RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST DALE AND STARLEE MILLER FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Dale and Starlee Miller, VI #0100004, are allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of October, 2001, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Dale Miller, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until January 8, 2002, to allow adequate time for the property owners
to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0100004 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Dale and Starlee Miller to remedy the violation of the
Weld County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until January 8, 2002, to allow
adequate time for the property owners to bring the subject property into compliance.

metal/iron, tires, trash and miscellaneous debris from all adjacent properties and the public right-of-way.
The Department of Planning also recommends that the County Attorney authorize legal action against any
other persons occupying the properties,any persons claiming an interest in the properties,and any persons
acting in active concert with the identified parties.

Dear Mr. & Mrs. Miller:
The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting
with the Board of County Commissioners on September 11, 2001, at 10:00 a.m., to consider the violations
occurring on the property. The above mentioned property is in violation of the following Section(s) of the
Weld County Code:
Chapter 23,Article Ill,Div 1 "A(Agricultural)Zone District"
Section 23-3.20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30./ "Noncommercial junkyard."
To bring the property into compliance the following option(s) are available:
The"Noncommercial Junkyard"consisting of derelict vehicles,wood,scrap metal/iron,tires,trash and
miscellaneous debris shall be removed or screened from adjacent properties and public-rights-of way.
This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County
Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the violations.
Please also be advised that I will be taking video from the road or adjacent properties the day before the
Violation Hearing (indicated above).
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate
that you were made aware of the nature of the violation including the action necessary to correct the
violation, and that you were given sufficient time to remedy this violation. If you have any questions
concerning this matter, please call me.

The silver van has plates, insurance and is a usable van other than the back tire went flat the other
day. The "truck beds are buildings that are make out of wood and metal,they are under 120
square feet and are sheds. The fence is more closed than any regular junk yard. I did do what you
said I should do last time and now you just come up with more. I really don't think you have any
intention of getting off my case, no matter what I do you will find something to put on your list.
The pictures did not come through but I believe I know what you are talking about.
So I'll see you tuesday and maybe we can find what it is that I'm really suposed to do and not
have something new all of the time.

Subject: Updated Inspection
Please be advised that I did indeed complete an inspection this morning from the road right-of-way and
the following items were noted:
piles of wood, metal, a door, derelict truck beds (white) and the fencing is not yet completed. One side
of the fencing (to the North) is a snow fence, this unfortunately reveals piles of wood and miscellaneous
debris from the road. Additionally, on the South side, the fencing was not totally opaque, thus, allowing
the derelict white truck units to be visible. Also, on the front porch was an apparent book case, coolers, a
vacuum and miscellaneous items. Lastly, the silver van appears to have expired license plates; however,
I am running a DMV check for a correct status. For your convenience, I have included the attached
pictures which were taken this morning.
I apologize that I could not provide happier information, but as far as staff is concerned the
Noncommercial Junkyard is still apparent.

Dear Mr. & Mrs. Miller:
The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting
with the Board of County Commissioners on October 9, 2001, at 10:00 a.m., to consider the violations
occurring on the property. The above mentioned property is in violation of the following Section(s) of the
Weld County Code:
Chapter 23,Article Ill, Div 1 "A(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.1 "Noncommercial junkyard."
To bring the property into compliance the following option(s) are available:
The"Noncommercial Junkyard"consisting of derelict vehicles,wood,scrap metal/iron,tires,trash and
miscellaneous debris shall be removed or screened from adjacent properties and public-rights-of way. Upon an
inspection conducted on September 7,2001,the following items were noted:
-Partial screening is in place: You and I discussed the necessity of the screening to obstruct the view from all
adjacent properties and public right-of-way. Currently not all of the derelict vehicles,metal,wood,trash and
miscellaneous debris are behind this screening;however,it was noted that part of the items have been placed
behind this partial area. Additionally,we specifically discussed that this area needs to be finished so that none
of the items are visible from any adjacent properties or public right-of-way.
-Color: We discussed that as a condition of metal fencing,staff has consistently made a condition of it being
painted in"earth tone color"(such as tan,off-white, brown,beige,etc...)
-Burning: Since it was indeed noted that burning was occurring on the property,specifically during my
inspection,please be advised that this has been forwarded to the Weld County Department of Public Health and
Environment.
Please be advised that if the property is brought into compliance before the above mentioned date,then
this violation hearing date would be vacated; however, the Department of Planning Staff feels that this
allows more than adequate time to bring the property into compliance, based on our previous telephone
conversation.
This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County
Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the violations.

Please also be advised that I will be taking video from the road or adjacent properties for the Board as close
to the hearing date as possible.
The Department of Planning Services'staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate
that you were made aware of the nature of the violation including the action necessary to correct the
violation, and that you were given sufficient time to remedy this violation. If you have any questions
