HomeMy WebLinkAbout20013348.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST ROGER AND RENATE CLARK FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Roger and Renate Clark, VI #0100212, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of December, 2001, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Roger and Renate Clark, property owners, were present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until June 11, 2002, to allow adequate time for the property owners to screen the noncommercial junkyard, complete the construction of the double-wide modular home and demolish two mobile homes. Additionally, the 2 (two) mobile homes without permits shall be removed, permitted or demolished. The above mentioned property is in violation of the following Section(s)of the Weld County Code: Chapter 23,Article In, Div 1 "A(Agricultural)Zone District" Section 23-3-20 "Uses allowed by right." Section 23-3-20.P "Mobile home subject to the additional requirements of Article IV, Division 3 of this Chapter." Section 23-3-30 "Accessory uses." Section 23-3-30.1 "Noncommercial junkyard." To bring the property into compliance the following option(s)are available: The"Noncommercial Junkyard"consisting of derelict vehicles shall be removed or screened from all adjacent property owners and public rights-of-way. During my last inspection conducted on August 15,2001,a couple of derelict vehicles appeared to be located outside of the screened area. Please maintain them completely behind the screened area. Additionally,the screened area does need to be taller. The vehicles should not be visible from the road right-of-way or any adjacent properties. Lastly, I apologize for misunderstanding you during our previous visit regarding the mobile homes. As we discussed during your last visit(08/14/01),mobile homes are not allowed as storage units in Weld County. Currently it appears that there are 3 mobile homes and 1 modular unit. You have already indicated that the 2(two) mobile homes will be removed or demolished as soon as possible(we gave you some ideas to assist in this endeavor). As soon as you obtain a building permit for the modular unit,the mobile home that you are currently living in will need to be converted to a"Temporary During Construction". As soon as your modular unit is finished and you receive your "Certificate of Occupancy",you will have 30 days to completely remove the last remaining mobile home(that you were living in while the modular was being constructed). Please also be advised,that if all of the above mentioned items have been addressed prior to December 10, 2001,this case will be dosed. This meeting will take place in the County Commissioners' Hearing Room, First Floor,Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance to answer any questions the Board of County Commissioners might have about the violations. Please also be advised that I will be taking video from the road or adjacent properties the business day before or as soon as possible to the above mentioned Violation Hearing date. Additionally, Ms. Clark had asked me if their fence would need to be a little taller. The fence was indeed to short in its current condition. We discussed what would need to be done to bring the property into compliance. I told them that we had 2 (two) concerns. 1.) The mobile homes. 2.)NCJY (consisting of derelict vehicles). They stated that they have 1 double wide and 3 single wides. The double wide is going to be their principle dwelling unit. They are going to then demolish the single wide that they are currently living in. They stated that the other 2 (two) mobile homes would be for storage until they get the double wide done. They said that all of the single wide mobile homes would be removed as soon as the double wide is completed. As for the NCJY (derelict vehicles), they stated that they do indeed have a couple of vehicles that they are slowly repairing. I told him that they could have a NCJY in the AG zone so long as they were completely screened from all adjacent properties and public rights-of-ways. I told them that I would send a 30 day letter giving them 30 days to complete and submit all applications and move the NCJY behind screening. I gave them 3 mobile home building permits and 2 zoning permits. The 2 zoning and 2 of the mobile home building permits would be for the Storage of the 2 mobile homes (single wides) and the other Building Permit for a mobile home would be for the addition of the double wide and they would need another building permit when it was time to demolish the old single wide. 08/13/2001 By: BJS Action: OFVS Comments: Ms. Clark came to the office. She was discussing the case with myself and Kim Ogle, Planner On-Call. She indicated that she wanted the mobile homes to be storage structures not just storing the mobile homes on the property. I explained that if that was indeed the case that they would not need a new Zoning Permit for a Mobile Home at all. She asked me to call her if the weeds were indeed too tall.
