RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST BOB AND HOPE CANDELARIE FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Bob and Hope Candelarie, VI #0100118, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of August, 2001, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Bob and Hope Candelarie, property owners, were present at said hearing,
and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until October 9, 2001, to allow adequate time for the property owners
to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0100118 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Bob and Hope Candelarie to remedy the violation of
the Weld County Code, and any other persons occupying the properties, any persons claiming
an interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until October 9, 2001, to allow
adequate time for the property owners to bring the subject property into compliance.

RESOLUTION
RE: GRANT MOBILE HOME PERMIT #2115 - ROBERT AND HOPE CANDELARIE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 1st
day of February, 1999, considered the request of Robert and Hope Candelarie, 16143 Barley
Avenue, Fort Lupton, Colorado 80621, for a mobile home to be used as a principal dwelling,
and
WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:
Lot 7, Block 67,Aristocrat Ranchettes, Section 26,
Township 2 North, Range 66 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, the Board of County Commissioners, having heard the testimony, finds that
said request should be granted subject to the following conditions:
1. The applicant shall apply for a building permit for the mobile home prior to
locating the mobile home on the property.
2. Prior to occupancy of the mobile home, the mobile home shall be connected to
an approved septic system and a legal water supply.
3. The mobile home shall meet the minimum setback and offset requirements for
the A (Agricultural) Zone District.
4. The mobile home shall connect to a public water supply system when it becomes
available.
5. The mobile home shall not be occupied until such time that the applicant has
complied with Conditions 1 through 3 as stated above.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Robert and Hope Candelarie for permission to place
a mobile home to be used as'a principal dwelling on the above described parcel of land, which
was found to be in compliance with Section 43 of the Weld County Zoning Ordinance, be, and
hereby is, granted subject to the hereinabove listed conditions.

I spoke with Hope Candelarie about a mobile home she has already placed at 16163 Barley Avenue in Aristocrate
Ranchetts. This trailer was placed on the lot without a building permit from the Planning Department. Mrs.
Candelarie indicated that she had come in and discussed the possibility of applying for a Medical Hardship in
order to place this trailer on their existing lot. She and her husband decided that the Medical Hardship involved
to much paperwork, and bought the lot at 16163 Barley Avenue to place the trailer on.

Mrs. Candelarie has applied for a well permit with the state, but that process has not yet been completed. I
advised Mrs. Candelarie to come in and apply for the building permit as soon as possible. I also informed her
that she needs to bring a copy of her warranty deed, a plot plan, and a copy of her septic permit. Mrs. Candelarie
said she had not yet applied for the septic. I than told her that the Planning Department requires a copy of an
issued septic permit and well permit before a building permit can be issued to her.
Mrs. Candelarie said she would sent her daughter to both the Health Department and the Planning Department
to apply for the needed permits.

- CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless
approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump
Installation Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(Il)(A) as the only well on a residential site of 1 acre described as Lot
7, Block 67, Filing.3, Aristocrat Ranchettes subdivision, Weld County.
4) The use of ground water from this well is limited to ordinary household purposes inside a single family dwelling.
• The ground water shall not be used for irrigation or other purposes.
5) Production from this well is restricted to the Laramie Fox Hills aquifer which corresponds to the interval between
375 feet and 660 feet below ground surface. Plain casing shall be installed and sealed to prevent production from
other zones. -
6) The maximum pumping rate shall not exceed 15 GPM.
7) The return flow from the use of the well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located
8) This well shall be constructed not more than 200 feet from the location specified on this permit. •
Note: To insure a maximum productive life of this well, perforated casing should be set through the entire
producing interval of the approved zone or aquifer indicated above.
Note: The ability of this well to withdraw its authorized amount of water from this non-renewable aquifer
may be less than the 100 years upon ch the amount of water in the aquifer is allocated, due
to anticipated water level declin II.i1_98

and Building Code Ordinances governing location, construction, and setup of the above proposed manufactured home for which
this permit is granted. The Building Official is authorized to order the immediate cessation of work at any time a violation
of the adopted codes or regulations appears to have occurred. Violations of any codes or regulations may result in the
revocation of this permit.
The manufactured home described on this permit must conform with the plans as submitted to the Weld County Building Inspection
Department. Any changes of the plans or layout must be approved prior to construction. Any change in the use or occupancy of
the home must be approved.
It shall be the duty of the property owner or the person doing the work authorized by this permit to notify the Weld County
Building Inspection Department that such work is ready for inspection.
All inspections shall be completed and approved and a certificate of occupancy obtained within 180 days of the issuance of this
permit. Failure to obtain a certificate of occupany within this 180 day period will be sufficient reason to consider the
manufactured home described on this permit to be in violation of the Weld County Building Code Ordinance.
