Dear Ms. Lockman:
In response to your letter of January 19, 2001 I am writing to express some concerns to
the Planning Commission in connection with the application for commercial development
of the site close to this address, as set out in the above case number file. At the time of
writing i have yet to view the file but intend to do so prior to the March 6 hearing
Concerns
1 The information contained in your letter does not provide sufficient description to
determine the nature and extent of the development and the potential impact of it
on the immediate environment. My telephone call to your office however has
disclosed additional information suggesting that the site would be used for the
garaging and repair of four semi-tractor units and that four individuals would be
employed there. Whereas my wife and I are not overly possessive of our
surroundings, we do have a personal and a public duty to protect it against
unnecessary and inappropriate usage Accordingly I have a number of comments
and questions that by implication show the possibility of a negative impact on this
environment.
2. Why, given the existence and choice of commercial sites in Commerce City,
Brighton, and parts of Fort Lupton, does the applicant wish to bring commercial
vehicle operations to an agricultural and residential area?
3 Having had connections with transportation for a number of years I can say that
commercial operations of this kind are always accompanied by multiple forms of
pollution, including the use of external and commonly powerful lighting beyond
normal business hours, the disposal of lubricants, the emission of exhaust fumes,
and the accompanying noise of engines being warmed and tested, shouts of
employees (to get above the engine noise) and the consequential traffic
contribution, all at varying hours.

4. This is a thinly populated residential and agricultural area and by its rural nature is
also the resort of wildlife and domestic animals. Residential development can be
sympathetic to such a situation, whereas commercial operations of the kind
anticipated are by their nature consistently disruptive, making this proposal more
than anti-social, with potential for conflict (Consider the present image of
Commerce City on Highway 85 and picture transposing such businesses to the
countryside of Weld County Where does it stop?)
5. What specifically is the planned and permitted use of the proposed development,
what conditions would be imposed/enforced to ensure compliance within that
approved use, and what protection do we have against future expansion of the
site?Most businesses exist to seek growth and I suspect that if not the applicant
then a subsequent owner would consider enlargement of the commercial
activities
6. What structure, vehicles etc. would be visible and at what distance, from the
driveway and our residence at the above address?
7. What information is available by way of projecting vehicular traffic frequency
and volume? Where precisely will traffic enter and leave the site?
8. What provision can be made, and legal assurances offered, for the safe
management of hazardous materials and the safe drainage of fluids from the site?
9. What information is available and what legal condition/provision may be attached
to the site usage with regard to the parking, access and movement of trailers,
loaded or not, and similarly with regard to varying types of commercial vehicles,
i_e. beyond the stated purpose in the initial application?

I am submitting my comments on Kelly and Dana Boyle's request for a Site Specific Development Plan
and Special Permit for a business permitted as a use by right in the Commercial Zone District in the
Agricultural District located in Part of the E2NE4 of Section 16,Township 2 North, Range 66 West of the
6th P.M. in Weld County. Colorado.
My property is located adjacent to this property to the west. I have reviewed the file on this request and
have spoken to the Boyles. I have no objection to what they have proposed.
