Approved with Conditions
The Weld County Department of Planning Services has determined through an administrative review that
the standards of Section 24-8-40.B.1 through 24-8-40.B.6 of the Weld County Code have been met. This
Recorded Exemption is approved with the following conditions in accordance with information submitted in
the application and the policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. The plat shall be titled: Recorded Exemption No. 0805-30-2 RE-3181.

/Z. In accordance with Chapter 8, Article II of the Weld County Code, Lot B shall be granted one
residential access. Direct access from a public road shall be limited to one access per legal
parcel for residential use,no circle drives or additional accesses shall be granted.The road shall
be graded and drained to provide all weather access. Accesses shall be placed in such a
location as to have adequate sight distance in both directions, shall not be placed below the
crest of a hill or where physical obstructions are present.
Lot A shall use the existing residential access point as no additional accesses shall be granted.
E. All approved accesses shall be clearly shown on the plat.The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required, a 15-inch Corrugated Metal Pipe (CMP) is Weld
County's minimum size. If the applicant chooses to place a larger culvert please contact the
Weld County Department of Public Works to adequately size the culvert.
7( Weld County Road 25 is designated on the Windsor Area Capacity Improvements Needs Study
as a local paved road, which requires 60 feet of right-of-way at full build out.There is presently
60 feet of right-of-way. A total of 30 feet from the centerline of Weld County Road 25 shall be
delineated right-of-way on the plat. This road is maintained by Weld County.
jdK Weld County Road 64.5 is designated on the Windsor Area Capacity Improvements Needs
Study as a collector status road, which requires 80 feet of right-of-way at full build out. There
is presently 60 feet of right-of-way.A total of 40 feet from the centerline of Weld County Road
64.5 shall be delineated on the plat as right-of-way reservation for future expansion ofWeld
County Road 64.5. This road is maintained by Weld County.
The applicant shall attempt to address the requirements(concerns)of the Windsor Severance
Fire Protection District, as stated in the referral response received 9/7/01. Evidence of such
shall be submitted in writing to the Weld County Department of Planning Services.l0I.
The applicant shall provide the Weld County Department of Planning Services with a certificate
from the Weld County Treasurer showing no delinquent taxes exist for the original parcel.
J. The following notes shall be placed on the plat:
iri All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
* No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code,shall be constructed
within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead.
Any construction within a 200-foot radius of any tank battery or 150-foot radius of any
wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld
County Code.
/X1 Any future structures or uses on site must obtain the appropriate zoning and building
permits.
3)/ Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Exemption number.
All Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that the Lot has an adequate water supply of sufficient
quality, quantity and dependability.
yShould noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
APrior to the release of building permits, the Lot owner shall verify with the nearest
Town/City or Sanitation District to determine the location of the nearest sewer line. In
accordance with the Weld County Code, if a sewer line exists within 400 feet of the
property and the sewer provider is willing to serve the proposed structure, a septic
permit cannot be granted by the Weld County Department of Public Health and
Environment.
/ ' WELD COUNTY'S RIGHT TO FARM. Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area:
open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens,field work,harvest,and gravel roads;odors from animal confinement,silage,and
manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening
the efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not
provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions are of the lowest
priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient that urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of
the farmer's livelihood. Parents are responsible for their children.
3. The applicant shall submit a Mylar plat to the Weld County Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in
accordance with the requirements of Section 24-8-70 of the Weld County Code. The plat shall be
submitted within sixty(60)days from the date of approval by the Weld County Department of Planning
Services. The applicant shall be responsible for paying the recording fee.
4. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to the
Weld County Board of County Commissioners with a staff recommendation for denial.

RECORDED EXEMPTION QUESTIONNAIRE
ITEMS REQUIRED FOR SUBMITTAL
1. Water supply statements addressing the following:
a. Domestic use. The statement will include evidence that a water supply of sufficient
quality, quantity and dependability will be available to serve all proposed lots. A letter
from a water district, municipality, or a well permit are examples of evidence for
domestic use.
North Weld County Water District has sufficient quality, quantity and dependability to
serve the two proposed lots. They are currently serving Lot A and are willing to serve
Lot B, as evidence in the enclosed letter.
b. Irrigation water. The statement will include the type and quantity of irrigation water to
the site, whether irrigation water has been removed from the site and, if so, when.
There are currently 3 '/z shares of the Whitney ditch that irrigate the total 35-acre parcel.
These shares will be divided among Lot A and B in 1 share and 2 'h shares respectively.
2. A statement explaining that the proposed lots will have an adequate means for the
disposal of sewage in compliance with the requirements of the underlying zone district
and the Weld County Department of Public Health and Environment. A copy of the
septic permit or a litter from the sewage disposal facility must accompany the
application.
Existing Lot A, is served by septic system with a percolation rate of 28 minutes per inch
and limiting zone of 5 feet depth, the site is not within the flood plain. It is therefore
expected that Lot B, or any subsequent need for septic system on this property, will be
achievable under the rules and regulations of the Weld County Health Department.
Attached is a copy of the existing septic permit.
3. A description of how the property is being used. When the parcel(s) is located in the
agricultural zone district, the description shall include approximate acreage of prime and
nonprime farmland as defined in Chapter 22 of the Weld County Code, number and types
of livestock and any existing improvements such as the principal residence, labor home,
mobile home, manufactured home, barn, outbuildings, irrigation ditches, and oil well
production facilities on the property.
Lot A and Lot B are located in nonprime farmland, Lot B is currently vacant farm
ground. Lot A contains four structures, one principle residence, a pole barn and two sheds
which have been used to house up to six horses, currently no animals are housed on the
property. The Whitney ditch runs through both Lots A and B and will continue to provide
irrigation water to both lots.
4. The reason for the proposed recorded exemption with an explanation how each lot will
be used.
Purpose for the record exemption is to allow the current owner, Mr. and Mrs. Gills, to
retain ownership of Lot A and sell the remaining 25 acres. The intended buyer plans to
construct his primary residence on Lot B.
5. A description of the location, size, and present use of the area where the proposed new
lot(s) will be created.
The current parcel known as Lot A, of amended recorded exemption (AmRE 833),
consists of 35 acres with the southern boundary fronting Weld County Road 64 'A. The
proposed recorded exemption splits the parcel into approximately 10 acres on the east
side and 25 acres on the west side, with a north/south line defining the common boundary
between Lots A and B.
6. A statement describing any unique physical characteristics on the site, if applicable.
There are no unique characteristics within the site; both lots are flat, with an irrigation
ditch along the perimeter.
7. A statement indicating that all proposed or existing structures will or do not meet
minimum setback and offset requirements for the zone district in which the property is
located
All existing structures have been constructed according to Weld County standards, at the
time they were constructed. All proposed structures shall meet minimum setback and
offset requirements for the agriculture zone district in which they are located.
8. A statement indicating whether the applicant is willing to place a conservation easement
on the property to maintain farm production or open space.
The applicant, is not willing to place a conservation easement on the property to maintain
a farm production or open space. This property is not large enough, nor does it exhibit
any unique characteristics, to suggest this is applicable to this lot.
9. A statement indication whether the primary building envelope and/or alternative building
envelope will be designated on any of the lots.
There will be no primary building envelopes or alternative building envelopes designated
on any of the lots. Lot B shall meet existing Weld County requirements when, and if, it
is developed.

10. A statement explaining how the proposal is consistent with Chapter 22 of the Weld
County Code and any adopted municipal plan, and any approved intergovernmental
agreement(s), if applicable.
The proposed recorded exemption is consistent with Chapter 22 of Weld County Code,
and is not located in an area covered by an intergovernmental agreement.
11. A statement explaining how the proposed uses will be compatible with existing
surrounding land uses.
Any proposed structures to be constructed on Lot B will need to be compatable with
surrounding uses. It is expected that a primary residence will be constructed on Lot B.
This will fit in with the surrounding agricultural uses and residences that occur in the
area.
12. A statement explaining how the proposal is consistent with the intent of the district is
located within as expressed in Chapters 22 and 23 of the Weld County Code.

COMMENTS:
WCR 64.5 is designated on the Windsor Study Area Capacity Improvement Needs as a collector status road,
which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
WCR 25 is designated on the Windsor Study Area Capacity Improvement Needs as a paved rural road, which
requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present. (Lot B)
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately
size your culvert. (Lot B)
Direct access from a public road shall be limited; only one access is allowed per legal residential parcel. No
circle drives will be allowed. In accordance with Chapter 8, Article II of the Weld County Code, this policy shall
apply to all new and existing accesses within the unincorporated areas of Weld County. Properties within
municipalities or other counties that access Weld County roads are also subject to this policy. (Lot B)
The applicant shall utilize the existing residential access to this parcel, and no additional accesses shall be
granted. (Lot A)
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1 . A Weld County Septic Permit is required for the proposed home septic system
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. Prior to the release of building permits on the larger lot, the lot owners shall verify
with the nearest Town/City or Sanitation District to determine the location of the
nearest sewer line. In accordance with the Weld County Code, if a sewer line
exists within 400 feet of the property and the sewer provider is willing to serve the
proposed structure, a septic permit cannot be granted by the Weld County
Department of Public Health and Environment.

Thank you for the referral for the above-referenced recorded exemption. The City of Greeley
Planning staff has reviewed the application and wishes to forward the following comments:
City of Greeley Planning Commission Resolution 7, 1985, gave administrative review authority to
the Greeley Planning staff to review recorded exemptions. This resolution indicates that we can
recommend approval on any application where the overall gross density does not exceed one
dwelling unit per 10 acres when the subject property is located inside Greeley's Long-Range
Expected Growth Area. Since this application creates two buildable lots through the exemption
process on an existing 34.999-acre parcel, we can recommend its approval based on Resolution 7,
1985. The Greeley Public Works Department requests that a minimum of 60 feet of right-of-way
from the centerline of Weld County Road 64'/2 be reserved to facilitate future development of this
area if the proposal is approved.

RECOMMENDATION: Staff recommends that the Planning Commission forward a
recommendation of approval of the Recorded Exemption to
the Weld County Department of Planning Services.
DISCUSSION:
The Windsor Planning Commission reviewed this ref en-al on September 19, 2001. The
subject property is located outside the Town's Growth Management Area, but within the
Community Influence Arca. The subject property is depicted as Community Separator on
the Town's Land Use Plan map. The Windsor Comprehensive Plan states that the
Community Separator land use depiction provides for areas of open space and open lands
which generally have little or no development, with the exception of agricultural activities.
The application proposes to create one additional lot to sell for development of one
additional primary residence, according to the application. 'the low-density residential use
appears to be consistent with the Town of Windsor's Land Use Plan map.
Therefore, Planning Commission forwards a recommendation of approval of this Recorded
Exemption to the Weld County Department of Planning Services subject to the following
conditions:
1. The applicant shall dedicate any additional right-of-way on the south side of WCR
64 % along the entire length of the southern property line in accordance with the
Weld County Public Works Department standards.
2. All requirements of the Windsor-Severance Fire Protection District shall be
addressed to the District's satisfaction.

RE: Gills, Karl & Mary/Recorded Exemption
This letter is in response to your inquiry regarding water service to the following described property,
Approximately 12267 WCR 64 - %z, in a portion of the
E 'A of the NW ''A of Section 30,T6N, R66W of the 6'h Prime Meridian
1. Water service is presently being provided to the above described property.
2. North Weld County Water District is able and intends to provide a Residential Only"RO"water service to the above
mentioned property, provided all requirements of the District are satisfied. Before a water tap may be purchased,
the applicant must provide a copy of a Warranty Deed, and Physical Address and this letter. The applicant
should also bring a copy of a surveyed plat of the property(required for a recorded exemption).
If contracts have not been completed with North Weld County Water District within one year from the date of this
letter,this letter shall become null and void. The Tap Fees quoted below,shall be valid for ten(10)business days from
the date the applicant receives this letter. After ten days,the costs will be subject to the current cost established by the
District.
TAP FEES INSTALLATION COST ESTIMATE
Raw Water for an "RO" Tap ('/2 an AFU) $5,000 Meter Installation
Base Portion of Plant Investment Fee $5,000 Range ($1,000 to $3,000)
Distance Portion of Plant Investment Fee $2,400 At Cost TBD
TOTAL COSTS $12,400+ Meter Set
After the water tap hasibeen purchased(Raw Water AFU&Plant Investment Fee)the applicant has one year in which
to have the meter set. The District requires 45 days prior notice to setting a meter. If the meter has not been set within
one year from the purchase of such meter, the District shall refund the applicant 75%of the purchase price that was
paid by the applicant. If any line extensions,road bores or additional installation costs are estimated to be more than
$5,000,then Proof that"Loan Funds or a Line of Credit"are Available and ready to reimburse the District at the time
of completion,for 100%of the not-to-exceed cost. The applicant will pay such costs before the tap is activated(water
is turned on).
Water tap/service shall be placed on the physical property, defined by a legal description. In case of a Recorded
Exemption,the water tap shall only serve the parcel that the water tap is located on. Service shall NOT cross the legal
description of one parcel to serve the other parcel.
With purchasing a "RO" Residential Only Tap, the customer foregoes the right to rent water from the District.
Additionally if usage exceeds 114,000 gallons annually a RO Surcharge shall be applied to the account. Currently this
surcharge is$4.00 per thousand gallons. To avoid this surcharge,the customer may seasonally transfer CBT water or
pay for V2 of the current Raw Water Fee. Transferring C13T water is a temporary solution. Purchasing V2 of the Raw
Water Fee is a permanent increase of your raw water and will remove the RO status and RO surcharge. The District
recommends that anticipated water usage be purchased through the District. The District guarantees treatment and
