RE: DIRECTING CLERK TO THE BOARD TO HAVE PUBLISHED A NOTICE OF INTENT
TO DESIGNATE THE SITE SELECTION AND CONSTRUCTION OF THOSE MAJOR
FACILITIES OF A PUBLIC UTILITY CONSISTING OF TRANSMISSION LINES,
POWER PLANTS, AND SUBSTATIONS OF ELECTRICAL UTILITIES AS A MATTER
OF STATE INTEREST, PURSUANT TO C.R.S. § 24-65.1-401, AND SETTING OF A
PUBLIC HEARING REGARDING SUCH DESIGNATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to C.R.S. § 24-65.1-401, the Board of County Commissioners has
the authority to designate those activities listed in C.R.S. § 24-65.1-203 as "matters of state
interest,"which may then be subject to guidelines and regulations promulgated by the Board,
pursuant to C.R.S. § 24-65.1-402, and
WHEREAS, the Board desires to conduct a public hearing on May 16, 2001, to consider
the designation of the site selection and construction of those major facilities of a public utility
consisting of transmission lines, power plants, and substations of electrical utilities as a matter
of state interest including, in the term public utility, those entities which build operate or maintain
transmission lines, power plants, and substations of electrical utilities regardless of whether
they are subject to the jurisdiction of the Colorado Public Utility Commission, and
WHEREAS, pursuant to C.R.S. § 24-65.1-404(2)(a), the Board is required to publish
notice of said public hearing in a newspaper of general circulation in Weld County at least thirty
(30) days and not more than sixty (60) days prior thereto, with a copy of such notice being sent
to the Colorado Land Use Commission within the same time frame.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Clerk to the Board be, and hereby is, directed to have
published in the County Newspaper on April 11, 2001, notice that the Board intends to
designate the site selection and construction of those major facilities of a public utility consisting
of transmission lines, power plants, and substations of electrical utilities as a matter of state
interest, pursuant to C.R.S. § 24-65.1-401.
BE IT FURTHER RESOLVED by the Board that a public hearing to consider such
designation be, and hereby is, set for May 16, 2001, at 9:00 a.m., in the Board's First Floor
Meeting Room, 915 10th Street, Greeley, Colorado.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby
is, further directed to include in the notice of intent to designate the above stated information
regarding the date, time and place of said public hearing and directed to send a copy of the
notice to the Colorado Land Use Commission no later than April 16, 2001.
