RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR MORIAH
ESTATES PLANNED UNIT DEVELOPMENT FINAL PLAN, S #497 - SHILOH, INC.,

WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated September 27, 1999, the Board did approve the
application of Shiloh, Inc., do James Scott, 35325 Cornerstone Way, Windsor, Colorado
80550, for a Planned Unit Development Final Plan, S #497, on the following described real
estate, to wit:
A portion of the SW1/4 of Section 4, Township 6
North, Range 67 West of the 6th P.M., Weld
County, Colorado, and
WHEREAS, on December 27, 1999, the Board of County Commissioner of Weld
County, Colorado, did approve an Improvements Agreement According to Policy Regarding
Collateral for Improvements (Private Road Maintenance) for Moriah Estates, between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, and Shiloh, Inc., c/o James Scott, with terms and conditions being as stated in
said agreement, and accepted Irrevocable Letter of Credit#00085, in the amount of
$386,713.00, drawn on the Centennial Bank, 1550 East Harmony Road, Fort Collins, Colorado,
80525, and
WHEREAS, on September 11, 2000, the Board of County Commissioners of Weld
County, Colorado, deemed it advisable to cancel and release Irrevocable Letter of Credit
#00085 Cashier's Check #1316, and to accept Check #1316 in the amount of$5,872.80, and
WHEREAS, staff from the Weld County Department of Public Works has conducted a
visual inspection and upon recommendation of staff, the Board deems it advisable to release
said collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Cashier's Check#1316, in the amount of$5,872.80 be, and
hereby is, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby
is, directed to return said collateral to the appropriate issuing party.

COLORADO
At your request, I completed a final inspection on the transportation portion of Moriah Estates. The October 8,
2001, inspection concluded that there is no distress or repairs of the roadway.
The Weld County Public Works Department recommends the release of collateral for the transportation
portion of Moriah Estates in the amount of$5,872.80. This has been retained for one year.
All other non-transportation items shall be verified by Planning Services.
Moriah Estates was proposed as a Planned Unit Development and the roadways are privately maintained.

SUBJECT: Release of Collateral for Moriah Estates
Case Number S-497, c/o Jim Scott
The Department of Planning Services has received a request from Jim Scott of Shiloh
Incorporated, Windsor, dated October 9, 2001 for release of collateral for Moriah Estates,
located in part of the SW4 of Section 4, Township 6 North, Range 67 West of the 6th P.M.,
Weld County Colorado.
The Board of County Commissioners is holding fifteen percent of the pavement item via check
number 1316 in the amount of five thousand eight hundred seventy-two and 80/100s
($5872.80)from Shiloh Incorporated, c/o Jim Scott. The Department of Planning Services
recommends release of these monies pending inspection of the pavement item by the
Department of Public Works.
