Approved with Conditions The Weld County Department of Planning Services has determined through an administrative review that the standards of Section 24-8-40.8.1 through 24-8-40.B.6 of the Weld County Code have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of Weld County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat: /A: The plat shall be titled: Recorded Exemption No. 0961-10-1 RE-3197. )3'. The applicant shall submit to the Weld County Department of Planning Services evidence that any existing septic system meets all requirements of the Weld County Department of Public Health and Environment. The Weld County Department of Public Health and Environment was unable to locate a septic permit for the septic system located on the parcel. Any existing septic ©0/—3057 system which is currently not permitted through the Weld County Department of Public Health and Environment will require an I.S.D.S. evaluation prior to the issuance of the required septic permits. In the event the system is found to be inadequate, the system must be brought into compliance with current I.S.D.S. regulations. C.l Lot A shall use the existing residential access point as no additional accesses shall be granted. W. Lot B shall use the existing agricultural /oil and gas /ditch road access points necessary for agricultural operations as no additional accesses shall be granted. E. All approved accesses shall be clearly shown on the plat.The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access point. If a drainage culvert is required, a 15-inch Corrugated Metal Pipe(CMP) is Weld County's minimum size. If the applicant chooses to place a larger culvert please contact the Weld County Department of Public Works to adequately size the culvert. F. East 16'Street and Fern Avenue are designated on the Weld County Transportation Plan Map as local paved roads, which require 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way.A total of 30 feet from the centerline of East 161h Street and Fern Avenue shall be delineated right-of-way on the plat. These roads are maintained by Weld County. G. Topographic or physical features of the proposed Lot, such as ravines, ditches, streams etc. may limit the area available for a new or replacement septic system. Prior to recording the plat the Weld County Department of Public Health and Environment recommends that the applicant review the Weld County Code pertaining to septic systems to assure that any installed septic system will comply with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to allow the installation of a septic system the lot may need to be enlarged. The Department of Public Health and Environment recommends the applicant set aside an area for a septic system replacement envelope for Lot A. The applicant shall attempt to address the requirements (concerns)of the City of Greeley, as stated in the referral response received10/3/01. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. I/ The applicant shall attempt to address the requirements(concerns)of the Greeley-Weld County Airport, as stated in the referral response dated 9/18/01. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. ,k The applicant shall attempt to address the requirements (concerns)of the West Greeley Soils Conservation District,as stated in the referral response received10/3/01. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. Lot A shall comply with the one (1)acre minimum lot size required by Section 24-8-80.E of the Weld County Code. L. The applicant shall provide the Weld County Department of Planning Services with a certificate from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. M. The following notes shall be placed on the plat: 71 All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure as defined and limited to those occupancies listed as Groups A, B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld County Code. 2'/ Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Exemption number. 4,) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lot B has an adequate water supply of sufficient quality, quantity and dependability. 5) Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code. ,61 Prior to the release of building permits on Lot B, the Lot owner shall verify with the nearest Town/City or Sanitation District to determine the location of the nearest sewer line. In accordance with the Weld County Code, if a sewer line exists within 400 feet of the property and the sewer provider is willing to serve the proposed structure, a septic permit cannot be granted by the Weld County Department of Public Health and Environment. 7) All construction or improvements occurring in the flood plain as delineated on Federal Emergency Management Agency FIRM Community Panel Map 080266 0637 C dated September 28, 1982, shall comply with the Flood Hazard Overlay District requirements of Section 23-5, Division 3 of the Weld County Code. 8) The installation of any septic system within the 100-year flood plain shall comply with the Weld County I.S.D.S.flood plain policy.In accordance with the State of Colorado I.S.D.S. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens,field work,harvest,and gravel roads;odors from animal confinement,silage,and manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 3. Location, Size, & Present Use of Area The property is located in Greeley on Fern Avenue and East 16th Street situated within the Northeast Quarter of Section 10, Township 5 North, Range 65 West of the 6th P.M., the land is approximately 100.0 acres in size. The land is currently used for pasture ground for the few horses present on the site. Several buildings exist on the property, including a single-family residence, old storage barns and corrals. Northwest of the site is a large mining operation. The Poudre River travels through the Northeast corner of the site. To the South and East of the site are several small single family dwellings. 6. Unique Physical Characteristics There is a mining operation to the Northwest of the property; the Poudre River travels through a portion of the property. 7. Setback and Offset Statement All proposed structures are to meet the minimum setback and offset requirements as regulated within the Agricultural Zone District. 8. Conservation Easement Statement The owners do not wish to place a conservation easement on their property at this time. There are no conservation easements currently placed on the property. 9. Building Envelope Statement The applicant does not wish to plan a building envelope on the property at this time due to the size of Lot A and that Lot B will not be used for residential purposes. However, at the County's request a building envelope will be designated on the final plat before recording. 10. Weld County Comprehensive Plan Consistency This proposal conforms to the Comprehensive Plan and is consistent with Chapter 22 of the Weld County Code. With this Recorded Exemption a single dwelling will be established within its own lot. This will leave approximately 98.8 acres of land open and available for agricultural uses. This proposal will not subtract agricultural land from the county. The building present at the site will meld with the surroundings, because there are several similar residences that have been established by these same means. This development is consistent with the surrounding design. It will not take away from agricultural productivity, and it will leave established farming and irrigation activities intact. 11. Compatibility with Surrounding Land Uses The proposed residential/agricultural use of this property coincides with the surrounding land use in the area. Mining currently takes place directly to the Northwest, similar single family dwellings occupy portions of land near the mining operation that are similar to the situation of this proposal. It is believed that this proposal will create only land uses that are compatible with the surrounding area. 12. Consistency with Intent of District This proposal will not interfere with agricultural work, production or activities in the surrounding area; therefore it is consistent with the Agricultural Districts intent. 13. Consistency with Efficient and Orderly Development This proposal safeguards the interest of the public with a new development that does not take away from the natural beauty of the county, in addition with the safety of fire and rescue, and the conveniences of utilities, such as public water supply, electric and telephone. It will not hinder any of the surrounding farming operations by keeping existing irrigation for the needs of the existing farms and ranches and preserving all of the surrounding farm producers. We feel this proposal will be consistent with efficient and orderly development as defined in the Weld County Subdivision Ordinance, Section 13 and Chapters 22 and 23 of the Weld County Code. 14. Summary Overall, it is felt that this land division is appropriate. The attempt to split of the ± 1.2-acre parcel of ground is consistent with Weld County's intent; it will not interfere with irrigation and farm practices in the area.
