February 5, 2001 ATTN: Kim Ogle Case #USR-1306 ed Ccuriy pinl1r!ig C_ pT 1555 N. 17th Avenue Greeley, CO 80631 4 2001 RECEUJ' ED Dear Mr. Ogle, We are writing to oppose the Use By Special Review Permit #1306 application by Platte Sand and Gravel, LLC. Currently, we are in the process of purchasing the property located at 10997 WCR #36. We had no idea, at the time of negotiating with the current owner, what was being planned for the land directly behind and to the north of the property. We first must say that our concerns are not of a personal nature against Mr. Tom Sharkey or Mr. Rocky Hoffschneider. We understand fully their right to the mineral claims on their property. We also send this letter with all due respect for Weld County policy under Section 22-5-80 of the Weld County Comprehensive Plan. However, we do believe that USR #1306 does not warrant approval. Our leading concern is for that of the immense and diverse wildlife populations in the area - especially the bald eagle population. We know of at least 11 adult and juvenile bald eagles which utilize the trees directly behind 10997 WCR #36. Weld County wildlife biologist Courtney Crawford recently indicated that, based on data gathered by their department, that at least one and possibly two night roost sites have been confirmed within the proposed mining boundaries. They now have volunteers documenting throughout the day, the continuing activity of these birds as nesting season fast approaches. Mr. Crawford also indicated that the possibility of a nesting site exists which would require by federal law significant restrictions on mining and hauling in proximity of up to a half-mile range. We request that no approval of any disruption of this site be granted until it is accurately and completely surveyed for the specific activities of this endangered species. There is also the possibility of other endangered species for which no site survey, that we are aware of, has been completed. We request that the proper surveys for the Preble's meadow jumping mouse, the Ute Ladies'tresses orchid, as well as proper survey's for possible other endangered plants and vertebrae, be required before any disruption of this land occurs. In our view, we as human beings are charged with the stewardship of the earth and its wildlife. We must take responsibility for caring for all species, let alone those we are mandated by law to care for which are now in danger of extinction. This area is one of the few existing today with such a diverse wetland and dryland population of wildlife. Populations of burrowing owls, badgers, foxes, coyotes, hawks, falcons and numerous other mammals and waterfowl call this property home. We must do what we can and at the very least, what is required by law, to preserve their quality of life. The sheer scope of this project, with 40 acres of exposed mining occurring at any one time is simply not in compliance with the Weld County Comprehensive plan which specifies "reasonable and orderly development of mineral resources". The number of other plants (concrete batch, asphalt batch, asphalt recycling, etc...) would turn this beautiful, peaceful, rural area into an industrial site. icai 2001-2126 The quality of life in this area would seriously decrease. Most of the residents here, ourselves included utilize the surrounding roads (which would become haul routes) for our leisure and recreational activities - most of which involve horses. This would become all but impossible given the rate of truck traffic and the noise which would accompany this traffic. The peaceful existence of this agricultural and farming community would be destroyed. Psychologically, the unending noise, dust and light poses significant risk to all of us - animal and human alike. The traffic volume is of great concern to us. The numbers quoted in the application do not appear to include up to 200 employee vehicles, delivery vehicles, or incoming trucks bringing in asphalt or concrete to be recycled. Looking at all of this together, we start to get a picture of 300-500 vehicles per day. In a 10-hour period, that works out to be approximately one vehicle every 1-2 minutes! A traffic study, to our knowledge, has not been performed for the proposed haul route. We request that a traffic study be completed before any decision regarding the application is made. The surrounding roads are not designed for this type of heavy traffic. No mention of mitigation concerning traffic, school bus routes or safety considerations was mentioned in the application. In investigating other nearby gravel mines (of which there are several - although the application states there are none), we found that they all are immediately accessed by at least one main, paved highway or byway. The application states that one of the benefits of this location is its easy access - yet a new road must be built, and the haul route runs directly through a rural community (where we and other community members ride on horseback, travel in slow- moving farm vehicles, etc...) before traveling several more miles to reach the highway where they will pass two other working gravel mines! We have serious concerns for ourselves and our children in negotiating this much traffic on these country roads. The new road extending WCR23 to the north would intersect our only means of arriving to and departing from our home. We would be coming and going in vehicles as well as riding on horseback across this road. Considering the number of vehicles planned (which of course could be more depending upon "market demand"), we feel we will be running a risk every time we come home, leave, or ride our horses out of our drive. No mention of these potential risks exists in the application. Nor is there adequate consideration to the noise of"fake brakes" - a potential hazard for anyone riding a horse nearby. Horses spook quite easily with any sudden, loud noise. No mention is made of liability for injury caused by a fall from a spooking horse due to traffic or noise from traffic. We also have serious concerns about the stability of the water table and our own and others' domestic wells. No mention of liability for changes to the water table and the possible resulting dry wells is mentioned. We cannot endorse an operation of this size that does not adequately address the need for responsibility around the viability of the surrounding wells - both domestic and agricultural. We are concerned about mosquito populations rising to an intolerable level due to standing water. Again, no mention was made concerning this problem. Noise Pollution. At the levels stated in the application, 200 feet away will be like living on an industrial site. This is not acceptable for the homeowners, including ourselves who fall within this 200 foot range. Dust Pollution. We are concerned that watering the roads twice a day will in no way be sufficient for the type and volume of truck traffic planned. It is mentioned in the application that dry mining may occur at the discretion of the operator. Nowhere does it address dust mitigation for anytype of mining activities. Light Pollution. No mention is made around lighting requirements. Twenty four hour availability of the plant area for maintenance, etc... will require 24 hours of lighting. Already this particular community has had to adjust to the large St. Vrain Power Plant, which lights up the sky and surrounding area 365 nights per year. Perhaps that is enough to ask of one community. This excessive lighting is potentially unhealthy for the humans and animals which endure constant night exposure. Migratory patterns of many species of birds are thrown off by human, artificial lighting. Nothing is mentioned in the application addressing lighting intentions. In the application, it is stated that the plant area will be moved as needed. Moved to where? We are concerned that at some point the intention is to move the plant further south for the convenience of the operator. Considering the concerns around the bald eagle habitat as well as the potential of living with a plant site directly in our backyard we strongly oppose the idea of a moveable plant. Perhaps the plant site will move further north with the anticipated railroad access? We don't know, and without delineating a permanent site, neither does anyone else until its too late. We are deeply concerned about the hours of operation. Four a.m. to 8 p.m. is not in line with "reasonable and orderly". The disruption to our and other's family, farming and rural life would be immense. In the fall, we breed two of our mares. Upon consultation with our veterinarian, we have serious concerns about encountering problems with both breeding and gestation due to the stress put on these animals living in such close proximity to the high volumes of noise, traffic, dust, and various other �-- mining and plant activities. Finally, we understand Weld County to be committed to preserving prime agricultural land. As we are moving from Boulder County, we know what it is like to live in a county which has developed so much of its agricultural land that there are yearly struggles to find enough hay and alfalfa to feed local livestock. Prices of $9-$12 per bale are now the norm and people feel lucky if they can find any at all. Hay and Alfalfa are trucked in from southern and eastern Colorado in order to supplement ever dwindling supplies. Boulder County did not think ahead about their agricultural needs. Weld County however, is aware of theirs. This is an opportunity to support and be in compliance with both the town of Platteville's and Weld County's comprehensive plans. As new citizens, we fully support the county and town in their endeavors to maintain quality of life for their citizens. The rejection of USR#1306, based upon its non- compliance with both comprehensive plans, will let people know that Weld County is indeed serious. Our home is located on the corner of that intersection. It currently is a productive working farm. Our concerns are with future water table levels(will taking 600,000 cu. yds. of gravel yearly) lower our water table and if so make our water wells fail? Another concern is traffic on WCR 40 (it is called a local delivery route in the application, no reference is made to the number of vehicles, type of vehicles this is very vague. An added concern is for local children(we have one daughter age 10) who rides the school bus on this road and WCR 23 and 36 every day where there could possibly be 120 or more large trucks driving daily. Not only is it unsafe it is very dangerous with the condition of these older county roads, widths are decreased by numerous culverts, ditches, fence lines, farm equipment and others. Air quality is also a concern, spring and summer months are already a hardship with existing traffic dust, I can only imagine it being worse with the added traffic. Will we be able to open our windows and enjoy the country air, and life style we choose years ago? Last but not least we oppose the industrial applications concrete and asphalt batch plants, asphalt and concrete recycling plant, pre-cast concrete plant. For what possible reason would we want those activities to be located in the center of a viable agricultural area that we have now. To sum up we live in weld county because we choose to.We farm our land as it was intended to when generations past broke it from sagebrush. Although I live approximately three miles from the site of the proposed gravel mine and batch plants, I feel strongly that my quality of life would be impacted by the mining. The traffic pattern could possibly send as many as two hundred gravel trucks directly in front of my home on Highway 66. The application states that Highway 66 and WCR 21 would be the access for reaching south of Platteville towards the Denver area. Anyone who is familiar with Highway 66 already knows that this highway is quite possibly one of the most dangerous stretches of highway in Colorado at the moment. The road is not designed for that amount of truck traffic. And it appears to me that the route that Platte Sand and Gravel has chosen is designed specifically to avoid checking at the Port of Entry that is one half mile south of Platteville. I strongly suggest,if it has not been done already, that Weld County Roads and the Colorado Department of Transportation do a traffic study on the intersection of Highway 66 and WCR 21. I'm quite sure that the results will be that the intersection does not meet the safety requirements for the volume of traffic the gravel mine would demand. In addition to the traffic issue,I have other concerns. The length of the permit, size of the operation and the batch plants in a flood plain seem to be overzealous. I have concerns with the wildlife of the area, the historical content of the area, and the impact of such a large operation for such a length of time on the surrounding landowners. Although there are differing opinions about the impact of mining to water supplies, this mine, simply by its size and length could impact surrounding prime agricultural property by drying up or severely limiting the quality underground wells. First, my children wait for the school bus to pick them up at approx. 7:30 a.m., and drop them off at approx. 3:30 p.m., on road 40 at the intersection of road 23. My family is not the only family with children getting on and off the school bus at this intersection. As declared in the application road 40 will be used for material needed in the immediate vicinity of the mine. This means all potential 130 loads with destinations North of road 40 will access road 40 at the intersection of road 40 and 23. This would be the shortest rout to Gilcrest, LaSalle, Milliken, Johnstown, "Greeley", "Loveland", "Ft. Collins",.. You now see the potential risks. Each morning and afternoon we have two school busses that travel on road 40 that we can see from the intersection of road 40 and 23. The first travels North on 23 and turns East on 40, the second travels West on 40 and turns south on 23. Keep in mind that the 130 outbound loads per day amounts to 260 round trips on road 40. Second, road 40 is extremely narrow from highway 60 to the intersection of road 23. As you travel these 3 miles, the width of the road is inadequate for this increased traffic. The telephone poles are directly off the road to the north approx. 10 feet from the centerline of the road. Today if I am West bound on road 40 and sharing the road with an East bound truck; I stop next to the telephone poles to allow room for the truck to pass. This issue needs to be addressed today with school busses. Road 40 is the narrowest at the end of our driveway, the exact place that the school bus stops to load and unload our children. Third, the amount of dust generated on road 40 today poses a health issue. If a vehicle is directly in front of you on road 40, you must let them advance a '''A to 'A a mile to allow the dust cloud to clear. If you don't, you cannot see the vehicle in front of you or on coming traffic. Keep in mind that a dairy is located at the intersection of road 40 and 23. The milk barn is approx. 50 yards South of road 40. This increased traffic and increased dust would create a huge health risk to the quality of dairy products produced on this farm, and decrease the over all health of the cattle due to breathing dust. EXM1Bff I Fourth, the amount of noise generated from this amount of truck traffic would drastically reduce the quiet enjoyment of our property. Previously we owned a home at the intersection of highway 60 and road 46. This is the truck route to the ConAgra feedlot East of highway 60. The J-Brakes would start at 5:15 a.m. and continue until approx. 5:30 p.m. This is the same situation we would have at the intersection of road 40 and 23. Fifth, the passing of permit #1306 would devaluate our property by approx. 25% of the appraised value with out the truck traffic. No one would purchase the properties along the truck routes with this amount of truck traffic, dust, noise, and increased risk of having an accident. No one. As a real estate broker with past listing near gravel pits, no one wants to be exposed to the truck traffic, dust, noise, and increased risk of having an accident. Also, the mounds of sand, gravel, asphalt, used concrete, used asphalt, and wash out sights of concrete trucks, do not help with the overall sight of the adjacent land. Pour a 75-foot high mount of sand, gravel, asphalt, used concrete, and used asphalt in your back yard and you understand how the valuation of your property diminishes. Sixth, when Platte, Sand& Gravel L.L.C. dewaters the site of excavation, how long before our shallow water wells dry up? This is bound to happen especially in a dry year like we had in 2000. Seventh, we have much better places to install sand and gravel pits. Last year Ed Kammerzell @ 22434 highway 60 Milliken, Colorado sold his river bottom property only 6 miles from Tom Sharkeys property. This sand and gravel pit has highway access directly to highway 60. The trucks will not pass any house on a dirt road to access the highway; no school bus issues, and the proposed processing sight will be %2 a mile from the nearest resident. We ask that you give careful consideration to our simple concerns contained in this letter. We do not want permit#1306 to be approved. We have hundreds of other places along the South Platte River and St. Vrain Creek to install a sand and gravel pit that will minimize the conflicts by 90%. I own an 80 acre farm on the east boundary of the proposed haul route of the gravel pit. I have owned this property only since December of 1999. During the past year, I, as well, as family and friends, have worked incessantly to improve this property. I have spent a great deal of time and money. This property is not only my home but it has also become a reputable horse boarding and training facility. I have many boarders who cherish the peace and serenity out here. This proposed gravel pit and haul route has brought much concern to myself and my boarders. I have many young horses and many"green" riders that board here. My liability as a trainer and facility owner would increase dramatically with 100-300 trucks driving down my property boundary on a daily basis. I would also like to mention the amount of noise and �-•• dust that the excessive amount of traffic would bring. I depend on monthly boarding fees and training fees to keep this property and feel as though this gravel operation and especially,the haul route, will eventually disable my efforts to keep this property. In addition, the area hosts several Bald Eagles. There is a roosting site not far from the proposed haul route. The mining activity and increased traffic is sure to force the eagles out of the area. I am also extremely concerned about water table protection. It has been brought to my attention that the water table will change, especially with a mining operation of this size. I am not only concerned about my domestic well but also the irrigation well that provides water to 20 or more acres of alfalfa. Afterall, this area is zoned agricultural not industrial! There are so many issues concerning this proposed mining operation USR#1306. The extreme size of the operation, the proposed access which affects so many residents, the wetlands and riparian areas, water table protection, schoolbus routes, and numerous other concerns are extremely valid reasons why this application requires thoughtful consideration. Why should there be another batch plant and precast plant within four (4) miles of the already established Platteville Ready Mix on the east side of Highway 85? 3. In a letter prepared by Mr. Steve O'Brian, of Environment Inc., dated December 11, 2000, Page 3 - He states that "This application can stand on its merits and we can work around their regulation to protect endangered species." Why should this organization be able to work around any regulation when everyone else (Camas, Lafarge, Hall-Irwin) be made to abide by the law? 4. Mr. O'Brian also verbally stated to Mr. Dave Eldredge, (individual wanting to purchase the property that is surrounded on all sides by the proposed properties for mining) that, "300 vehicles will blow down WCR 23 a day." This is a far cry from the proposed 20+ trucks stated in the application. 5. Page 25 of the said application is a Noise Report, however, I deem this worthless due to the fact is was not a "site specific" report. The proposed plant and equipment is stated to not be closer that 500 feet to the property line. The statement made in the application states that they do not believe the noise generated from this operation will disturb surrounding residences. Flow can this be stated if the noise report on Page 25 is not site specific? 7. There is one house that is severely affected by this operation due to the fact it is surrounded on all four sides of its property lines, not more than within 200 feet of the operation. What are noise levels at that location? 8. In the noise report, Page 25 of the application, it doesn't mention if the decibels of noise made by the equipment were made with equipment in the working mode or in an idle position? This would have a significant difference in the noise levels. 9. Has FEMA been consulted regarding the effects of storing asphalt for recycling in a flood plain? Is an Asphalt plant even allowed within a flood plain? What are the FEMA requirements regarding temporary structures in a flood plain? r 10. The entire mining area is in a FP1 or FP2 zone, except for the old ranch headquarters. Will the proposed shop area and plant be elevated above the 100 year flood mark? The Hoffschneider house is at an elevation of 4763.5 and the north end of the mining area is at 4734.5. It would appear that there is almost 30 feet difference in elevation. Will the stock piles of material (i.e. gravel, sand, rock, and recycled asphalt) affect the 100 year flood plain mark? In other words, the lake is dug out and full of water and the material is stock piled around the lake. Will this force flood tables to raise? 11. The application states two continuous shifts of 4:00 a.m. to 8:00 p.m.. What happened to the 7:00 a.m. to 7:00 p.m. scheduled in the summer and a 7:00 a.m. to 4:00 p.m shift in the winter? (This statement was made to Mike DePratt and Dave Eldredge by the Weld County Planner - Kim Ogle). 12. The application states that vehicle speed will be 15 mph on interior roads. Who will be in control to enforce that speed? Should the truck-speed on the county roads then be posted as 25 mph on WCR 23 for all trucks over five (5) tons? It is well known that WCR 36 is used as a "short-cut" for semi's to dodge the port of entry. Should WCR 36 be posted 30 mph for all vehicles five (5) tons or more? 14. Dust control by watering twice a day is inconsistent. Why not Envirotech (what the County uses on WCR 36 and 23) as the dust control agent? What time of day would the watering of the roads take place? 15. The "Sharkey" property is covered with thistle ( a noxious weed as per the Weld County Agricultural Department). They have done nothing with the weeds they have now. Will this mining project, such as the removal of top soil, help spread this already established thistle problem? Should a weed consultant be employed by the company to ensure no further spreading to the surrounding agricultural properties? 16. What does the "buffer area" consist of? 200 feet along the property lines? Will this area be planted with trees, landscaped or left as is? 17. Will the "buffer area" be used as a driveway or road? 18. How will the company tie in their proposed road at WCR 23? How do they propose entering WCR 23 or exiting WCR 23 with regards to safety of the public? There is no Right of Way (ROW) west of WCR 23, as stated in the application (see Attachment 1 - Quit Claim Deed, dated August 31, 1972, which gives that 60 feet of ground back to the property owners - i.e. Mr. Norm Swank). 19. There is a statement on Page 25 of the application which says that the company will work with the-neiohbors. Should the company be required to give the owners an option to be bought out? Such as a relocation settlement? 20. 4:bo o •p appraiser be called in to appraise the surrounding properties prior to the ining,operatibn to establish property values? What about relators opinions oft the resale value of the property after a pit is started? Is it hard to sell your property next to an active pit? 21. Mr. Francis Adler, a long time resident Of the area in question, has mentioned a historical site marked by a monurdentwhere the old Fort Saint Vrain once stood. Varra Companies is turning their area over to the Town of Firestone as a pristine open space for the public. Why does this company retain the privacy? Surrounding neighbors will be giving up their privacy for 100 years with nothing in return. 24. What are the benefits that Weld County, neighbors, and the surrounding agricultural areas will see that the company talks of? It is understood that most of this gravel will end up at this companies sister location located in the Littleton area. How does this benefit Weld County if it is being shipped to another location 60 miles out of Weld County boundaries? 25. In Section 6 (24.7.1.3) of the application a statement explaining the uses permitted will be compatible with the existing surrounding land uses, including a description of existing land uses of all properties adjacent to the property. The answer given was that the mining within 200 feet of a home and land owner will have little affect on the surrounding uses. What about the property value and serenity? These things are priceless to the surrounding area. It will greatly affect the area especially the areas to the south. There is more than five (5) homes to be affected, despite what is stated in the application. 26. This mine is next to an urban growth area. The Town of Platteville's growth area is North to WCR 36 and West to WCR 23. This mine will impact any further growth that may happen North of WCR 36. If this mine goes for the full proposed 100 years, how can the Town of Platteville expand to the North? The Town's plan shows expansion to WCR 36 by the year 2025. This only covers 25 years. The Town of Platteville will need to expand to survive. However, if a 100 mine is in the way, it interferes with the comprehension plan of the Town. One of our concerns regards the increased truck traffic on our already dilapidated road system. The road system in our area is comprised of many dirt county roads. These roads are not designed to accommodate any heavy truck traffic. Agricultural and natural gas/oil rig trucks use the paved county roads in our area. These roads are already deteriorated and filled with potholes, increasing heavy traffic on these roads will only make the situation worse. A second concern for us is the proximity of the proposed site to the county road that goes by our home. It is County Road 32 '/z and is one of only two paved roads in the area that has a bridge that cross the Platte River and lead to Highway 85. This road is already dangerous because of the multiple curves as the road leads into Platteville and becomes Grand Avenue. The final curve leading into Platteville accommodates the only egress to our subdivision. I cannot count the times our family has witnessed"near-misses" at this intersection. We are afraid that this intersection will become one of"hits"should the tractor trailer traffic increase. Our gravest concern stems from the vague wording of the proposal. We feel that the mining operation could adversely affect not only the lives of the citizens in the area,but also the natural habitat of many species in our area. We have enjoyed living in the Platte River and Saint Vrain River valley. Often, as we commute to work or to the store, we are blessed to witness the beauty of our national symbol as it soars in the sky and targets a rodent as its next meal. We are against the proposal Case # USR-1036. There are already several mining operations between Highway 66 and County Road 24 along the Saint Vrain River. We are not convinced another operation is necessary. FSV is also concerned about what occurs in our neighborhood as we continue to consider the possibility of other energy dependent businesses being located on our property. FSV has been in discussions with various gravel mining operators for the last three years regarding mining on our property east of the South Platte River and south of the applicant. We have discussed our proposal for mining gravel on our property with Platte Sand and Grave LLC, the applicant, as a potential vendor. Our purpose in mining the gravel is to develop water storage to supplement the water supply to FSV and other generating assets as we continue to meet he growing energy needs of Colorado. We expect to be making application to Weld County r our own mining operation in the near term because this storage is important to meet our short t objectives. My concerns regarding the application are as follows: • The applicant will generate considerable truck traffic on roads adjacent to our plant, ich may affect the safety of our employees and contractors. Improvements to the roads w 11 help mitigate this effect,but we don't know what improvements are being proposed a part of this project. Improvements to the area where WC Road 23 joins WC Road 32 '4 j t east of the bridge over the South Platte should be completed. The recent Varra mining operation has had an effect on Hwy 66 and we understand them may be another mining application for the area just north of Hwy 66. This could result in multiple concurrent mining operations. • Hwy 66 should be improved to accommodate this traffic and the increasing traffic associated with the growth in the area. Our employees frequently take WC Road 34 west to I-25 because of their current safety concerns for travel on Hwy 66. These multiple mining operations will exaggerate this problem. • We understand the applicant's right to mine the gravel on his property similar to what we will be proposing. We don't understand the need for the other related asphalt batch plait and recycling operations and the applicant hasn't been clear around his business purposes for this expanded operation. In our discussions with the applicant,they haven't clearly identified the incremental traffic impacts from each of these operations. The applicant indicated a current problem with excessive concrete spoils at their Denver operation and we are concerned about our neighborhood being negatively impacted by this part of his proposed operation. • FSV is willing to discuss a mil option for transporting this material using our railroad spur from Milliken. Our discussions with other gravel vendors have indicated they didn't believe rail transport was financially viable. This possibility should be given serious consideration before it is represented to the neighbors as a method of mitigating the impact of trafhc- • FSV has completed significant environmental studies during our nuclear operating history. Most of this information is in the public domain and we are prepared to assist in identifying any potential problems such as wildlife habitat or archaeological issues. I recently learned now a mining operation for sand & gravel, an asphalt batch plant, a concrete batch plant, an asphalt/concrete recycling plant and a precast concrete manufacturing plant are all now possibly going to be located a little over a mile from my neighborhood. Currently, my neighborhood consists of 92 houses (new) . Nearby, a new developement of 175 houses is just starting to the northwest on rd.32} (even closer to the proposed mine site) . With the population growing in the area and related other factors I respectfullyya denial of mining application (case llusr-1306) . reluesT The following are some of the reasons an operation of this type is not suitable for this area: PROXIMITY - populated areas are too close. After housing projects are completed traffic will increaSe much more than at present. The operation states in it's review papers that they will havein'. constant daily operation-20 to 50 gravel trucks, 10 to 30 concrete mixer trucks, 20 to 30 asphalt trucks, 3 to 10 precast delivery trucks, 8-10 delivery vehicles, & miscellaneous other vehicles--all weighing 15 to 25 tons. This much heavy traffic will not mix well with increased daily car/truck passenger. traffic & farm machinery that currently rely on these local roads. The proposed truck route also goaonto highway 66 (currently heavily used & dangerous as it is) . Road 32},21,23 & surrounding area roads are not in great shape now and are surely not made to withstand up to 120 or so 15-25 ton trucks daily. After these roads wear outs:who will foot the bill for road repairs? They will rapidly wear out & taxes will most likely be effected-not a popular prospect nowadays. NOISE - The serenity of this area will become a thing of the past. Being about a mile away, I will most likely hear truck traffic noise, excavation noise, rock crushing noise, and a variety of other noises -coming from the site: The shift hours are to be 4a.m. to 8 p.m. Who will listen to the complaints of residents who are awoken at 4 a.m. daily? Eight a.m. to six p.m. are reasonable hours not 4 a.m. to 8 p.m. Those hours are preposterous. AIR POLLUTION - Concrete & asphalt manufacturing & recycling have potential for air degradation in. the area. Who will sincerely, regularly & rigidly enforce anti-pollution guidelines? Loose rock on theroads and dust may also be problems to contend with. DESTRUCTION OF WILDLIFE HABITAT — Currently the area is inhabited by a variety of wildlife=geese, ducks, eagles, woodpeckers, hawks, owls, foxes, skunks, deer, pttrie dogs, coyotes, possums, etc. etc. That is one. reason I enjoy living where I do. Just yards from the proposed property is an area I see numerous waterfowl using daily. The increased activity, the noise and destruction of land will drive this wildlife away. The river needs repair as it is but, increasing potential damage to it & surrounding wetlands is inexcusable. (cont.) Current residents will most likely be leaving also. A lower standard of liming is not something to strive for. This situation is not fair to the people of Platteville & surrounding areas. We have worked hard to ensure our goals, aspirations, & happiness in life is attainable. Allowing this operation to commence activities (at the expense of surroundings& well baing of it's inhabitants)is a big mistake that will have a negative impact. S & H mine have no previous mining records as a company. This is troubling. With no apparent track record we have every right to be skeptical & very concerned. The unforseen consequences are definately worth considering. Who will enforce regulation? Who will monitor adherance to EPA standards? Who will regulate proper procedural methods? Who will adequately handle concerns, questions & complaints of local residents? Who will seriously monitor & regulate land reclamation? If your commission can not make such a conditional approval, please disapprove or postponed the approval until such time as new roads are in place. Property that I own will be negatively affected by the heavy increase in truck traffic associated with proposed gravel operation. The property, N1/2NE1/4 1-3 —67, will have a 1/2 mile frontage on WCR 38, one of the access road to and from the east, and Va mile frontage on WCR 25, the first road from the pit that offers access to and from the south. The present graveled roads are not suited to the volume of traffic associate with such an operation. The frequent passing of heavy trucks will generate an unacceptable and an unhealthy level of dust during dry periods. The heavy trucks will render the roads impassible to cars during wet weather. EF3 16 X001 February 6. 2001 R..E C, ki tki Weld County Commissioners, !\ We are writing to you in regard to the gravel pit that is being proposed for the Platteville area by Platte Sand and Gravel on 850 acres approximately 3 miles northwest of Platteville. Our concerns are many and we ask you to please listen to our concerns and give them careful consideration. First of all we ask for an indepth traffic study on Colorado Highway 66, the Platteville city streets of Division (off of Hwy.66) and Grand, leading to the proposed area. Right now Grand will suffer a huge additional use as 175 new homes are being built as we speak. Division is of great concern because this street runs by our middle school and elementary school. Many children use this street to get to and from school every day. And as we all know highway 66 is heavily traveled now. One hundred more trucks a day will only make a bad problem worse. Besides traffic and safety concerns for our children we are also concerned about the wildlife habitat along the South Platte River. The gravel pit will be noisy, dusty and damaging to the bald eagle and other raptors in the area. Mr. Sharkey states in the Greeley Tribune that he is"doing it for his children" but his children would have to live to be well over 100 years old to see the lakes and beaches that Mr. Sharkey says he "will probably" give back to the state and or county at completion of the project. Mr. Sharkey also states that he"has a good job and doesn't necessarily need the money from the operation." In conclusion we ask you to please consider all the facts before making your decision.
