RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A THERAPIST STUDIO -
JOHN HOT STOUN
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 10th day of October, 1984 , at the hour of 2 : 00
o' clock p.m. in the Chambers of the Board for the purpose of hearing
the application of John Houstoun, 8962 Weld County Road 74 , Windsor,
Colorado 80550 , for a Use by Special Review for a Therapist Studio
on the following described real estate, to-wit:
Part of the NE;, Section 4, Township 6 North ,
Range 67 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County Plan-
ning Commission and all of the exhibits and evidence presented in
this matter, and having been fully informed, finds that this re-
quest shall be approved for the following reasons :
1 . The submitted materials are in compliance with application
requirements of Section 24 . 7 of the Weld County Zoning
Ordinance.
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows :
a. The proposal is consistent with the Comprehensive
Plan and is consistent with the intent of the Agri-
cultural Zone District. The proposal does not
appear to have any adverse impact on the agricultural
interests of the County or the environment.
b. The use is both compatible with existing agricultural
activities and with any future agricultural use as
identified in the Comprehensive Plan.

c. The proposal was reviewed by the City of Windsor
and was found to comply with their long-range
comprehensive plan.
d. No overlay districts affect the site.
e. Use by Special Review Operation and Design Standards
provide adequate protection of the health, safety and
welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application for a
Use by Special Review for a Therapist Studio on the hereinabove
described parcel of land be, and hereby is , granted subject to
the following conditions:
1 . The attached Standards for Use by Special Review be
adopted and placed on the Use by Special Review plat
prior to recording.
2 . The prescribed Use by Special Review activity shall not
occur nor shall any building or electrical permits be
issued on the subject property until the Use by Special
Rev:_ew plat has been delivered to the Department of
Planning Services office and the plat has been recorded
in the office of the Weld County Clerk and Recorder.
The above and foregoing Resolution was , on motion duly made
and seconded , adopted by the following vote on the 10th day of

1. The use permitted shall be a Therapist Studio as described in the
application materials on file with the Department of Planning Services.
2. All construction work done on the property shall be in compliance with
the Weld County Building Code Ordinance.
3. The applicant shall comply with the design standards for the Use by
Special Review, Section 24.5 et seq. , of the Weld County Zoning
Ordinance.
4. The applicant shall comply with the Operation Standards for Uses by
Special Review, Section 24.6 et seq. , of the Weld County Zoning
Ordinance.
5. Representatives or members of the Weld County Health Department and
Weld County Department of Planning Services shall be granted access
onto the site at any reasonable time in order to insure the operations
carried out on the site comply with the Operation Standards stated
hereon and all applicable Weld County Regulations.
6. The Use by Special Review area shall be limited to the plans shown
hereon and governed by the Standards as stated above and all applicable
Weld County Regulations. Any material deviations from the plans and/or
Standards as shown or stated above shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and the
Board of County Commissioners before such changes from the plans and/or
Standards are permitted. Any other changes shall be filed in the
office of the Department of Planning Services.
7. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Standards.
Noncompliance with any of the above stated Standards may he reason for
revocation of the Permit by the Board of County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice dated September 24, 1984, and duly
published in the La Salle Leader on September 27, 1984, a public hearing was
conducted to consider the application of John Houstoun for a Use by Special
Review for a therapist. studio. Bruce Barker, Assistant County Attorney, read
this application into the record. Rod Allison, Planning Department representa-
tive, read the favorable recommendation of the Planning Commission into the
record and stated that seven Operation Standards have been proposed for this
Use by Special Review. John Houstoun, the applicant, came forward to answer
questions of the Board. He stated that he has operated for three years in the
City of Greeley. Commissioner Johnson moved to approve this Use by Special
Review for John Houstoun, based on the Planning Commission's recommendation.
Commissioner Brantner seconded the motion and it carried with a unanimous vote.

were informed the proper zoning for this area should be Commercial Three.
Therefore, they submitted an application for a change of zone. It is his
feeling the Commercial-Three zoning actually represents the businesses
that are here more accurately.
The Chairman asked Mr. Stookesberry if he had reviewed the recommendations
and conditions as set forth by the Department of Planning Services staff.
He stated he has no objections to anything as outlined.
The Chairman called for discussion from the audience. There was none.
Rod Allison explained the city of Greeley's no position stand on this
request.
The Chairman asked that reading of the Department of Planning Services
staff Comments and the Conditions as outlined by the staff be dispensed
with and that they be filed with the summary as a permanent record of
these proceedings.
MOTION:
Paulette Weaver moved Case Number Z-409:84:10 for E.S.I. Corporation, which

Commissioners with the Planning Commission's recommendation for approval

APPEARANCE:
John Houstcun, property owner and applicant, stated this request is to
upgrade a building that is approximately eighteen feet by eighteen feet
which is located on their property. He is a licensed Massage Therapist
and he cDnsults with his clients in this building. It is also used as
a guestroom for friends and relatives. This building has been used for
these purposes for the past two years. He would like to upgrade the
building with new siding, roof, windows, and remodel the interior.
There is not a kitchen in this building and it cannot be considered
an additional residence.

The Chairman called for discussion from the audience. Howard Smith, a
surrounding property owner, stated he has no objections to this request
providing there will not be an increase in traffic.
The Chairman asked Mr. Houstoun if he had reviewed the recommendations,
conditions , and operation standards as outlined by the Department of
Planning Services staff. He stated he had and has no objections to any-
thing as stated.
The Chairman asked that reading of the Department of Planning Services

II. We propose to use this building as a guest room for visiting family
members and friends; as a quite place for me to read and study as I
continue my education; and as a quiet place to meet with clients. We need
to use this room in the above mentioned capacity as both of our families
are from out of state; as we have three children, ages four, five and six,
who can become quite boisterous at times which makes it difficult to
maintain my concentration on necessary areas of study when in the main
house. We estimate the maximum number of users, other than myself for
study puposes, to be eight guests per year, mostly family members„

the City of Greeley (see attached copy) and currently work with Natural
Therapeutics and at the Greeley Country Club. I also work at Healthworks
in Fort Collins and have worked at the Jewish Community Center in Denver.
I work with my clients one at a time and each appointment lasts from one
to 1 1 /2 hours. It is more advantageous for some clients to come to our
house to receive their treatment. I neither advertise nor solicit from
the general populace. All of my clients are referred to me by word of
mouth. I estimate 75% of my clients come to me for stress reduction and
management. I also work with professional athelets, sports-related
injuries, general traumas and physically handicapped persons.
The number of clients I meet with presently is one to three per week. I
plan to attend school in Boulder within two years, for a one year period,
during which time I will need to use the room for study and writing a
minimum of twenty hours per week. Upon completion of my studies and
graduation from school, I project the maximum number of clients to be four
to eight per week.
Our four acres is used for residential purposes while the surrounding area
is farmed and used for irrigational storage. All of the distances in
relation to our residence is portrayed on the plot plan. The water supply
to our residence and the building is treated water from North Weld County
Water District. Our sewage is handled by a one thousand gallon septic
tank with a five-hundred square foot leach field as per county code and
regulation. The access to our building is a gravel driveway as shown on
the map; all vehicles are standard passenger automobiles. We are located
within the Windsor-Severance Fire Protection District which maintains a
very high standard of quality for the community. The removal of trash is
in fifty gallon drums hauled to the dump once a month. All landscaping is
existing and the areas around our building are sodded.
III. We are consistent with the Weld County Comprehensive Plan and have
absolutely no impact or detriment to the agricultural and irrigational
activities around us. The building has existed at its present site for at
least fifteen years. We exempted and purchased the acreage with all
buildings in October of 1978 with the intention of residing here forever.
We are not in Winsor's ten year plan nor in any known projected plans of
Weld County. The building has been upgraded and made safer by conforming
with present day codes. The water supply is from North Weld County Water
District, which is more than adequate for quantity, quality and
dependabil".ty, all soil reports are on the vicinity map and the
surrounding property owners are listed on the accompaning forms.
