The Department of Planning Services has received the attached letter dated September 5,
2001 from Mr. John Hochmiller. Mr. Hochmiller is requesting that Special Use Permit-311 be
vacated.
Mr. Hochmiller recently applied for Use by Special Review Permit 1311 to expand the original
salvage operation. The Department of Planning Services required the vacation of SUP-311 as a
condition of approval.

It is then bottled and either sold as-r xycled antifreeze or reused in our own vehicles or

Brake fluid and washer fluid are drained from vehicles and bottled IS reuse or for sale.
Approximately 5-t0 gallons of brake fluid and 5-10 gallons cif washer fluid are reersve ed
per year.
R-12 refrigerant is recovered and reused by a Snap-!On recovery machine. This
retngciagt is sold in shops,or.reused,onsight. Approximately eixty ponds are, recovered
in.a year's time..
Batteries arc removed from the vehicles and tested.Junk batteries are sold to Rocky
Mountain Battery M Denver.(iced batteries.arc stored inside for muse,Junk batteries arc
stored in a steel waterproof container,which will hold about 50 batteries ata time.
Chemicals that axe at the facility are mostly hrmschold ductse.nts and cleaners, A filly-
gallon barrel of soap is stored in our wash rack attd is an organic sap rased with a closed
loop wtttor system for cleaning parts.

RE: Plan of correction for the disposal of pallot.s and wood wastes that are of concern
under item 2E of the developement standards for USR#1311
The plan of conavtion will include:
1. Load all wood wastes and debris onto an end dump trailer
2. hail to local landfill
Estimated time of completion is November 20, 2001.
I would ask that approval of this plan be in a timely manner in order to fulfill requirements

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS OF APPROVAL
•
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2,.unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(4)and the findings of the State Engineer dated /9/6u•4 / f .too/
4) Approved for the use of an existing well, the construction of which was approved pursuant to findings of the State Board of
Examiners of Water Well Construction and Pump Installation Contractors dated April 9, 2001.
5) The maximum pumping rate of this well shall not exceed 15 GPM.
3) The average annual amount of ground water to be appropriated shall not exceed 1.63 acre-feet, as requested by
applicant.
7) Production is limited to the Laramie-Fox Hills aquifer which is located 300 feet below land surface and extends to depth of
620 feet.
3) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case
number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings.
9) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all
diversions must be maintained by the well owner(recorded at least annually)and submitted to the Division Engineer upon
request.
10) This well shall be constructed at least 600 feet from any existing well completed in the same aquifer that is not owned by
the applicant.
11) This well shall be constructed.not more than 200 feet from the location specified on this permit.
12) Pursuant to CRS 37-90-137(9)(b) and the Denver Basin Rules, no more than 98% of the nontributary ground water
withdrawn annually shall be consumed and the well owner shall demonstrate to the reasonable satisfaction of the State
Engineer that no more than 98%of the water withdrawn will be consumed.
13) This well is subject to administration by the Division Engineer in accordance with applicable decrees, statutes, rules,and
regulations.
NOTE:The ability of this well to withdraw its authorized amount of water from this non-renewable aquifer may be less than
the 100 years upon which the amount of water in the aquifer is allocated, due to anticipated water level declines. 441

The State Board of Examiners of Water Well Construction and Pump Installation Contractors,
having reviewed the well construction information provided by the well owner and licensed water well
construction contractor, hereby enters the following Finding with respect to the adequacy of construction
of the subject water well:
FINDING
At its meeting on April 3, 2001, the Board of Examiners reviewed the Licensed Contractor's Well
Inspection Report and information submitted by the well owner for the subject well constructed by a
licensed contractor and finds the well to be adequately constructed to protect the ground water resource
and the public health. .By this finding the Board waives its requirement for submitting a Well
Construction and Test Report for construction of the well. However, the well owner must obtain the
necessary well permit from the State Engineer authorizing withdrawal of ground water from the well.

Re: USR 1311 Amendinent to•existing NPDES (CEO-0t;0000)
The Weld County Health Dept is requesting evidence of compliance with the Water
Control Div of Colorado under the existing storm weer permit after the approval of USR
.1311 and.it's.proposed.changes.to the.facility.
The process for aprovat-of any changes to the Stono Water Management.Plan.under said
permit is as follows.Once changes are made to'the facility,whether i a physicalchange-
.or a change in'wastc handling,or-merely•a change in-wastc'rnanagcmncizt•palicy'and
procedure, that facility must include those changes in an annual report which is due every
year on November 28th. At that time,the Colorado Dept. of Hea lth Will review the
changes along with the results of the annual water sample test and determine whether the
facility needs to change policy or procedures in order to maintain expectable water run
off test results.
They are not concerned about pre-approval of changes,they just want these changes
noted in the_annual report.

Per request.of Char Davis,Supervisor, Weld.County Environmental I-leaalth Services, I.
•contacted the EPA in reference to the•facilities compliance for with the class V injection R-
welt re2ulattans.
Ispoke with Douglas Minter with the EPA's Class V injection Well Div.. I explained to
him that we have-had a dry shop for the last 24 years and we plan to have a dry shop with
the new propped 80x80-
He informed me that as long as it will in fact be a dry shop,.then We will be in
compliance.A dry shop can still have a rest room and a hand sink, however, once floor
drains.are installed it is no.longer a dry.shop.By.Douglas' definition.ofa.dry shop,all
existing and.proposed buildings.are in compliance.
