COLD HEARINGS ON A series of public hearings to receive testimony on proposed rules PROPOSED RULES and regulations implementing the Reclamation Reform Act of 1982 has FOR 1982 been announced by Commissioner of Reclamation Robert N. Broadbent. Representa- tives from the Corps of Engineers and the consultant team will be on hand to review the Systemwide EIS process and to answer questions. This is the first public meeting to be held on the West Slope. The following topics will be reviewed: - the Systemwide EIS Final Work Plan - the project schedule and progress - development of the water demand model for the Denver metropolitan area - how West Slope impacts and concerns are being handled in the EIS process - coordination with the Metropolitan Water Roundtable - Green Mountain and Wolford Mountain alternatives - the public involvement process. WATER CONGRESS The Colorado Water Congress will publish a complete book this month 1983 STATE LAWS containing all water and water related laws of the first regular OF INTEREST TO session of the fifty-fourth General Assembly. Since this book will WATER USERS be several hundred pages in length and paper, printing, postage and labor are significant costs, the price of the book is $50 (CWC mem- bers) and $100 (non-members). Furthermore, since there will be only fifty copies of this book available, distribution will be governed in order of requests. CWC SEMINAR The Colorado Water Congress will offer on four consecutive Fridays in ON COLORADO July (8th, 15th, 22nd and 29th) the "Second Annual Seminar on Colorado WATER LAW Water Law. " The class will be limited to thirty individuals (23 paid registrants and 7 scholarships). The first 23 individuals who pay or guarantee their registration will constitute the class. The paid registrants will be joined by the seven scholarship recipients who will be selected from members of the state legislature and Congressional staff members. The registration fee will be $250 for Colorado Water Congress members and $400 for non-members of CWC. Assistant Secretary of the Army for Civil SECTION 404 Works, has announced that proposed revisions to regulations dealing REGULATORY REFORM with the Crops of Engineers' regulatory program under Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act were published in the Federal R.<lister on May 12, 1983. "The proposed regulations," fir. Gianelli i said, "do not sugg:t ehangg to the scope of jurisdiction of the program. Instead, they clarify this by assembling the definitions of previously scattered terms dealing with jurisdiction into a special section of the regulations where they can be more easily referenced." He further sated, "The changes strengthen our policy of respecting the decisions of state and local governments and reinforce the authority of the Corps to issue general permits in a manner to avo d duplicating the reviews and decisions of other agencies." WATER QUALITY Ray Reeb of Loveland has resigned from the Colorado Water Quality COMMISSION Control Commission. Reeb's term was due to expire on February 15, RESIGNATION 1985. A replacement for Reeb will probably be appointed by the Gov- ernor after the Legislature adjourns -- so that means that the re- placement will not be subject to Senate confirmation until January or February of 1984. FEDERAL The U.S, Senate Environment and Punic Works' Water Resources Subcommittee COST hopes to ho'd a secono hearing on fderal cost shari n' policy on June 15, SHARING 1983. Last time, none of the Administration's invited witnesses appeared to testify. However, an Administration decision on the cost sharing issue isa,: reportedly been reached, which will be announced by the June I5th hearing. The Cabinet Council on Natural Resources and the Environment was supposed to meet on the metter June 2nd, (Source Western State Water Newsletter of June 3, 1983. ) NATIONAL WILDLIFE The Colorado Water Congress on May 25 moved to intervene on the FEDERATION V. side of the Army Corps of Engineers in a lawsuit brought by the MARSH ("404") National Wildlife Federation and fifteen other environmental groups, including the }Sierra Club, Natural Resources Defense Council , Environmental Defense Fund, and National Audubon Society. The Water Congress seeks to defend new Corps' regulations which are meant to implement some of the reforms to the section 404 dredge and fill permit program sponsored by Senator Hart in 1977. Chief among the 1.977 Clean Water Act reforms was an expanded use of general permits, and exemptions for irrigation ditches and farming and ranching operations. The complaint, filed in Washington D.C. against Secretary of the Army Marsh, accuses WATER INTELLIGENCE REPORT -5- June 6, 1983 Senator Hart, the Corps, and EPA of seeking to unlawfully expand the irrigation ditch • exemption. In particular, the environmental groups complain that the term "irriga- tion facilities" used in the new regulations is broader than the term "irrigation ditch" found in the statute. The Water Congress has pointed out in its intervention papers that use of the broader term is appropriate. An agricultural ditch necessarily includes facilities by which water is diverted from the stream for irrigation. These diversion structures, so integral to operation of the ditch for its purpose, are often washed out or damaged by high water in May or June, just when the irrigation season is about to begin. Congress intended that the shorth; .nd reference to 'kiitch" would relieve agricultural water users from the burden of obtaining individual 404 permits each time construction or repair of an irrigation ditch and its associated facilities is required. The Water Congress intervention papers state the "CWC represents numerous irrigations districts, ditch companies, ranchers, farmers, and•other irrigating indi- viduals and entities who have a substantial and critical interest. in upholding the challenged regulation to ensure that they will not need to obtain a 404 permit to construct or make repairs to their headgates, wingwalls or other irrigation facili- ties each spring. CWC also has a considerable interest in general permit issues as they affect irrigation facilities and practices," In order for the Colorado Water Congress (CWC) to intervene in NWF v. Marsh, CHIC needs to raise $50,000 for the suit. To date, CWC with remendous assistance from the Colorado Cattlemen's .Associa- tion has raised $29,275. The city and county of Denver seat is currently held by David W. Robbins of Denver and it is expected that he will he reappointed. Like- wise, it is generally expected that Dale F. Grant of Basalt will be reappointed to the main Colorado drainage basin seat. However, in the case of the Yampa-White drain- age basin seat, it is known that veteran Board member John R. Fetcher of Steamboat Village has withdrawn his name from consideration; thus, the way is clear for a new appointment from that drainage basin to CWCB, At the present time, there are six candidates. for the Yampa-White seat and they are: Wiley i3erthelson of Meeker, Jim Gann of Steamboat Springs, Terry Reedy of Slater, David Smith of Meeker, Joe Sullivan of Meeker and Lynn Whiteman of Meeker. In terms of water legislation, it appears that the Colorado Water Congress (CWC) enjoyed a fairly successful session. Twenty-two of the 25 bills supported by CWC have passed both houses of the Legislature ( sixteen of the 22 have already been signed by the Governor). Twelve bills were opposed by CWC and all 12 were postponed in- definitely (killed). Significant water bills passed are: SB 90 (Water Right Determination & Admini- stration Act of 1969 - Amendments thereto); SB 303 (Water Quality - Discharge Permit Fees) -- this bill is complemented with a $316,000 general fund appropriation in the „Long Bill (SB 401)"; HB 1104 (Treatment of Water Rights for Property Tax Purposes); H8 1255 (Tabulation of Water Rights); HB 1272 (Validation & Re-Creation of Water Conservancy Districts); HB 1310 (Colorado Ground Water Management Act); HB 1416 (Dam Safety); and HB 1567 (Diversion of Waters Outside Colorado). The following finance items are enclosed: (1) Colorado Water Congress Financial Statements and Supplementary Information for year ended December 31, 1982 with Accountant's Review Report; (2) financial statement as of April 30, 1983; (3) delinquent CWC membership status as of June 8, 1983; (4) CWC 1983 membership list by geographical areas; (5) CWC new member summary sheet; (6) CWC new member detailed sheets; and (7) financial statement for 1983 CWC 25th Annual Convention. All of the aforementioned financial items are enclosed and identified as appendix C. In passing, the following informa- tion is provided on CWC's carryover situation: 12-31-79 -- (-$6,242) ; 12-31-80 -- $3,147; 12-31-81 -- $17,735; and 12-31-82 -- $44,106. The M&B Committee has authorized the director to seek and negotiate "expanded space" at such time as space might become available in the 1390 Logan Street Office Building. At the end of May, the director was successful in negotiating additional space from the Colorado Public Expenditures Council (CPEC). This "new space" is next to the director's present office -- so it makes it fairly easy to enter from the existing CWC office. Incidentally, the additional monthly office rent would be $98.25 with the expanded office space. Action Necessary: Approve or Disapprove Expanding CWC office. Norris: May 16, 1983 Executive Director Colorado Water Congress Dear Dick: Resignation from the Board of Directors It is with regret that I submit this letter of resignation to the Colorado Water Congress. I have enjoyed serving on the Board of Directors for the past two terms and am confident that the Staff and Board of the Water Congress will continue to provide the quality leadership that they have provided in the past. With the other activities I am currently involved in, I am unable to spend the time working on Water Congress matters that a position on this Board deserves. I am, however, looking forward to a continuing friendship with members of the Staff and Board of Directors. Very truly yours, Kenneth E. Norris CWC Board Agenda June 18, 1983 Page Four The following provisions of the CWC Restated Articles of Incorporation on Board vacancies are setforth below: Article VI , Section 5. In case of death, resignation, or inability to act of any officer of the Colorado Water Congress, the Board of Directors shall desig- nate a successor to such officer. In the event of such vacancy in the office of President, the Vice-President shall act i- his place pending the filling of such vacancy as herein provided. In case of the death , resignation, or inability to act of any member of the Board of Directors, a successor to such member of the Board shall be designated as provided in Article IV Section 5. Article IV, Section 5. The term of a director not present in person or by proper written proxy for two consecutive board meetings shall be terminated automatically and the Board of Directors shall appoint another person from the same division until the division organization elects a replacement to serve the remainder of the term. National Wildlife Federation v. Marsh ("404"). The CWC Board of Directors by postcard ballot approved intervention of the Water Congress in NWF v. Marsh. Also, for your information, we are enclosing the following as appendix D: (1) letter from Mr. Sayre dated 3/1/83; (2) letter from Mr. Sayre dated 5/18/83; and (3) a list of contributors to CWC's efforts in the lawsuit. Also, it is sincerely hoped that all members of the Board can attend and participate in the workshop -- as you can appreciate, Board members will be better able to participate in the discussions on the workshop recommendations if they are in attendance at same. Enclosed as appendix F are the following: (1) 1982-83 CWC State & Federal Priorities; (2) 1982-83 CWC Resolutions; (3) 1981-82 NWRA Resolutions; and (4) Position Statements Supportive of NWRA Resolutions.
