According to the application, there are four aspects of the proposed modification to the service plan. They include: 1. Amendments to the original service plan 2. Wastewater Treatment Plant Capacity 3. Expanded Service Area 4. Storm and Surface Drainage General comments we have concern the lack of information to substantiate and confirm conclusions made in the application materials. Perhaps the information submitted to Weld County includes such detail, and it was not forwarded to referral agencies for review and comments? If so, such information might be helpful to reviewers to determine if we arrive at the same conclusions as the applicant. Also, the size and quality of the photocopied maps hinder our ability to determine the categories of particular areas of the service area that are proposed to be amended. For example, it is not clear what category the Sherwood parcels are on the St. Vrain Sanitation District Title 32 Service Area Map. Specific comments concerning information on particular pages of the application follow. Amendments to original service plan propose to modify some of the original requirements of approval. One of the requirements is that the St. Vrain Sanitation District's (SVSD) facilities shall be consistent with the expansion of future municipal wastewater treatment facilities. The application provides information (page 2) concerning the City of Longmont's Wastewater 4. The conclusion of the most recent Wastewater Treatment Master Plan was not definitive that the City of Longmont will expand treatment capacity to 22 million gallons per day (MGD) at our current wastewater treatment plant site. Rather, the Wastewater Treatment Master Plan recommended that the City pursue our current expansion to 17 MGD, and then revisit alternatives for the next(probably ultimate) expansion. At that time, the City may revisit downstream locations and some consolidation of service areas. The City anticipates that analysis and review will occur in the 2015-2020 time frame. The application proposes that the requirement to discuss impacts on County roads and police services be eliminated (page 2) because it assumes that municipalities will continue to annex in unincorporated Weld County and remove the County's road and police service responsibilities. The City questions the wisdom of removing this requirement prior to such annexations actually being recorded and the land being removed from the County's jurisdiction for these two services. One of the requirements of the original service plan is that an industrial pretreatment plan be submitted to the Colorado Department of Public Health and Environment (CDPHE) as part of the site application (page 3). The application indicates that this has been done. It also mentions that pretreatment requirements have become more stringent and likely will continue to change over time. However, the application does not provide information about what it needs to do to comply with the CDPHE's approval of its pretreatment plan. The City is interested in learning more about the SVSD's pretreatment program, how the SVSD intends to intensify its pretreatment efforts as more industries locate within the district, and finally the details of the CDPHE's approval of this pretreatment plan. The proposed increase of wastewater treatment plant capacity is the second aspect of the modifications to the service plan. According to the application, the original service plan was approved for 0.5 MGD with future phases to increase capacity to 1.5 MGD for a population equivalent of 15,000. The current proposal is to provide for treatment capacity in phases. The application includes both low and high projections of when construction of these phases needs to begin "based on known and projected future development" (page 4): 1.5 MGD by 2002, 3 MGD between 2005 and 2012, and 4.5 MGD by 2008 in the high projection. More details about the general location, timing, and number of dwelling units and square feet of non-residential construction that are included in this "known and projected future development" are necessary so that individual jurisdictions can evaluate whether or not they concur that these projections are reasonable. The application anticipates that the phasing of treatment plant improvements eventually will allow treatment capacity to expand to 16.2 MGD (page 6). If municipalities in Weld County will annex property prior to development as the application assumes (page 2), there may be the possibility that these same jurisdictions also will want to provide wastewater service to these annexed areas. The application is silent about this possibility. The City recognizes that certain approvals will be necessary to exclude areas from the SVSD. However, other jurisdictions might be in a better position to provide wastewater service to areas of the SVSD that it does not serve at time of annexation. The City trusts that Weld County will explore this issue with affected municipalities (particularly Erie and Mead) and the SVSD. 2 The application does not address effluent quality and stream standard issues. The City anticipates that these issues will be addressed through the North Front Range Water Quality Planning Association (NFRWQPA) and the CDPHE site application process as the proposed expansions are submitted for review. The application has minimal discussion of biosolids (pages 5 & 6). As the SVSD plant turns into a mechanical plant and keeps expanding, there will be increased need to treat, store and recycle biosolids. The expansion plans need to address what the SVSD intends to do with biosolids in the future. The expanded service area aspect of the modifications includes amendments to the SVSD's Title 32 Service Area. The application indicates that the NFRWQPA is the water quality planning agency for the SVSD (pages 7 &8). There is also an agreement between NFRWQPA and the Denver Regional Council of Governments (DRCOG) for joint review of any overlapping service area issues. Longmont, Erie and parts of North Denver could fall into this situation. As mentioned earlier, the maps sent with the referrals are difficult to read. The application does discuss amendments to the service area just east of Longmont (page 9). Deletions include areas being served by the City of Longmont. Presumably that would include the McLane/Western Annexation, the Mayeda Annexation, and the Sandstone Ranch Annexations. If so, the applicant may want to confirm that the legal descriptions in the application are correct. The City requests that additional areas be removed from the SVSD. They include the N'h Section 6 & all of Section 31 T2N R68W 6PM, and all City-owned properties below the proposed high water line of Union Reservoir in Sections 29 & 30 T3N R68W 6PM and in Sections 32 & 5 in T2N R68W 6PM. The City is willing to meet with SVSD representatives to further discuss these exclusions. The application also indicates adding 480 acres in Section 18. From the map it appears that this addition includes the Sherwood parcels. If so, the City questions the reason for adding this area now prior to land use development approval from either Weld County or the City of Longmont. The application provides information about population equivalents for the district for the years 1985, 1999, and 2000. Population equivalents are based on the number of single family taps added to the other residential and non-residential development wastewater demand translated into single family tap equivalents (page 10). Using this information, the application projects population equivalents through the year 2010. The application assumes a 14.75% annual increase through the year 2005, and a 6.3% annual increase for the years 2006 through 2010. Background information concerning the number of dwelling units and square feet of non- residential development incorporated into these assumptions should help jurisdictions determine how reasonable and conservative these population equivalent estimates are. Also, it does not appear that the 2005 through 2010 estimated wastewater demand (MGD) on page 4 corresponds to the population equivalent estimates on page 10. For example, a 2010 population equivalent of 17,986 would probably be closer to a flow of 1.5 MGD than the 2.5 MGD shown on page 4. 3 Based on feedback that the SVSD and Weld County receive from jurisdictions concerning estimated development activity, the estimate of future assessed valuation in the district might be reviewed in light of this feedback (pages 11 & 12). The storm and surface drainage aspect of the proposed modifications to the service plan are unclear in their effect on the SVSD's authority and implications for jurisdictions that already provide stormwater services and may annex into portions of the area themselves. The application indicates that the SVSD has agreed to participate in the creation of a stormwater management agency to manage storm and surface drainage. Areas the application indicates would be included in this agency encompass areas where private property owners have expressed some interest in undertaking neighborhood planning in preparation for amending the Longmont Area Comprehensive Plan (LACP) to include their property: specifically the proposed Sandstone Neighborhood and the proposed Union Reservoir Neighborhood. The application also references a St. Vrain Stormwater Management Agency Board of Directors. It is not clear what the SVSD is specifically asking for with this amendment in order to assist this new agency that it can not do now. It is not clear what the approvals requested would allow the SVSD to do in the future that are not particularly mentioned in this application, and it is not clear what the implications may be for jurisdictions in Weld County that currently provide stormwater services. The City requests that this information be further detailed before any modification to the service plan is approved for this particular aspect of the request. The City also has some particular comments regarding storm drainage. Any proposed drainage area should not include area tributary to Spring Gulch No. 2 (particularly the Concepts Direct Annexation). The City is in the drainage planning process for Spring Gulch No. 2. Having another organization do the same probably would be a waste of effort. Any development standards should be similar to those that the City has to avoid any design differences. Finally, the City suggests that there be a provision that says that if an area annexes to Longmont, and the City believes that it can best provide the necessary drainage planning and development, that the area would come out of the district or authority and be served by Longmont. Criteria for approval of a service plan amendment are listed on pages 15 & 16. Three criteria stand out for review based on the City's comments: a. There is sufficient existing and projected need for organized service in the amended service area to be serviced by the District. f. Adequate service is not or will not be available to the amended service area through the County, other existing municipal or quasi-municipal corporations, including existing special districts, within a reasonable time on a comparable basis. j. The additional service area as proposed will be in the best interests of the area to be served. The City has raised questions about the future estimates the SVSD has used in its application. We recognize the possibility that referral agencies may not receive a complete application package. However, without more detailed information backing up the growth projections, it is 4 difficult for a referral agency to determine how reasonable they might be. Since the application did not document the alternatives explored and the reasons for their rejection, it also is difficult to conclude that others can not provide adequate service for the areas proposed to be added to the SVSD and that their inclusion is in the best interests of the area to be served. Finally, given the response deadline for this referral, there was not sufficient time to try to resolve some of the City's comments prior to sending them to Weld County. This is being done due to requests of property owners who would like to be served by SVSD and because the SVSD is the logical entity to provide sewer service to these areas. In one specific case, the property is within the City of Dacono and partially within the Dacono Sanitation District service area. The service of that whole property may require an IGA between the entities to accomplish the intended service. The North Front Range Water Quality Planning Association wishes to express support for the IGA that will help to provide the sewer service that appears to be the best alternative for that one property and we also support the SVSD in its efforts to extend service to additional developing properties where their service provides the best solution from a water quality and cost effective perspective. Part'd' of that application deals with stormwater management and has caused some confusion. The Saint Vrain Sanitation District is participating in a group of public entities which has assumed the responsibility of addressing and mitigating the hazards to life, property, and water quality presented by stormwater in an area roughly approximated by the District's CWA Section 208 boundary and the boundary of the Weld County Tri-Area Sanitation District. The District's participation in the stormwater management group obviates the need for Part'd'of the District's application. Therefor, the District asks that the commissioners consider Part'd'of the application as information only; not part of the formal application for service plan amendment.
