Section 2.1 of Ord. 195 (Code section 19-2-40)says that"development" is "any land use requiring regulatory approval by the elected governing body . . ." I understand that the site plan is not"approved by the elected governing body." So, technically, I think its not development as that term is defined in the agreement. It seems to me, however, that if the site plan is the first step of a process that will evenually include consideration by the "elected governing body,"that we should treat the site plan application like development and subject to the terms of the agreement. It appears that the bed is under the asphalt lot and the trenches that were exposed have no gravel in them. The existing tank appears to be usable. An ISDS is not allowed to be covered with asphalt so the existing system does not meet Weld County Regulations. I recommend that a new system be designed and constructed to provide sanitary service for the site. If the system is designed for 16 employees, one shift per day, the bed will be approximately 500 to 800 square feet depending on the percolation test. This type of bed can be constructed for about $3.00 per square foot. The percolation-test and design will cost approximately $800.00 to $1,000. This estimate is conditioned on getting perc rates between 20 and 45 minutes per inch. If the rates are higher the square footage and cost will go up. In that this site may very well be annexed to the City of Dacono in the future the City desires various issues be addressed now consistent with Dacono's Standards. These include landscaping, roadway, utilities, fire flow, drainage and encroachment items. Numerous meetings have been held with Dacono officials by the Applicant and their agents and representatives, and preliminary designs were submitted to Dacono and Weld County for comment on August 1°'. No written response has been received at this date. The Applicant respects and is sensitive the City's issues. Nonetheless, this SPR Proceeding is currently within the County's jurisdiction and within a county approved subdivision. The Applicant has diligently addressed and pursued resolution of those items following. The Panoram Circle roadway designs reflect those eventualities. — Traffic: The Weld County Department of Public Works and the City of Dacono have requested a Traffic Impact Study in and about the Panoram Industrial Park Subdivision and said Study was submitted to both entities on July 5t. Written response and/or acceptance was specifically requested by the undersigned. At this date, no written acknowledgment has been received. Mr. Bruce Roscoe, the City's contract engineer did advise the undersigned via telephone conversation that the Traffic submittals were okay. (See enclosed Traffic Impact Study prepared by W. L. Contractors dated May, 2001 and associated correspondence.) This SPR Application generates minimal incremental traffic volumes and future traffic counts are difficult to project or anticipate. Nonetheless, the Applicant has striven to make realistic future projections and expects such traffic will not exceed five(5)times the volumes within this SPR Application. All roadway designs including corner radii and road surfacing cross sections have factored-in these ultimate traffic projections. — Annexation: The City of Dacono has requested the Applicant annex to the City at its future request. The Applicant is willing to do so, and respectfully requests Weld County approve this Site Plan Review in order to allow the Applicant the ability to develop a functional, operational facility as soon as possible under the Mr. Robert Anderson, Planner Department of Planning Services August 22, 2001 Page 4 prevailing and applicable Weld County Site Plan Review processes. Please note in any future annexation proceeding, the City still has the opportunity to address then pertinent issues and concerns under their jurisdiction. — Water Supply/Fire Protection: The Applicant realizes the existing Central Weld County Water District's(CWCWD)infrastructure is inadequate to provide sufficient fire flow capacity for the construction planned under this SPR. The Applicant has,therefore, contracted with CWCWD for extension of new 12" and 24" lines from Highway 52 to service the site(see attached contract and correspondence). That extension is slated for installation very shortly. Drexel,Barrell& Company have designed an ultimate water distribution system within the Subdivision. Appropriate site specific hydrants and distribution have also been designed. All designs have been preliminarily reviewed by CWCWD,by Mountain View Fire Protection District and by the City of Dacono's engineering firm. The water system design is a phased plan and the Applicant is willing to collateralize future phases via an Improvements Agreement. A draft of said Agreement is hereby requested of Weld County for review and execution by the Applicant. — Drainage: A extensive Drainage Report was prepared by Kenneth N. Armfield, P.E. on December 8, 2000 and included in the original SPR Submittals. That report has been reviewed and enhanced by Drexel, Barrell& Company, and a new drainageway designed paralleling the south right-of-way line of Weld County Road 12. This drainageway, associated culverts and on-site detention ponds and easements insure storm water runoff will not exceed historic flows from the undeveloped site and are designed to release retained water at a rate not to exceed applicable standards. Nonetheless,the City of Dacono's engineer has expressed concerns regarding downstream storm water runoff, both immediately west of the site and along Weld County Road 12, downstream and west/northwest of the site. The Applicant has initiated good faith efforts and contacts with the property owner(St. Vrain Block/Dan Ryan) regarding same. St. Vrain Block does not perceive a current or future problem and is,therefore, reluctant to address the issue at this time. The Applicant has neither the power nor authority to address basin-wide or downstream issues and is in compliance with applicable runoff, detention and Mr. Robert Anderson, Planner Department of Planning Services August 22, 2001 Page 5 release criteria. Further, the involved governmental jurisdictions have a future opportunity to address broad drainage concerns at such time as other property owners might initiate annexation, zoning, subdivision or Site Plan Review proceedings affecting the involved downstream(and upstream) lands. — Railroad Spur Easement: The Panoram Industrial Park Subdivision(Reception No. 01879792)indicates a 40'R.R. Spur Easement on and across Lots 7 and 8 , Block 1 and Lot 7,Block 2 within this SPR. The City of Dacono's referral letter of January 25, 2001 requests the Applicant secure written confirmation and acceptance to allow encroachment into the easement. The Applicant has researched the genesis and history of the easement and has contacted and requested of Union Pacific a relinquishment of any rights they may possess. Union Pacific feels they have no land rights regarding the easement and are reluctant to execute any documents regarding the easement (see attached correspondence). The Applicant believes this issue has been vigorously pursued and that no problems exist regarding the easement that may affect this SPR. — Sewer: No public sewer system exists within 400 feet of the site. The Applicant agrees to connect to such a system when any portion of the site is within 400 feet of a sewer line that has capacity to serve the property. ► 1.E: Mountain View Fire Protection District's referral letter of January 11, 2001 has been addressed. Drexel, Barrell& Company have designed water lines and hydrants and the Applicant has secured an adequate supply source from CWCWD to meet or exceed requirements of the 1997 Uniform Fire Code for Type II-N construction. The undersigned and Mr. Cliff Brockman with Drexel, Barrel(& Company met with Mountain View on August 1"and have revised designs according to their recommendations. ► 2.A: See enclosed Landscape Plan and 1.A.9 and 1.B.1-4 foregoing. ► 2.B: The existing septic system has been reviewed by Ken Rollin, P.E. (see enclosed correspondence of July 5, 2001). In that portions of the existing system do not , meet Weld County regulations, an appropriately engineered/re-engineered system will be designed, permitted and constructed. Whenever a single product is specified in the Contract Documents by a reference to the name, trade name, make or catalog number of any manufacturer or supplier, the intent is not to limit competition, but to establish a standard of quality which the Landscape Architect has determined is necessary for the project. Substitutions are acceptable as long the quality of the product is deemed comparable. 1.03: Qualifications of Contractor: Contractors are asked to have available if requested, references and documentation showing proven experience in special construction and similar projects of equal or greater capacities of this nature and complexity. Failure to provide such information if requested , will be basis for rejection of proposal. 1.04: Subcontractors: All bidders are advised that any person, firm or other party to whom is proposed to award a subcontract under this Contract must be acceptable to the Owner , Owner Representative and or Landscape Architect. The Owner Representative reserves the right to reject any Subcontractor prior to final award of contract. 1.05: Work Covered by Contract Documents Work under this contract includes all materials, equipment, and labor, necessary to complete the work indicated on the drawings, described in the Specifications or reasonably inferred. Please note : Phase #1 and Phase #2 aspects of improvements are required to be bid separately. 1.06: Time of Completion: Bidders must commence work within 10 days from date of award of contract and complete the work within timeframe deemed necessary by Owner Representative. 1.07: Cleaning: The Contractor shall keep the premises free from all surplus materials, waste materials, rubbish caused by his employees or work and at the completion of his work he shall remove such surplus materials, waste materials, dirt and rubbish, as well as all his tools, trailers, and equipment and shall leave his work clean and spotless, unless more exact requirements are specified. In the case of a dispute, the Owner Representative or General Contractor shall remove all such items and charge the cost of such removal to the contractor. 1.08: Warranties: The Contractor and each subcontractor shall remedy any defects due to faulty materials or workmanship and pay for any damage to other work resulting therefrom, which shall appear in his work within a period of one year from the date of Acceptance by Owner or Owner Representative. The Owner Representative or Owner shall give notice of observed defects with reasonable promptness. The contractor shall respond to warranty issue within a reasonable timeframe, not exceeding 30 days beyond notice of warranty issue. 1.09: Bid Phase #1 separate from Phase #2 Due to the development of the infrastucture on County Road #12, this bid includes provisions for phasing. Bidders are responsible for reviewing Drawings and Specifications for each phase, see attached contract plan documents. After the development, enlargement and paving operations of County Road #12, installation of Phase #2 may commence. 1.10: Project Record Documents: Maintain at job site, one copy of : Contract Drawings, Specifications, addenda, Change Orders, Other Modifications to Contract, As built drawings. Maintain documents in a clean, dry legible condition and do not use record documents for construction purposes. Make documents available at all times for inspection by Owner, Owner Representative and or Landscape Architect. Label each document "Project Record". Record drawing information in colored pencils with different colors for various systems and defined by a color legend. Submit all record drawings to Owner or Landscape Architect at the completion of the project. 1.11 Coordination: The Contractor shall be responsible for coordinating all the work specified under "Landscape Contract". The Contractor shall coordinate the efforts of their subcontractors and the deliveries of suppliers so that the work progresses in an orderly fashion without delays towards timely completion of a complete project in accordance with the drawings and specifications. SECTION 2.00: Demolition, Preservation, Earthwork & Grading 2.01: Demolition: A.) The landscape Contractor is required to physically remove all weeds and native vegetation in the planting areas and beds prior to the construction of the berms and areas deemed for new vegetation . Native vegetation and weeds shall be removed by tilling to a depth of 8-12" and physically removing all weed roots and grass stock in accordance with Industry standards. B.) Preservation: It is requested that all existing tree and shrub stock to remain per plan, be protected with plastic contruction fencing: 2" diameter mesh by 4' height. This construction fencing shall be placed around the drip lines of all trees and shrubs, staked in place, to prevent equipment and traffic from compacting root system and affecting the overall health of the vegetation. Upon completion of heavy construction and equipment use, fencing may be removed, trees and shrubs shall be pruned of all damaged or injured branches. 2.02: Earthwork & Grading A.) The existing grade is within about 4" of final grade not including construction of landscape berm areas. Contractor is required to shape berm areas in an aesthetically pleasing manner. It is requested that berm surfaces not exceed a 3 to 1 slope. 2.03: Cleaning: Maintain continuous cleaning operations throughout the duration of Work. Dispose of, off site at no additional cost to the Owner, all trash and debris generated by installation of the landscape and demolition of any plant materials proposed for removal or any debris left from pruning operations. SECTION 3.00: SOIL PREPARATION 3.01: Description: 1.) Provide soil preparation for the following areas: A.) Tree and shub planting areas. B.)Over seeded areas affected by construction staging and mobilization c.) Installation of new low grow seed bed areas. 3.02: Delivery, storage and Handling: 1.) Take adequate measures to control offensive odors caused by delivery, storage, stockpiling and spreading of soil amendment. Stockpile material at "on site" location. Avoid stockpiling soil amendments for more than seven consecutive days prior to spreading. Incorporate material into ground as soon as possible. 3.03: Materials 1.) Soil amendments (plant mix) shall be composed of 50% Premium 3 and 50% screened topsoil. Upon receipt of CSU soils test results, additional soil supplements may be necessary based on mineral content. This information will be issued through an addendum if necessary. The organic material shall have 90% or greater organic content. This mixture shall be free from clay subsoil, stones, lumps, clogs, plants and their roots, sticks, weed stolen and seeds, high salt content and other materials harmful to plant life. Recommended supplier of this product is A-1 Organics, Eaton Facility : Phone # 800-776-1644. Other materials and supplier are acceptable however organic content must equal at least 90%. 2.) The Contractor shall supply to Owner Representative the following information: If alternate soil amendment product is utilized: soil test results showing mixture composition an analysis. 3.) Provide Owner Representative with delivery tickets on materials to verify quantities delivered to site. 3.04: Fertilizers: A.) Tree and Shrub planting pits: provide 50% premium 3 compost well mixed with 50% of the excavated backfill. Slow release agriform tablets are required B.)Low Grow Seed Areas: Provide Azo-kote amendment at a rate of 1 pound per 100 pounds of seed mix. Integrate fertilizer starter (18-46-0) at a rate of 1 pound per 2000 square feet. Local supplier is Arkansas Valley Seed at 303- 320-7500. 3.05: Planting Tree and shrub stock:see attached details A.) Finish grading and preparation of the planting areas shall be achieved by fine grading until the surface is smooth, friable and of a uniform fine texture and compaction having no lumps or stones over (2) inch in diameter. No planting shall be installed on any area which has not been rough graded. Obtain the Owner's or Landscape Architect's acceptance of prepared areas prior to proceeding. B.) Prepare planting holes with 50% excavated backfill and 50% Premium 3 compost C.) Fertilizer: Slow release Agriform tablets (20-10-5) Apply at a rate of 4/tree, 2/shrub and 1/1 gallon container. 3.06: Planting Low Grow Dry land Seed area A.) Spread organic matter : soil prep. material at a rate of (1.25) cubic yards per 1000 square feet. B.) Mix seed with Azo-kote and ferilizer mixture C.) Evenly apply and immediately incorporate materials into the grade by means of a harrow or other approved method to a depth of(3-4") inches. D.) Drill seed as specified below and topdress with topsoil at a rate of .66 cubic yard of topsoil per 1000 square feet. Finish grading until the surface is generally smooth, having no lumps or stones over (3) inch in diameter. 3.07: Guarantee: Upon completion of soil preparation work, the Contractor shall guarantee against settlement for one full year after final acceptance. Any correction required to meet this specification, including repair/replacement of seed, sod or plant material shall be at Contractor expense. SECTION 4.00 SEEDING & HYDROMULCHING 4.01: Materials & Execution Seed: All seed shall be furnished in bags or containers clearly labeled to show the name and address of supplier, the seed name, the lot number, the percent of weed seed content and the guaranteed percentage of purity and germination. The seed shall have a minimum germination and a minimum purity of (85) percent. Seed shall not exceed 1% weed content by weight. Seed shall be drilled in areas damaged due to construction. Soil tilth is critical in areas of compaction prior to drilling of seed. 1.) Low Grow Dryland Mixture: shall be composed of 30% Crested Wheat grass, 20% SR3200 Blue Fescue, 25% Dwarf Perennial Rye grass, 15% Canada Bluegrass & 10% Chewing Fescue. Seeding rate shall be 1.50 pounds per 2000 square feet. Seed Mixture is known as "Low Grow Mix" and is available through Arkansas Valley Seed Company, phone #: (303-320-7500). 2.) All seed beds shall be hydromulched. Mulch shall be wood cellulose fiber for hydraulic mulching. Aspen fiber mulch shall not be allowed. Mulch shall be died an appropriate color to allow visual metering of its application. The mulch material shall be supplied in packages having a gross weight not in excess of 100 pounds and shall be marked by the manufacturer to showthe air dry weight content. Ten percent (10%) of the wood cellulose fiber mulch shall be applied with the seed. The remaining (90%) percent shall be applied with the tackifier no later than 24 hours after completion of the seeding. The mulch shall be applied by hydraulic method at the rate of (2000) lbs/acre. 3.) Tackifier : shall be "M Binder", R-2400 organic tackifier or acceptable equal. Tackifier shall be applied at a rate of (100lbs) per acre. Local supplier is Bowman Construction: (303-696-8960) 4.) Erosion Control Netting or Soil Guard: Drainage Easement: Within the confines of the 35' drainage easement, along the East boundary of the property, where slopes equal to or exceed a 3 to 1 ratio, Soil Guard Hydromulching product or Excelsior Erosion Control netting is required on these specified slopes. Either product is available through Bowman Construction Products (303-696-8960) and is intended to hold the bank while the seed establishes. 4.02 : Warranty: For a period of 1 year after final acceptance of seeding at no additional cost to the Owner, the Contractor is to reseed any dead, diseased seed in an unhealthy condition. Inadequate or improper maintenance by the Owner shall not be cause for replacement, provided that the Contractor has submitted a bimonthly report of inadequate or improper maintenance. SECTION 5.00: PLANTING 5.01: Work Included , Quality Assurance and Plant Qualifications A.) Furnish all plant material, backfill material, trees, shrubs, ground cover, mulch, labor, equipment, and non plant materials required to complete installation of planting as indicated on the drawings. B.) Plant materials shall be inspected by Owner and or Landscape Architect at the growing site and tagged or otherwise approved for delivery. C.) Plant material shall have a habit of growth that is normal for the species and shall be of sound health, vigorous growth and free from insect pests, diseases, and injuries. All plants shall equal or exceed the measurements specified in the Plant Lists, which are minimum acceptable sizes. Requirements for the measurement, branching, grading, balling, and burlap ping of plants shall equal or exceed the code of standards currently recommended by the American Association of Nurserymen. Collected stock is not permitted. D.) Substitutions will not be permitted without the written approval of Owner or Landscape Architect. E.) Protection after delivery: The balls of burlapped plants which cannot be planted immediately on delivery shall be covered with moist soil or mulch. Shade and protect plants in outside storage areas from wind and direct sunlight. All plants shall be watered as necessary until planted. Plants remain the property of the Contractor until final acceptance by Owner. F.) Planting operations shall be conducted under favorable weather conditions. No planting shall take place after November 15 without written permission of Landscape Architect or Owner Representative 5.02: Prepared Plant Backfill & Staking , Guying and Wrapping: see detail. A.) Prepared plant backfill shall consist of excavated soil and premium 3 compost in the following proportions : 50% Premium 3 Compost well mixed with 50% excavated backfill. B.) Staking , Guying and Wrapping, Mulching: For installation of up to 3" caliper deciduous trees and 8-9' height evergreen trees, See attached detail. For trees in excess of this caliper size: Duck bill #66 with turn buckle shall be utilized. # 66 may also be utilized for evergreen trees in excess of 9' height. 1.) Wire guys #10412 gauge 2.) Grommeted Green nylon straps 1 1/2" wide. 3.) Treated Lodge pole Post : minimum of 6' in height. 4.) Tree wrapping materials shall be first quality 4" wide, bituminous impregnated tape, crepe paper, brown in color, specifically manufactured for tree wrapping and having qualities to resist insect infestation. 5.) Guy wire signals shall be either surveyor flagging or 1/2" diameter white PVC, length 8" /guy wire. 6.) Trees shall be supported immediately after planting. All trees shall be guyed and wrapped as detailed. 5.03: Setting Trees and Shrubs: See detail 1.) Unless otherwise specified, all plants shall be planted in pits to such a depth that the finished grade of the plant after settlement is at least 2-3" above the grade of the surrounding planting area. 2.) Trees and Shrubs shall be planted upright and faced to give the best appearance or relationship to adjacent areas. 3.) Excavation of planting pit shall be done in accordance with Tree, Evergreen and Shrub Planting details. Please refer to the insert for planting hole depth and width and other specifications. A.) For container grown stock: Remove the container to prevent damage to plant or root system. Cut root ball vertically in two to three places with a sharp knife before planting. B.) Balled and Burlap Stock: Backfill with prepared soil mixture amendment to approximately half the depth of the ball and then tamp material. Carefully remove excess burlap and upper 2/3 of wire basket and all of the twine. Tamp and complete backfill, place mulch and water. 4.) Compact the backfill planting soil by puddling with water to eliminate air pockets as necessary and allow it to soak away. After the ground settles, additional soil shall be filled in to the level of the finished grade. 6.) Mulch shall be placed evenly in tree wells as noted on the drawings to a minimum depth of 3". 5.04: Warranty Period and Replacements: 1.) The warranty period for nursery grown shrub, container and tree stock will be for (1) one calendar year from Acceptance of planting installation by Owner and or Landscape Architect. 2.) At no additional cost to the Owner, the Contractor shall replace any trees or plant stock that is dead or in the opinion of the Owner or Landscape Architect is in unhealthy or unsightly condition. Inadequate or improper maintenance by the Owner shall not be cause for replacement, provided the Contractor has submitted throughout the warranty period a bimonthly letter of report to the Owner on improper or inadequate maintenance practices. 3.) All replacement planting is to be executed within 30 days of notice to replace. 4.) Replacement of planting is to be in accordance with the original specifications and its cost included in the bid price. All areas damaged by tree or shrub planting or replacement operations are to be restored to original condition. SECTION 6.00: FINISHES 1.) Work included in this section entails landscape edger, installation of organic cedar mulch, weed barrier and stone mulch. 6.01 : Landscape Edger 1.) Edging : Uniformly edge beds of individual planting areas per drawing. Provide a clear cut division line between planted area and adjacent seed or mulch. Form bed shapes as indicated. Utilize Green Pro, Ryerson, or approved equal of edger which is painted steel. Staking of edger shall occur 3 stakes/ 10' of edger. 6.02: Mulching: Organic 1.) Provide a minimum of 3" of cedar mulch in all tree well in seed and rock mulch areas and other areas indicated on plan. Keep mulch off of sidewalks, driveways and parking areas. 6.03: Mulch: Stone & Weed Barrier Provide a minimum of 2.5" of 3/4-1.5" washed stone mulch in all areas as specified on plan. Mulch shall be placed over Mirifi 140 sn fabric weed barrier. I L NTs• Section 8.00: MAINTENANCE 8.01: General Scope of Work: Through the use of qualified, trained personnel and by using the practices and methods recognized and accepted as standards by the landscape industry, the appointed Maintenance Supervisor will provide plant care, chemical pest control, manual irrigation to all plant materials, monitoring and any other maintenance specified herein . Due to the available labor force with Firebaugh Precast and the downtime which is sometimes incurred with this business, Firebaugh may utilize some of their labor force in maintaining the grounds. Labor activities will be directly supervised by an industry trained professional that acts as a Supervisor for Firebaugh. The maintenance shall be on -going and replacement of plant stock which is not thriving will be executed. 8.02: Mowing; Due to the specified "Low Grow seed mix", seeded areas will not exceed 12" in height. Should annual weed growth be prevalent in the first seeded season, mowing can occur on an "as requested" basis. Monitoring of areas shall be overseen by the Maintenance Supervisor. 8.03: Trash, Debris: All landscape areas will be policed and checked in conjunction with other maintenance operations for loose trash and debris. Trash pick up will occur on a weekly basis. 8.04: Weed Control: All native seed areas will be monitored and sprayed for noxious weeds such as Canadian Thistle and Bind weed. This task shall be provided for on a monthly basis Broadleaf sprays shall be handled on a curative basis rather than a preventative basis. Pre-emergent weed control is also acceptable when needed for specifically early spring weeds. 8.05: Bed Care: All bed areas will be checked on a regular basis for mulch coverage. If additional mulch is needed: this is to brought to the attention of the Owner Representative and final consent given prior to proceeding. Every effort shall be made to control grasses and bind weed growing directly in shrub beds and tree wells. After the second season following the installation of the plant materials, it is recommended that vegetation be put on a fertilization schedule. 8.06: Tree and Shrub Care: Maintenance Supervisor will monitor on a regular basis, the health of all plant material and make necessary recommendations to the Owner or Owner Representative with respect to such items as : Fertilization, insect and disease control, etc.. Maintenance Supervisor shall be responsible for pruning of all trees and shrubs on the open space of the subdivision property. Plants shall be pruned in accordance with regularly accepted industry standards for Pruning. Pruning is done to promote healthy growth, prevent weak or abnormal limb structure, control unwanted leggy growth, and maintain the natural growth habit of the plant. A grass free area (mulch ring 3' in diameter) shall be maintained around the circumference of all trees planted in native seed areas. When necessary: tree rings shall be remulched in an effort to maintain moisture in the plant and prevent the introduction of native weed and thistle. Due to the variables and unpredictable nature of insects and disease problems, trees and shrubs shall be sprayed on an " as needed" basis. Most sprays shall be done on a curative basis , however Supervisor may elect to treat potential problems on a preventative basis. 8.07: Watering and Plant irrigation: The existing 2" water meter located on Block #1, lot#1 shall be utilized for hand watering of vegetation along County Road #12. This meter is located just due east of the seconary fire access road or what is now Firebaugh's temporary access. Hand watering of vegetation in close proximity to the office building shall utilize hose bibs off of the office building A.) The newly seeded areas shall be irrigated on a bi weekly basis until seed beds are established. Once established: this drought tolerant low grow seed will not exceed a 12: height, unless irrigated on a regular basis, which is not the desire. B.) Tree and Shrub bed shall be irrigated with a deep root needle on a weekly basis depending on cultivars of vegetation. Gallon age requirements and seasonal demand shall be provided as a guideline for the manual hand water activity. 8.08: Winter Service: All landscape areas shall be policed for trash and debris on a weekly basis. The Supervisor shall monitor the site for trash and debris and shall inspect all landscape and plant materials. Winter watering shall be the responsibility of the Landscape Supervisor and is expected to be performed at a minimum on a monthly basis during drought periods. Maintenance Supervisor shall also be responsible for the collection and removal of fall leaf drop. Leaf Removal in heavy concentrations is strongly suggested in the native seed areas. Pruning and Tree Wrapping are also considered the responsibility of the maintenance Supervisor. The traffic impact seta&should include analysis of projected 2020 traffic conditions with and without site trat97c for intersection and for roadway level of service. The projected traffic for this development repmsents only 12%of the traffic on the adjacent roadway. As additional land develops and the background traffic increases, the percentage of traffic on the roadways from this development decreases. This development will not cause an impact on the existing roadway system and will be an even smaller percentage of the roadway traffic in the future. The Level of Service is determined by analyzing peak hours. The development is projected to generate 7 trips in the AM peak hour and 6 trips in the PM peak hour. The analysis showed that these trips will not degrade the level of service on Weld County Road 12 when the site is constructed. Seven trips in the AM peak period and 6 trips in the PM peak hour will also not affect the Level of Service in any future year. The north side of Weld County Road 12 is undeveloped in the area, The driveways on the south side of Weld County Road 12 are widely spaced and typical of rural gravel roadways. There will be no conflicts with adjacent driveways. The site is between Weld County Road 11 and Weld County Road 13. Them is sufficient distance between the access and the intersections that the access will not impact either intersection. 4. Trip generation projections seem adequate for 13 employees. Are 15 employees the maximum number ofemployees required with full development of the site. Firebaugh Precast estimates 15 employees at the site. S. Describe the number of gravel trucks required on a daily basis to supply the concrete plant for the precast operation. The site will take access from the road. In order to document the traffic on Weld County Road 12,traffic counts were taken by WL Contractors on March 6, 2001. ' Weld County Road 12 is a two lane gravel roadway in the area of the development. ' The traffic count indicated that there were approximately 350 vehicles per Iday on Weld County Road 12. The traffic is evenly split with 180 vehicles eastbound and 172 vehicles westbound. Site Generated Traffic Access to the site is along what is Panoram Circle in the Panoram IIndustrial Park Subdivision. A secondary access will be provided for emergency access only. Thus all traffic to and from the site will enter and Iexit onto Weld County Road 12. ' Firebaugh Precast also operates similar facilities in Colorado Springs. From their experience at their other facilities, they estimate 15 employees Iand 9 hauls per day. This would equate to approximately 48 trips per day. IThe Institute of Transportation Engineers Trip Generation—6th Edition is I used to predict the number of trips that a development would generate. A General Light Industrial use (Land Use#110) in the Trip Generation I manual is predicted to generate 3.02 trips per employee. That equates to 45 trips per day. Regarding traffic issues surrounding the SPR,Ms. Houghtaling in a meeting with the undersigned on February 14, 2001,recommended a traffic engineer be retained by the Applicant to analyze said traffic impacts. Subsequently, J. W. Engineering was hired to commence the traffic analysis. On March 6, 2001, J. W. Engineering performed a volume and classification count on WCR 12 between WCR 11 and 13, some 100±feet east of the existing Firebaugh driveway. These counts suggest WCR 12,which is within the City of Dacono,is currently at 180 daily vehicles eastbound and 172 vehicles westbound. Apparently total counts of over 200 vehicles per day represent a "threshold." Firebaugh projected impacts total less than 50 trips per day. On March 27,2001,1 again met with Ms. Houghtaling advising her of the results of the survey. In that meeting she advised that since WCR 12 was within Dacono that Dacono would have jurisdiction regarding traffic impacts of the Firebaugh Site Plan Review. As a result, enclosed herewith are Traffic Counts as surveyed by J. W. Engineering. It is respectfully requested the City of Dacono advise as to appropriate next steps in order to expedite final approval and resolution of traffic impacts attendant with this Site Plan Review. After a lengthy discussion, I believe a reasonable and appropriate resolution was achieved: — Since the subdivision will not be fully built-out on all lots and since Site Plan Review is required for all construction, it will not be necessary to install hydrants in Panoram Circle at 300' intervals at this time. — 3000 gpm fire flow will be required to serve Firebaugh's Phase I building(s), assuming Type II N construction with no sprinkler systems. — Dead end feed within Panoram Circle is okay, as long as flow velocities do not exceed 10 ft./second. Cliff will recheck the flow calculations and possibly a 10" line will be required instead of an 8". — Three on-site hydrants will be required initially with a site interior loop necessary. Terracon/Road Section: • I asked Cliff/Drexel to review the Terracon Report and provide an opinion regarding same and to specifically address whether a gravel only road section can be used, at least for an interim period both technically and from an economic perspective. Drainage: • I asked Cliff/Drexel to call Bruce Roscoe regarding drainage concerns. Cliff's thoughts are that Firebaugh doesn't have the power or authority to address basin-wide or downstream issues and any problems with the Block Plant are really the City of Dacono's to address. Also, I advised Cliff that the triangle in the southwest corner of Weld County Road 12 and 13 intersection does not drain westward and is, therefore, not an issue regarding drainage along Weld County Road 12. Cliff mentioned looking at the site in the field and reviewing his and Dan Burroughs' calculations. If additional work is required, Drexel will need a change order. Title investigations and conversations with the Union Pacific Railroad do not indicate any documented land rights to this easement. It appears to have simply been designated on the plat as an easement for a potential, future railroad spur connecting with the Union Pacific Railroad mainline that existed east of the Subdivision at the time of platting in 1981. Since that time the easement has been built over by Stresscon,by the Applicant's predecessors, and by utilities, the Union Pacific has removed all mainline trackage near the Subdivision and the Union Pacific has sold its right-of-way to others (William Stonebraker, the Town of Firestone and City of Dacono). Further the Block Plant located to the west of the Subject Site has constructed a building immediately west of and over the westerly extension, projected, of the platted Spur Easement. It appears the Spur Easement was simply designated on the plat in accommodation of any potential future USER desirous of railroad service in the Subdivision. Conversations in January 2000 with a Union Pacific land representative (Jack Nelson - Omaha District) indicate Union Pacific has no record of conveyance by the plat to Union Pacific nor any record of a specific grant by the original owner to the Union Pacific. In other words, Union Mr. Robert Anderson Planner Department of Planning Services Weld County, Colorado January 21, 2001 Page 2 Pacific, the only railroad even in the area,whose trackage is now at least 1-1/2±miles from the Subdivision, has no rights or interest in the spur. Recent contact on January 15, 2001, with the Union Pacific Railroad again affirms that the Union Pacific feels they have no surface land rights relative to the subject easement. The Union Pacific is, therefore, reluctant to even address the issue and not receptive of executing a quit claim deed. It is highly unlikely a future USER would desire rail service or even could reasonably get rail service any place near the Subdivision. Again, no title search indicate any rail rights within the Subdivision. The Applicant, therefore, proposes building over the easement. The original Union Pacific rail line served, among other entities, the Graden Mine in Section 12, T1N, R68W. That mine was abandoned in 1955. The rail line continue northward past the west side of Dacono,Frederick, and Firestone and onward to Greeley. Over the years, trackage has been removed and much of the right-of-way purchased in fee from the Union Pacific Railroad by others, including adjacent property owners and by the Towns. The trackage terminates some 12+ miles north of the Panoram Site near the Fort Saint Vrain Power Plant. Union Pacific's closest current ownership terminates near the south line of Section 13, TIN, R68W, some 1-1/2±miles south of Panoram. Further, the St. Vrain Valley Open Lands and Trails Project under the auspices of Weld County and in concert with Colorado Open Lands, Tri-Towns, Great Outdoors Colorado, Boulder County,Longmont, Erie, and the CSU Cooperative Extension have targeted the old Union Pacific right-of-way as a portion of a regional trail system, come 30 miles in length. (See enclosed Farmer& Miner article dated August 23, 2000.) It, therefore, appears highly unlikely any resumption of rail service adjacent to the Panoram Industrial Park Subdivision can or will occur in the future. I have been in conversation with Mr. Lee Morrison, Assistant Weld County Attorney, regarding possible means to address resolution of the spur easement shown on the Panoram Industrial Park Subdivision Plat. His suggestion is to document within the Site Plan Review file the circumstances surrounding the situation and the logic behind allowing the easement to remain on the Plat. An ISDS is not allowed to be covered with asphalt so the existing system does not meet Weld County Regulations. I recommend that a new system be designed and constructed to provide sanitary service for the site. N If the system is designed for 16 employees, one shift per day, the bed will be approximately 500 to 800 square feet depending on the percolation test. This type of bed can be constructed for about $3.00 per square foot. The percolation-test and design will cost approximately $800.00 to $1,000. This estimate is conditioned on getting perc rates between 20 and 45 minutes per inch. If the rates are higher the square footage and cost will go up. The location of the proposed fire hydrants arc satisfactory as shown on the plans. With regard to the fire hydrant installation, I have the following comments: • The type of fire hydrant and the installation of the fire hydrant, waterlines, thrust blocks and valves, etc. shall be in accordance with requirements of the Central Weld Water District. • Fire hydrants shall be installed such that the hydrant connections arc at least 18 inches above grade and no more than 36 inches above grade • If ground cover and shrubbery is desired around fire hydrants for aesthetic purposes, the ground cover and shrubbery may not exceed 4 inches height. • If the fire hydrant is not set back at least three feet from a curb that is at least six inches high, then the hydrant must be protected by bollards. Bollards should be at least Schedule 40 steel pipes, at least 3 inches in diameter,set three feet in concrete and filled with concrete. Bollards should be located so as not to obstruct hydrant outlets. Should any changes be made to approved plans, additional comment and review by the Fire District will be necessary. We have the following comments: General 1. The proposed dead-end water lines should be looped. 2. Mt. View Fire Protection District will need to approve these plans. 3. City of Dacono criteria requires three (3) valves at all water line tees, and four (4) valves at crosses. It would appear that, if the 354 L.F. section of water line in front of the Phase I building went out of service, all water to buildings would be lost. In general, the rule is to locate valves so that only one hydrant will go out of service at a time in the event of a line break. 4. The three 42-inch culverts are'shown too low in the profile on page 4 of 6. The invert out of 36.00 could not daylight until somewhere north of the oil storage tanks according to the existing contours. 5. The report is adequate. It should be noted that county criteria allows releasing at historic rates from the detention ponds, while City of Dacono criteria requires that the rates be based on soil types as per UD&FCD. We have allowed this procedure in the past. 2. While it does not meet City of Dacono criteria, the report does comply with generally accepted engineering practice. Recommendation • We recommend that the submittal be revised and resubmitted. This review is for general conformance with City of Dacono criteria, and does not relieve the applicant of complying with any specific regulation as may be required by a representative of the City. Does the seventeen acres complete the development of the industrial park? If additional lots remain to be developed then trips from those lots should be included in the access volumes? The additional lots are not included in this development and at this time the land is planned to remain vacant. Thus no additional trips will be added to the projected traffic. 2. The traffic impact study should include analysts of projected 2020 traffic conditions with and without site traffic for intersection and for roadway level of service. The projected traffic for this development represents only 12%of the traffic on the adjacent roadway. As additional land develops and the background traffic increases, the percentage of traffic on the roadways from this development decreases. This development will not cause an impact on the existing roadway system and will be an even smaller percentage of the roadway traffic in the future. The Level of Service is determined by analyzing peak hours. The development is projected to generate 7 trips in the AM peak hour and 6 trips in the PM peak hour. The analysis showed that these trips will not degrade the level of service on Weld County Road 12 when the site is constructed. Seven trips in the AM peak period and 6 trips in the PM peak hour will also not affect the Level of Service in any future year. Describe access sight distance conditions and distances to adjacent intersections and access locations. There are no restrictions to site distance at the proposed access. The north side of Weld County Road 12 is undeveloped in the area. The driveways on the south side of Weld County Road 12 are widely spaced and typical of rural gravel roadways. There will be no conflicts with adjacent driveways. The site is between Weld County Road 11 and Weld County Road 13. Them is sufficient distance between the access and the intersections that the access will not impact either intersection. 4. Trip generation projections seem adequate for 13 employees. Are 15 employees S maximum number of employees required with full development of the site. Firebaugh Precast estimates 15 employees at the site. 5. Describe the number of gravel trucks required on a daily basis to supply the concrete plant for the precast operation. The number ofgravel trucks per day plus precast loads per day plus employee trips will be used to determine pavement design for WCRl2.
