RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST CARL AND PAMELA SCHAAL FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Carl and Pamela Schaal, VI #0100042, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of February, 2001, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Kevin Dennis, representative, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until June 13, 2001, to allow adequate time for the property owners to
bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0100042 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Carl and Pamela Schaal to remedy the violation of the
Weld County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until June 13, 2001, to allow adequate
time for the property owners to bring the subject property into compliance by obtaining a
Change of Zone.
BE IT FURTHER RESOLVED by the Board that the Department of Planning Services
be, and hereby is, authorized to issue building permits on the property upon receipt of a signed
petition indicating the support of the surrounding property owners.

Currently, there is a violation of Chapter 23, Article III (3) , Division 2,

greenhouse activities in the R-1 (Residential) zone district. The property owner
can use the greenhouse only for personal use.

Dear Mr. Schaal:
After our teephone conversation of January 26, 2001 , I have had the opportunity to review your
application or a building permit to construct three (3) greenhouses on the above referenced
property. As we discussed, the construction of a greenhouse is generally considered an accessory
use as lone as the use is incidental to the residential activities occurring on the site. This intent can
be found in Section 23-3-110 of the Weld County Code which states, the purpose of the R-1 Zone
District is tc provide areas in the county for single family residential uses. The R-1 Zone District
is also intolded to accommodate non-residential land uses that are both accessory to, and
compatible with, residential uses allowed by right in the zone district.
When you isited with Chris Gathman on January 15,2001, Chris responded to your request under
the assur: ption that the property was zoned Agricultural. After you applied for your building
permits, it was determined that your property was not zoned Agricultural, rather it was zoned R-1
and had been for some time.
I have not researched your property to determine why it was zoned R-1 and will do so if you need
this additional information, so as it stands today, the property is definitely zoned R-1. Therefore,
to use the structures as a wholesale greenhouse facility, is not a use allowed nor are there
provisions to grandfather this particular use. In our conversation, you asked why you could farm
a portion of this property and raise crops, but you couldn't.use a greenhouse for wholesale
purposes? There is a fine division in landuse based on a historic use of a property versus a
change of use.
At this point, to afford you the opportunity to conduct a wholesale business in the greenhouses,
would not be appropriate without receiving special approval, as there is no indication that there is
a historic use based on this type of accessory use. The R-1 Zone District makes only one
provision,which is an exclusion for single family lots created prior to August 25, 1981, (the effective
date of the Weld County Code), by allowing you flexibility to not adhere to the public water, or
public sewer requirement.
There are four options to assist you in this resolution, and based on our conversation, you are
inclined to accept the violation option. Nevertheless, I would like to again list all available
remedies.
1. Use the greenhouses, solely for your own benefit with no type of wholesale activities.
2. Change the zone to Agricultural, which would afford you the opportunity to either apply for
a Use '3y Special Review with a higher intensity agricultural use, or as a Use by Right to
conduct wholesale activities.
3. Appeal my decision to the Board of Adjustment concerning a limitation of wholesale
greenhouses, which is not an appropriate use nor can this use be considered a
grandfathered use in the R-1 zone district, (as cited in the Weld County Code, 23-3-110-7,
you are afforded the opportunity for any structure or use clearly incidental in accessory to
a use allowed by right in the R-1 zone district). Retaining greenhouses would fall under a
use incidental or accessory as long as it complies with the family residential use of the R-1
zone district. The Board of Adjustments' is a quasi-judicial body empowered to hear
decisions based on an administrative appeal.
4. F .iier this week, a violation option was discussed with you by Lee Morrison, Assistant
County Attorney. Because you may be able to explain the uniqueness associated with this
case, Mr. Morrison suggested that a violation could be cited on this property and the Board
or County Commissioners, at a violation hearing, would have the authority to direct staff to
issue the pending building permits, and not pursue further violation activity. I also believe
Mr. Morrison informed you that should this be the Board of County Commissioners
direction, your property would remain in violation until such time that a more permanent
solution could be achieved.
According o county policy, you are extended thirty (30)days from the receipt of this letter to make
your decision concerning which of the four options you wish to undertake.
Until this .;:3ue has reached some kind of resolution, it is appropriate not to build any additional
structures )r complete any construction on the property. I have set this case to be considered at
the Febru:: y 13, 2001, violation hearing. Prior to this hearing, you may want to consider support
from the Jrounding property owners. I have taken the liberty to list all Weld County property
owners 500 feet. This information is enclosed for you with this letter. Additionally, as a point
of clarificH:ion, a drive-by field inspection was conducted on January 29, 2001. At that time, there
were two2) existing greenhouses on the site, along with one new frame for a greenhouse under
construction.

When I purchased the land it was Estate Zoning and that was changed
around 1980 to R1 zoning without notify ng me or my neighbors. It was
explained to me that if zoning was upgrded then notification was not
necessary. Because Union Reservoir is downstream from us a public
sewer system is not allowed. In order to use R1 zoning you mist have
public water and public sewer, This is why I am using the land for
agricultural turpos'.S.
