RE: APPROVAL OF REQUEST TO AMEND DEVELOPMENT STANDARDS CONCERNING
UNIT DEVELOPMENT NO. UD-4 : 81 : 2 - RICHARD PERCHLIK (SHARKTOOTH
RECREATION AREA)
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado held a public meeting on the 27th day of May, 1981 at
the hour of 9: 00 o 'clock a.m. for the purpose of hearing the
application of Richard Perchlik for approval to amend the develop-
ment standards contained in Unit Development No. UD-4 : 81 : 2 con-
cerning the following described parcel of land:

WHEREAS, evidence was presented in support of the approval
to amend the development standards for the Unit Development, and
WHEREAS , Section 6. 6 of the Weld County Zoning Resolution
authorizes the Board of County Commissioners to approve amend-
ments to the development standards for a Unit Development upon
a showing by the petitioner of compliance with all of the require-
ments of Section 6 . 6 of the Weld County Zoning Resolution, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those pre-
sent, has studied the request of the petitioner and the recom-
mendations of the Weld County Planning Commission and all of the
exhibits and evidence presented in this matter and having been
fully informed, finds that the request to amend the development
standards to Unit Development No. UD-4 : 81 : 2 should be approved.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that the petition of Richard
Perchlik for approval to amend the development standards contained
in Unit Development No. UD-4 : 81: 2 on the tract of land as set forth
above be, and hereby is , granted subject to the following:

SHARKTOOTH RECREATIONAL AREA
B-UD Regulations
USES
Recreational uses including winter activities such as skiing, tubing, and
ice skating, and summer activities such as grass skiing, tennis , volley-
ball , archery, swimming, and water sports. Excluded activities would be
the discharge of firearms and the use of motorized vehicles. Exclusions
would not apply to activities of the owner and family. Developed as a
business enterprise for public use. Related uses will also be provided
in the form of a parking lot, office-refreshment-storage buildings to
serve customers, and a rental service of recreational equipment.
PARKING
A gravel surface parking lot shall be provided capable of containing at
least 200 autos. If usage exceeds the quantity provided, an additional
area to the south is available as overflow parking.
STRUCTURES
Buildings shall be provided to house an office, warming and reception
areas, storage, snack bar, restrooms , and related recreational facilities.
Ski tow equipment shall also be provided, but will not be housed within
a structure.
LIGHTING
Flood lighting shall be provided in activity area. Lighting shall be
directed away from adjoining property.
SIGNING
One identification sign will be provided. It shall be set back from the
County road 25 feet and shall not exceed a total area per face of 25 square
feet. The sign, if lighted, will not have any flashing or rotating lights.
Maximum height shall not exceed 8 feet, and will be designed as a low
profile sign.
SETBACKS
All structures shall be set back at least 25 feet from any property line
or dedicated road.
OPERATION
The use is year-round, but primary use will be in winter and summer months ,
generally in daylight hours with some evening use. Operation may be up to
seven days per week.
UTILITIES
Water source is the City of Greeley. Sewage treatment is 2 septic tanks
and leach field meeting the requirements of the health department.

REQUEST FOR CHANGE IN
SKI FUN VALLEY OFFICIAL UNIT DEVELOPMENT PLAN
On April 21 , 1971 , the official Unit Development Plan known as Ski Fun
Valley was approved by the Weld Board of County Commissioners. During the past
ten years the business known as Sharktooth Ski Area has operated as a ski and
winter sports area during the months of December through March each year.
Request is hereby submitted to make three changes in the official Unit
Development Plan: (1) change of the official name to Sharktooth Recreational
Area; (2) expand uses to year-round activities ; (3) remove specific building
restrictions and expand to building needs demanded by official uses in conformance
to general building standards for this type of zoning.
Rationale:
a. Official Name: Shortly after having the original plan approved,
the name of the business was officially registered with the Secretary of
State as Sharktooth Ski Area and has since been known to the public by
this name. Recently the more comprehensive nature of activities at
Sharktooth including skating, tubing and possibly expanded activities has
led to a more general designation to the public as Sharktooth Recreational
Area.
b. Uses: When we originally made application to the county for zoning
we specified use for winter activities only. This was officially recorded
as such, and now serves as a restriction. We asked only for winter use
because at that time we had no expectation of doing more. Records of the
zoning hearings will show that no public or official petition asked for
this restriction of use at that time. The land was barren and inhospitable
in summer months for recreational activities. Over the past ten years we
have recontoured and grassed the area, provided irrigation, and planted
over 500 trees to the point where now the environment is compatible to
summer use.
In addition, my personal commitments to other professional responsi-
bilities made it impossible to devote more than a few months to the
recreational business. The ski area has never been a profitable enterprise
but I have made it a personal commitment to serve the great needs for
recreation for our area youth. Summer enterprise would without additional
capital costs bring in additional revenue to expand this need and improve

the area in landscaping. Specifically, additional revenue would enable
us to convert to new and relatively silent snowmaking which would eliminate
late evening noise levels which have been the only possible nusiance our
operation has ever presented to our good neighbors although no one has
ever filed any complaint about our operation.
Primarily we would like to expand uses for year-round activities
highlighting grassskiing, a new and expanding summer sport. This use
would utilize all existing facilities and require no additional capital
construction. Grass skiing requires only special roller type skis now
available. Summer uses might also include other traditional summer related
recreational activity such as archery, tennis, volleyball , batting practice,
swimming and water sports, and picnicing but excluding any use of fire-
arms or motorized vehicles other than those used for maintainence purposes.
Refreshment and activity related concession facilities would be operated
to serve the attending populations only.
Summer activities would pose no new demands upon the area, utilities,
or surrounding environment. Activities would be limited to a daily
attendance which would be accomodated by our parking lot of 200 spaces.
Road traffic and crowds would be no greater than what is now by the ski
area. Maintenance of County Road 25 has been excellent and has success-
fully served Sharktooth traffic even in the worst of winter months.
A septic waste water system now in place, with a 1500 gallon capacity
and 625 foot leach field (Weld County Health Department Permit no. 2382)
is successfully meeting the facility's demands , and summer use would pose
no additional loads. Water is supplied by a metered City of Greeley tap
and no significant additional yearly consumption would be required by
contemplated summer use.
c. Structures: Buildings would be restricted to those housing machinery
used to serve recreation facility, and those needed for serving reception,
concession and ticket site activities , and for housing sanitation
facilities for recreational customer. No new structures are planned for
additional summer activities but specific space restrictions make the
provision of future customer needs impossible. Increasing winter use will
probably demand construction of another warming lodge in the near future,
possibly for the 1982 season.

In summary, Sharktooth Recreational Area has successfully served the popula-
tion of Weld County the past ten years as a winter sports facility without any
disturbances or public criticism. A general of our young citizens and their
families have found clean and wholesome enjoyment at Sharktooth and year-round
activities would greatly expand this opportunity. As a business, Sharktooth has
enhanced the county tax base and has provided part-time employment for about 20
area youth each year. Most of our $25-30 thousand yearly revenue has been pumped
back into the community through salaries and purchases of utilities and supplies.
Spin-off economic benefits have been derived by area ski equipment shop sales.
All these economic benefits would be enhanced significantly by year-round
recreational activities at Sharktooth with no burdens to the local population or
to the County in general .

Thank you very much -for your notification to us as the subsurface mineral
owner of Sec. 36-6N-67W, Weld County. Unfortunately, we will be unable to
attend your meeting on May 19, 1981. However, the state's interest is
merely that we be able, through our oil and gas lessee, Sulphur River
Exploration Inc. , to explore for and hopeTully produce oil and/or gas
that may occur under that tract.
We have many situations in which we own minerals and someone else owns the
surface. When a surface is patented, we have no sway of keeping track of
surface ownership. Therefore, we are unable to notify these meopl-e directly
when we issue various minerals and oil and gas leases under their prn_perty.

AMENDMENT TO B-UD REGULATIONS
SKI FUN VALLEY
OFFICIAL UNIT DEVELOPMENT PLAN

KNOW ALL MEN BY THESE PRESENTS, that RICHARD PERCHLIK, the applicant
of SKI FUN VALLY Official Development Plan B-UD previously agreed to be
bound by certain B-UD Regulations more fully set forth in the records of
the Clerk and Recorder of Weld County, Colorado, recorded in Book 645 under
Reception #1566676.
WHEREAS, RICHARD PERCHLIK has requested that certain regulations
previously stated in the B-UD Regulations identified above be altered with
the approval of Weld County, and
WHEREAS, it is the desire of RICHARD PERCHLIK and Weld County
to revoke certain items of those regulations while not altering in any
manner the remaining regulations previously adopted.
NOW THEREFORE, RICHARD PERCHLIK and Weld County jointly modify
the B-UD Regulations for SKI FUN VALLEY official Unit Development Plan B-UD
recorded in Book 645 under Reception #1566676 in the manner set forth
below:
USES
Recreational uses including winter activities such as skiing, tubing, and
ice skating, and summer activities such as grass skiing, tennis, volley-
ball, archery, swimming, and water sports. Excluded activities would be
the discharge of firearms and the use of motorized vehicles. Exclusions
would not apply to activities of the owner and family. Developed as a
business enterprise for public use. Related uses will also be provided in
the form of a parking lot, office-refreshment-storage buildings to serve
customers, and a rental service of recreational equipment.
PARKING
A gravel surface parking lot shall be provided capable of containing at
least two-hundred (200) autos. If usage exceeds the quantity provided, and
additional area to the south is available as overflow parking.
STRUCTURES Buildings shall be provided to house an office, warming and
reception areas, storage, snack bar, restrooms, and related recreational
facilities. Ski tow equipment shall also be provided, but will not be
housed within a structure.
LIGHTING
Flood lighting shall be provided in activity area. Lighting shall be
directed away from adjoining property.
SIGNING
One identification sign will be provided. It shall be set back from the
County road twnety-five (25) feet and shall not exceed a total area per
face of twenty-five (25) square feet. The sign, if lighted, will not have
any flashing or rotating lights. Maximum height shall not exceed eight (8)
feet, and will be designed as a low profile sign.

SETBACKS
All structures shall be set back at least twenty-five (25) feet from any
property line or dedicated road.
OPERATION
The use is year-round, but primary use will be in winter and summer months,
generally in daylight hours with some evening use. Operation may be up to
seven (7) days per week.
UTILITIES
Water source is the City of Greeley. Sewage treatment is two (2) septic
tanks and leach field meeting the requirements of the health department.
DEVELOPER'S APPROVAL
I, RICHARD PERCHLIK, hereby agree to this amendment of the B-UD
Regulations for the SKI FUN VALLEY official Unit Development Plan.
