/ or Town. It is anticipated that the Owner and Town will enter into an Annexation Agreement based upon the Town's standard "Annexation Agreement"format prior to annexation. Mineral are leased by Natural Gas Association, Inc., H.S. Resources, Inc. and Patina Oil & Gas Corp. The Greeley - Loveland Ditch crosses the property but only serves downstream property under the same ownership, and may be abandoned. School Impact The development has a proposed density which could be as high as 650 to 700 Dwelling Units and which will have a significant impact on the existing school system as indicated below by the respective calculations for the region. Elementary School 0.345 Students/DU Middle School 0.170 Students/DU High School 0.195 Students/DU Total: 0.710 Students/DU With 650 to 700 DU x 0.710 =increase of 462 to 497 students (1.7 DU/acre) The school fee is based upon new residential structures only and is set at $750.00 per dwelling unit.
