The purpose of this letter is to satisfy the conditions of approval for USR 1316 so that we may schedule
a Board of County Commissioners hearing.. Our response follows the order of the conditions in the
Land Use Application Summary Sheet.
1. We will adopt and place the development standards for the Special Review Plat prior to
recording.
' A. Enclosed is a copy of an agreement with mineral owner George Hall stipulating that Hall-Irwin
has adequately incorporated the oil and gas activities into the site design.
2B. Enclosed is a letter from Savage and Savage indicating the site is not suitable for Ute Ladies'
Tresses Orchid.

2D. Hall-Irwin Corporation will follow the Division of Wildlife's guidelines for eradicating prairie

toxicants.
2. Hall-Irwin will not eliminate prairie dogs by use of earth moving equipment.
3. Use of toxicants shall only include the use of chemicals registered for this purpose and
techniques considered appropriate for eradication.

4. In an effort to avoid adverse impacts to Burrowing Owls, a Colorado listed threatened
species and juvenile prairie dogs, we will try to initiate initial dirt work between September
1"and March 31. If control efforts or initial groundbreaking occurs between April 1" and
August 31, the site shall be surveyed by a certified biologist trained in the property
technique to ensure there are no active Burrowing Owls.
We would like to attend a Board of County Commissioners' hearing as soon as possible. Please call

Dear Ms. Ortiz:
On February 5, 2001, Savage and Savage conducted a site investigation of the North La
Poudre Resource site in order to assess the likelihood of encountering jurisdictional
wetlands. The North La Poudre Resource site is approximately 40 acres located
immediately south of Colorado State Highway 392 and approximately 0.25 miles east of
Weld County Road 13. The legal description of the site is the N''/2NW'/. Section 19.
T6N, R67W, 6'h Prime Meridian, Weld County, Colorado. Currently, the property has
two ongoing land uses; agriculture and grazing. Adjacent land uses include sand and
gravel extraction, agriculture. commercial, and residential.
Waters of the United States
Waters of the United States. regulated by the U.S. Army Corps of Engineers (Corps), are
all waters which were. are, or could be used in interstate commerce: and in Colorado
include (but are not limited to) rivers, streams. ponds. sloughs, and wetlands. There are
no waters of the United States on the North La Poudre project site.
Jurisdictional Wetlands
Regulated jurisdictional wetlands encountered in Colorado include submergent,
emergent. wet meadows. sloughs, surface water drainage ditches, bogs, and potholes.
Jurisdictional wetlands are not present on the site.
Discussion and Recommendations
Waters of the United States and potential jurisdictional wetlands are not located on the
North La Poudre site. Therefore, in our opinion, no additional wetland surveys need be
undertaken.

Wildlife Assessment
Site Description
Savage and Savage conducted a wildlife assessment for the Hall-Irwin Corporation's
North La Poudre Resource site on February 5, 2001. The North La Poudre Resource site
is approximately 40 acres located immediately south of Colorado State Highway 392 and
approximately 0.25 miles east of Weld County Road 13 (see Location Map). The legal
description of the site is the Nl/2 NW1/4, Section 19, T6N, R67W, 6th Prime Meridian,
in Weld County, Colorado.
The weather during our site investigation was breezy and mild with temperatures around
55° F. The ground surface was moist with snowmelt from a previous snowstorm. The
elevation of the study area is 4,785 feet and slopes less than 1°to the south. The nearest
receiving water is the Cache La Poudre River which is located approximately 0.5 miles
south of the site. The soils on the site appear to be a mix of silt and clay.
A north-south fence line separates two fields within the site. The larger field
encompasses the west two-thirds of the site. This field is a heavily grazed native pasture
that is dominated by the cool season grasses inland saltgrass (Distichlis spicata) and
intermediate wheatgrass (Agropyron intermedium). The smaller field encompasses the
east one-third of the site. The smaller field is an alfalfa hayfield that is actively managed
and cut. The most recent cutting appeared to be in the fall of 2000. Current land use
impacts to wildlife resources are of an indirect nature. The current quality of wildlife
habitat based on range condition and overall health and diversity of the vegetation
communities in the grazed pasture is poor and fair in the hayfield.
Significant Wildlife Resources
Tables 1, 2, and 3 list wildlife species that potentially occur on-site according to the
Colorado Distribution Latilong Studies (CDOW, 1981, 1990, 1998). The latilong studies
address mammals, birds, reptiles, and amphibians. During our site investigation several
species were identified by sight or sign. Several colonies of black-tailed prairie dogs
(Cynomys ludovicianus) are present on the site. We estimated the total population of the
colonies to be comprised of greater than 75 individuals. Coyote (Canis latrans) and
unknown rodent scat were encountered during the investigation. Raccoon (Procyon
lotor) tracks were present along the east edge of the large native pasture field. A merlin
(Falco columbarius) was perched on a utility line along the north boundary of the site.
Seasonal Use
With the exception of bats, the mammals species encountered during the site inspection
or that potentially occur on-site are expected to be year-round residents or users of the
site. The carnivore and ungulate species are not restricted to this site and tend to have
relatively large home ranges (up to several square miles). The majority of rodent and
insectivore species can be expected to reside on-site throughout the year, though many
may hibernate during the cold months. Avian species may be year-round, temporary
migrants, or summer residents of the site. Year-round residents would include the
waterfowl, raptor, gallinaceous birds, pigeons, owls, and woodpeckers. The majority of
the shorebirds and passerines would use the site during the spring, summer, and fall for
feeding or resting during migration. Amphibian and reptile species of the site are year-
round residents.
Threatened and Endangered Species and Critical Habitat
Critical potential habitat for any identified species of special concern was evaluated. In
particular, critical potential habitat for the Preble's meadow jumping mouse (Zapus
hudsonius preblei), Ute ladies'-tresses orchid (Spiranthes diluvialis), and western
burrowing owl(Strix varia) was evaluated. No potential critical habitat was found for the
Preble's meadow jumping mouse or the Ute ladies'-tresses orchid. A request for
disqualification of the site for these species has been submitted to the U.S. Fish and
Wildlife Service for concurrence (copies appended). Potential critical habitat for the
western burrowing owl is present on-site. Burrowing owls occupy abandoned prairie dog
and ground squirrel burrows on open ground between March and November in Colorado.
While the black-tailed prairie dog colonies could be potential habitat for burrowing owls,
no sign of owls (pellets, feathers, and tracks) was observed during the field investigation.
Project Effects to Wildlife
Temporary effects from mineral extraction at the North La Poudre project site will
include habitat and food source loss for year-round resident species, specifically the
black-tailed prairie dogs and other less mobile species. Other species such as raccoons,
coyotes, and raptors will continue to use the periphery of the site as well as the site itself
when operations are not active. Bird species will use the periphery of the site and the site
itself opportunistically, if prey or food species are present on-site. As there is little
significant wildlife habitat present currently, impacts to the wildlife resulting from the
project should be minimal.
The proposed project will extract material and leave two cells covering the majority of
the site. Permanent reclamation of the site will entail grading, respreading topsoil, and
seeding and planting perennial species that will support wildlife species. The mining and
reclamation will create a more diverse habitat than is currently present. Areas of open
water will sustain additional species of reptiles and amphibians as well as shorebirds and
waterfowl. The addition of the water will create fringe environments favorable to
predatory mammals and raptors, as well as food and water sources for herbivores. With
the planting of tress and shrubs, additional strata and vegetation layers will be added to
the site, creating improved cover, foraging, roosting, and nesting areas for wildlife.

Dear Mr. Plage:
Savage and Savage conducted a field investigation at the proposed North La Poudre
project property on February 5, 2001 in order to assess the potential for the presence of
critical habitat for the Preble's meadow jumping mouse (Zapus hudsonius preblei), a
federally listed threatened species. The North La Poudre Resource site is approximately
40 acres located immediately south of Colorado State Highway 392 and approximately
0.25 miles east of Weld County Road 13. The legal description of the site is the N1/2
NW1/4, Section 19, T6N, R67W, 6th Prime Meridian, in Weld County, Colorado.
Currently, the property has two ongoing land uses; agriculture and grazing. The nearest
receiving water is the Cache La Poudre River which is located approximately 0.5 miles

of Zapus hudsonius preblei for the following reasons.

The nearest riparian corridor is along the Cache La Poudre River which is located
approximately 0.5 miles south of the site. No bodies of water, wet meadows, or
seasonally moist soils are present on the site. The North La Poudre site consists of two
highly modified fields. The larger field on the west two-thirds of the property is heavily
grazed native pasture. The smaller field on the east one-third of the site is an alfalfa field.
There are no shrubs or trees on the North La Poudre project site that form a vegetative
canopy.

Based on the authority conferred to the U.S. Fish and Wildlife Service (Service) by the Endangered
Species Act of 1973 (ESA), as amended (16 U.S.C. 1531 et seq.), the Service reviewed the Preble's
meadow jumping mouse. Zapus hudsonius prehlei, (Preble's) survey report submitted February 8.
2001. This report regards the Hall-Irwin Corporation, North La Poudre Resource Site in
County. Colorado (Section 19, Township 6 North, Range 76 West).
Given your compliance with the Preble's survey guidelines, the Service finds the report acceptable
and agrees that Preble's habitat is not present within the subject area. Thus, the Service concludes
that development or other actions on this site should not directly affect the continued existence of
Preble's. Should Preble's populations exist downstream from the site, actions on the site that result
in significant modification of Preble's habitat downstream (for example_through alteration of
existing flow regimes. or sedimentation) may be subject to provisions of the ESA.

SUBJECT: Revised Conditions of Approval
Planning Staff is recommending that the following revisions be made to the conditions of
approval/development standards for USR-1316:
1) The Weld County Department of Health and Environment has indicated that conditions of
approval 2B and 2E have been satisfied and therefore can be removed.
2) Development Standard #10 shall be modified to read as follows:
The facility shall adhere to the maximum permissible noise levels in the Industrial
Zone District as delineated in Section 25-12-103, C.R.S.
3) Development Standard #13 shall be modified to read as follows:
Portable toilets may be utilized on sites which are temporary locations of
the working face and portable processing equipment, etc., for up to six
months at each location.
