SUBJECT: Cockroft Dairy-April 20, 2001 Discharge
In response to a complaint on Friday, April 20, 2001, JoRene Peden and I observed the
Cockroft Dairy. The dairy is located at 27906 WCR 388, Weld County. The complaint
alleged that the facility was discharging process waste water via the southern portion of
an irrigated field.
At approximately 4:20 p.m. Ms. Peden and I arrived at the dairy. We observed that waste
water was flowing from the tail end of a field located on the north side of WCR 388. The
waste water flowed off the field into a ditch. Tailwater ponds did not appear to be present.
The waste water then flowed in the ditch east along WCR 388, then flowed through a
culvert under WCR 388,and was discharging into the South Platte River. We documented
this with several photographs (attached). We collected a sample (results attached) of the
discharge where the waste water was discharging from the culvert. We also documented
the sample location with a photograph.
After we delivered the samples to our laboratory, I called Cockroft Dairy and spoke to Scott
Cockroft. In discussing the complaint, he acknowledged that they were aware of the
discharge but had not immediately stopped the flow. Scott Cockroft said they pump waste
water from the lagoon on the south side of WCR 388 to the field north of WCR 388, where
it runs down the rows. They they were running two irrigation wells and process waste
water from the lagoon to push water through the rows.
The Cockroft's did cease the discharge while we were present on the site. They turned off
the pump at the waste water lagoon.

The Weld County Department of Public Health and Environment has reviewed this
application. We recommend for denial of this application. We would like to point out
that the facility has the potential to comply with all applicable rules and regulations,
however, the location of a facility of this size at this particular location does not make
sense from the stand-point of water quality protection.
Our recommendation for denial is based upon the following:
• The facility is located on the banks of the South Platte River. The waste water
retention structure is located approximately 50 feet from the main channel of the
South Platte River. According to Panel 645 of the Federal Emergency
Management Agency, Flood Insurance Rate Maps' the retention structure is
located in Zone A. Zone A is defined as "Areas of 100-year flood; base
elevations and flood hazard factors are not determined." Given the location of
the retention structure, in relation to the actual location of the river channel, we
question whether flood proofing can be designed to protect the structure from
moving water during floods or other periods of high water. In October 2000,
Loren Cockroft advised our Department that within the past 3 years, on at least
one occasion, the lagoon was washed out during spring run-off.
• The facility is proposing to have the majority of the cattle on 10 acres. Limiting
the area for necessary water quality protection measures. For example, the
facility does not have adequate capacity on the south side of WCR 388 for
process and stormwater collection and storage. As a result, they are proposing
a pump station to move waste water one-half of a mile to the north for storage.
This is a labor intensive process that relies on management and electricity to
assure transport of water. Failure of this system would likely result in a
discharge of wastewater to the South Platte River. EXHIBIT

• The owners and operators of this facility have routinely violated the Confined
Animal Feeding Operations Control (CAFO) Regulations. Our Department has
documented that the facility discharged contaminated waste water directly to the
South Platte River in November 1996, October 2000, and as recently as April
2001. The facility was cited and fined by the Colorado Department of Public
Health and Environment (CDPHE) for the October 2000 discharge. The CDPHE
is currently evaluating the most recent discharge for additional possible action.
The facility has also had other violations of the CAFO Regulations, including
construction of a lagoon, in the flood plain without a liner, and flood irrigation of
waste water without tailwater ponds.
• Due to the necessity of pumping wastewater, to the north, and limited waste
water storage capacity on the south side of the WCR 388, the facility has very
few safeguards in the event of excess water usage, electrical failure,
accumulation of solids in the primary lagoon (reducing the volume of the lagoon),
etc. to prevent future discharges to the South Platte River.
In the event this facility is approved, we recommend that the following conditions be a
part of the USR. We have attempted to simplify our conditions by separating them into
conditions of approval and development standards.
The following are recommended to be conditions of approval:
1. Prior to recording the plat:
A) The facility shall demonstrate compliance with the Confined Animal
Feeding Operations Control (CAFO) Regulations and the additional
requirements outlined below. This shall be demonstrated by submitting a
comprehensive manure and waste water management plan to the Weld
County Department of Public Health and Environment for review and
approval. This plan shall include, but not be limited to the following:
(1) Demonstration that all manure stockpile areas and waste water
collection, conveyance, and retention facilities are adequately sized
and constructed to handle and retain the storm water run-off
generated from a twenty-five year, twenty-four hour storm event.
This shall be conducted by a Registered Professional Engineer .
(2) Demonstration that the existing waste water retention structure has
been constructed with a liner, similar to the liners described in the
CAFO Regulations, that does not exceed a seepage rate of
1/32"/day (1 X 10-6 cm/sec). The demonstration shall be conducted
by a Registered Professional engineer.
(3) Demonstration that any proposed waste water retention structure
will be constructed in accordance with the criteria described in the
Cockroft Dairy

CAFO Regulations. The demonstration shall be conducted by a
Registered Professional engineer.
(4) A site map demonstrating the layout of the site. This should
include the locations of all pens, structures, feed storage areas,
any water courses through the property, manure storage areas,
lagoons, etc.
(5) A surface contour map which demonstrates all surface water
control features on the site. This should include surveyed surface
elevations, indicate flow direction, run-on control features, etc.
(6) Demonstration that the facility has the ability to manage, dispose,
and/or land apply manure and waste water at agronomic rates in
accordance with the CAFO regulations.
(7) Demonstration that adequate measures are in place to prevent any
discharges except those which are allowed by the CAFO
Regulations.
(8) Other necessary measures which are required in order to comply
with the CAFO Regulations.
(6) A description of the types of records that will be maintained on the
facility, as required by the CAFO Regulations.
(7) A detailed design and description of the pump and all associated
equipment that will be used to maintain the southern-most pond to
a liquid level of not more than 1 .5 feet from the design base
elevation of the retention structure.
(8) A detailed design and description of the easily readible depth
gauge that will be permanently attached to the southern-most pond
so that the liquid level of the pond can be easily observed.
9) Evidence that all portions of the facility located in the flood plain are
adequately flood proofed to prevent inundation or removal during
storm events up to and including a 100-year event. This shall be
conducted by a Registered Professional Engineer.
B) In accordance with CAFO, the applicant shall submit the facility's manure
and waste water management plan to the Colorado Department of Public
Health and Environment for review and comment.
C) A dust abatement plan shall be submitted to the Weld County Department
of Public Health and Environment for review and approval.

D) A fly control plan shall be submitted to the Weld County Department of
Public Health and Environment for review and approval.
E) An odor control plan shall be submitted to the Weld County Department of
Public Health and Environment for review and approval.
F) The facility shall rectify the non-compliant septic system serving the
residence located at 30906 WCR 388.
G) All septic systems located on the property shall have appropriate permits
from the Weld County Department of Public Health & Environment.
Environmental Health Division of the Weld County Department of Public
Health & Environment was unable to locate a septic permit for the septic
systems currently serving the milking parlor and the 3 mobile homes
existing on the property. Any existing septic system(s) which is not
currently permitted through the Weld County Department of Public Health
& Environment will require an I.S.D.S. Evaluation prior to the issuance of
the required septic permit(s). In the event the system(s) is found to be
inadequate, the system(s) must be brought into compliance with current
I.S.D.S. regulations.
The following are recommended to be development standards:
1 . Fugitive dust shall be controlled on this site. The facility shall be operated in
accordance with the approved dust abatement plan at all times.
2. All liquid and solid waste shall be stored and removed for final disposal in a
manner that protects against surface and groundwater contamination.
3. There shall be no permanent disposal of solid wastes, as defined in the
Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR
1007-2), at this site.
4. The facility shall maintain compliance with Confined Animal Feeding Operations
Control Regulations (5 CCR 1002-19) and, Section 23-4-710 of the Weld County
Code, as amended.
5. The facility shall adhere to the maximum permissible noise levels allowed in the
Light Industrial Zone as delineated in Section 25-12-103 C.R.S, as amended.
6. Any required NPDES Permit shall be maintained in compliance with the Water
Quality Control Division of the Colorado Department of Public Health &
Environment.
7. The facility shall not discharge run-off or other waste waters to surface or
groundwater with exception to what is allowed by the Confined Animal Feeding

Operations Control Regulations.
8. Wastes materials, not specifically addressed by other development standards,
shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
9. The applicant shall remove, handle, and stockpile manure from the livestock
area in a manner that will prevent nuisance conditions. The manure piles shall
not be allowed to exist or deteriorate to a condition that facilitates excessive
odors, flies, insect pests, or pollutant runoff. The surface beneath the manure
storage areas shall be of materials which are protective of State waters. These
areas shall be constructed to minimize seepage or percolation of manure
contaminated water. In no event shall the facility impact or degrade waters of
the State in violation of the Confined Animal Feeding Operations Control
Regulation (5 CCR 1002-19).
10. The facility shall be operated in accordance with the approved odor abatement
plan. Odors detected off site shall not equal or exceed the level of fifteen-to-one
dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air
Pollution Control Regulations. Additional controls shall be implemented at the
request of the Weld County Department of Public Health and Environment in the
event odor levels detected off site of the facility meet or exceed the level of
fifteen-to-one dilution threshold, or in the judgement of the Weld County Health
Officer, there exists an odor condition requiring abatement.
11. A spillage retention berm shall be required around any fuel container with a
volume greater than 50 gallons. The volume retained by the spillage berm
should be greater than the volume of the largest tank inside the berm.
12. The facility shall be operated in a manner to control flies. The facility shall be
operated in accordance, at all times, with the approved fly control plan.
Additional fly control measures shall be implemented at the request of the Weld
County Department of Public Health and Environment in the event that flies
(which can be determined to be associated with the facility) are in such a number
to be considered a nuisance condition. The plan shall also be implemented in
the event the Weld County Department of Public Health and Environment
receives a significant number of fly (associated with facility) complaints, and in
the judgement of the Weld County Health Officer, there exists a fly condition
requiring abatement.
13. Any septic system located on the property must comply with all provisions of the
Weld County Individual Sewage Disposal System Regulations.
14. There shall be no burning conducted at the site, with exception to burning
defined as "agricultural open burning" as defined by Regulation No. 1 of the
Colorado Air Quality Control Commission Regulations.

15. The facility shall be operated in accordance with the approved manure and
waste water management plan.
16. The southern-most pond shall be equipped with a permanent easily readible
depth gauge so that the liquid level of the pond can be easily observed. The
liquid level shall be maintained at a depth of not more than 1 .5 feet from the
design base elevation of the retention structure.
Also, due to the outstanding zoning violations and the recent violations of the CAFO
Regulations, we recommend that a specific time frame (somewhat less than 180 days)
be applied as to the facility recording its plat and complying with all conditions of
approval and development standards.

The Weld County Public Works Department has reviewed this proposal;this project falls primarily under the purview
of the Use by Special Review Standards. Our comments and requirements are as follows:
COMMENTS:
WCR 388 is designated on the Transportation Plan Map as a collector status road,which requires an 80-foot right-
of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the
required setback is measured from the future right-of-way line.
The most current average daily traffic count reflects 472 vehicles taken in a 24-hour period October 1, 1997.
In the summer of 2001, the Weld County Public Works Department will count all dairies/feedlots within Weld
County. The current list has been submitted from the State/Health Department.
The Weld County Public Works Department has concerns on accesses from one side of the roadway to the other
with slow moving farm equipment.
REQUIREMENTS:
Site Layout: During my site investigation, I had a difficult time in determining the east and west boundaries of the
USR. There are modulars and mobile homes at both ends. It is difficult to determine the dominate fence or property
line. We recommend that the site layout drawing is amended to show the USR boundaries south of WCR 388.
Right-of-Way: The applicant shall reserve an additional 10 feet of right-of-way on both sides of WCR 388 and
parallel for future build out.
Existing Access: This dairy has been in existence since the 1970s. All existing accesses have a purpose for the
operation of the dairy. The structures, pens, feed alleys, and milking parlor are located extremely close to WCR
388, which restricts the existing access points. It has a negative impact of the dairy operation. I recommend that
one main access on the north of WCR 388 to the feed and calf hut operation be limited to only one access point,
minimizing additional accesses to a collector status road.
New Pipeline: The applicant indicated that there will be a pipeline crossing WCR 388 to the proposed waste water
ponds. The applicant shall acquire an utility permit from the Weld County Public Works Department prior to
installing the pipeline across the right-of-way. Please contact Bill Hawkins,Weld County Public Works,at(970)381-

Storm Water Drainage: Any storm water drainage shall be referred to the Department of Health and Environment
as this dairy deals with animal units.
^.irculation: All feed alleys shall be surfaced with gravel and shall be graded to prevent drainage problems.
Off-Street Parking: No off-street parking adjacent to WCR 388 shall be allowed.

Dear Sheri,
I received and reviewed the packet from you concerning the updates to the Cockroft Dairy operation on
Weld Road 388. I have been on the property on many occasions doing routine law enforcement and
made a brief site visit this morning.
-- For years the Cockroft Dairy has had two sewage lagoons located,within the 100 year flood hazard zone
in an overflow channel of the South Platte River. In the 19 years I have had this district, I have seen this
overflow channel inundated by floodwaters on at least two occasions. Additionally, unless the lagoons
are fully lined and the liner is intact there is substantial risk of untreated sewage from the dairy entering
waters of the South Platte by percolation through soils.
As you know,the riparian corridor along the South Platte River is considered very important wildlife
habitat. Low elevation cottonwood-willow, riparian corridors provide essential habitat for a greater
diversity of wildlife than any other habitat type in our state. Mapping efforts by Weld County and the
Division of Wildlife have designated the riparian corridor along the South Platte as High Impact Wildlife
Habitat. Therefore any development in the riparian corridor should be carefully planned to minimize
negative impacts to habitat and wildlife, terrestrial and aquatic, dependent upon it. Water quality is an
important issue along the South Platte. Water quality can adversely impact the site under consideration
•
as well as downstream users. The Division would recommend that whenever possible steps should be
taken that will improve or at the very least maintain water quality in the South Platte Basin. To this end
on this proposal the Division would recommend:
1. That sewage lagoons from agricultural operations not be located in the 100 year flood zone of the
South Platte River. The proposed sewage lagoons,to the north of the dairy should have capacity to
contain predicted peak flows from the dairy.
2. If it is necessary to locate sewage lagoons in the 100 year flood zone they should be diked to a height
that would protect the lagoon from periodic inundation, and the lagoon should be fully lined to
prevent percolation of sewage into groundwaters associated with the riparian system. The lagoon
should be emptied and scraped periodically to remove solids that may be carried downstream in
floods. There should be a system in place to dewater the lagoon if floods are forecast for the River.

3. The South Platte River is a navigable waterway, subject to provisions of the Clean Water Act,
Administered by the U.S. Army Corps of Engineers. Before any excavation occurs in the floodway
involving fill activities or streambank modification, the Army Corps should be consulted and if
necessary an application for a 404 permit should be completed.

Dear Ms. Lockman:
I have received and reviewed Cockroft Dairy's Use by Special Review Permit application, Case
Number USR-1327, for a 1350 head dairy northeast of Kersey. In addition, a site inspection was
made to view the dairy and surrounding properties.
This plan calls for major upgrades to the process wastewater handling system for the existing
dairy. Construction of a new lagoon north of the dairy, and retirement of an existing lagoon will
help them comply with Confined Animal Feeding Operation (CAFO) Regulations. There
appears to be adequate evidence that these regulations have been considered in the planning
phase.
The plan calls for up to 15 employees, which is within industry standards for a dairy of this size.
Weld County Extension has no objection to this proposal. If there are any questions, please do
