HomeMy WebLinkAbout20010265.tiff RESOLUTION RE: APPROVE CONTRACT AMENDMENT#1 FOR SINGLE ENTRY POINT AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with Contract Amendment#1 for the Single Entry Point between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Area Agency on Aging, and the Colorado Department of Health Care Policy and Financing, with terms and conditions being as stated in said amendment, and WHEREAS, after review, the Board deems it advisable to approve said amendment, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Contract Amendment#1 for the Single Entry Point between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Area Agency on Aging, and the Colorado Department of Health Care Policy and Financing be, and hereby is, approved. The current payment is $838 and the new amount will be $855 per client per year. FACTUAL RECITALS Authority exists in the Law and Funds have been budgeted, appropriated, and otherwise made available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 100, Appropriation Code 175,Contract Encumbrance Number 3cc U ff 3 ;and 33Required approval, clearance, and coordination has been a�omplish d from and with appropriate agencies; and The parties entered into a contract dated 30'h day of June 2000 , for Contractor to serve as a district Single Entry Point agency through provision of case management for clients in State community- based long term care programs, more fully described below. The adoption of regulations that provide authority for the Single Entry Point contractors to provide utilization monitoring of skilled care provided for Single Entry Point agency clients have been delayed substantially. NOW THEREFORE, it is hereby agreed that Consideration for this amendment to the original contract, Contract Encumbrance number SC UHA 3301-1318, Contract Routing Number 3301-1318, dated 30th day of June 2000 consists of the payments which shall be made pursuant to this amendment and the promises and agreements herein set forth. 2. It is expressly agreed by the parties that this amendment is supplemental to the original Contract Routing Number 3301-1318, dated 30th day of June 2000 referred to as the "original contract," which is, by this reference, incorporated, and made a part hereof, and all terms, conditions, and provisions thereof, unless specifically modified herein, are to apply to this amendment as though they were expressly rewritten, incorporated,and included herein. 3. It is agreed the original contract is and shall be modified, altered, and changed in the following respects only: Page I of 3 Pages a. The first sentence of Exhibit E, Page I of 3, Paragraph(I)(c)that is in the original contract: "If performance standard (3) is attained by State certification by January 2001, contractor shall receive payment of an additional $17 per client for clients served throughout the period from July I. 2000 through June 30, 2001 under the payment methodology described in Exhibit A to this contract." Is replaced by the sentence: On approval by the State of the Single Entry Point District Home Health Implementation Plan: addressed on Page 3 of 17, Paragraph 2(a) E (3), line 1; submitted by the contractor, contractor shall receive payment of an additional $17 per client for clients served throughout the period from July I, 2000 through June 30,2001 under the payment methodology described in Exhibit A to this contract. b. Exhibit E, Page 3 of 3, Paragraph(3)that is in the original contract: " "Monitoring of Skilled Care Provider(Home Health)Service Utilization"The increase in cost of skilled care services must be limited to 12.5%, not including the increase that occurs as a result of rate increases set by the Department. The Medical Services Board of the Department of Health Care Policy and Financing will set an average per client increase in the cost of services per client and effective September 1,2000, that rate of increase shall become the standard against which this objective will be measured. For the contractor to qualify under this standard,a data base which meets State requirements must be kept timely and accurately to within seven days for all Prior Authorization Reviews(PARs)for clients who receive skilled care performed by the contractor. A review of this data base by the State following entry of client PARs for Home Health skilled care must demonstrate that the contractor has approved PARs for services that do not average more than the increase amount set by the Medical Services Board over an average baseline PAR approval figure in dollars for that contractor district that is provided to the contractor by the State." Is replaced by the paragraphs: "Monitoring of Skilled Care Provider(Home Health)Service Utilization"To qualify under this standard,a plan; addressed and described on Page 3 of 17, Paragraph 2(a)E(3), line I;must be submitted to the State and approved by the State. While remaining a requirement to be performed by the contractors under this contract, the implementation and use of the State approved data base will be used to obtain statistical, managerial and/or financial information. Data base results will not be taken into account for contractor payment purposes in FY2000-2001 under this contract. The data base which meets State requirements must be kept timely and accurately to within seven days for all Prior Authorization Reviews(PARs) for clients who receive skilled care and who are also served by the contractor under this contract. 4. The effective date of this amendment is February 1, 2001 or upon approval by the State Controller, whichever is later. 5. Except for the "Special Provisions," in the event of any conflict, inconsistency, variance, or contradiction between the provisions of this amendment and any of the provisions of the original contract, the provisions of this amendment shall in all respects supersede, govern, and control. The "Special Provisions" shall always be controlling over other provisions in the contract or amendments. The representations in the Special Provisions concerning the absence of bribery or corrupt influences and personal interest of State employees are presently reaffirmed. Page 2 of 3 Pages 6. FINANCIAL OBLIGATIONS OF THE STATE PAYABLE AFTER THE CURRENT FISCAL YEAR ARE CONTINGENT UPON FUNDS FOR THAT PURPOSE BEING APPROPRIATED, BUDGETED, AND OTHERWISE MADE AVAILABLE. 7. Dear OLTC Administrator: BACKGROUND: The Fiscal Year 2000-0I Single Entry Point contract contains provision that $17 per client per year, as provided by the Single Entry Point payment methodology, is contingent upon the contractor's achievement of limited average growth per client in expenditures in the area of prior approved skilled care. Reference to this is contained in Exhibit E, Page 1 of 3, Paragraph 1(c), and Page 3 of 3. Paragraph 3. The payment methodology is defined in Exhibit A of the contract. This performance-based standard, originally foreseen to be implemented as early as July 1, 2000, was contingent upon rule approval by the Medical Services Board that gives the Single Entry Point agencies the authority to receive and to approve prior authorizations of skilled care. This process of rule approval and implementation was delayed significantly necessitating an adjustment of the performance-based payment standards originally addressed in DAL 187. Enclosed, you will find an amendment to the contract with the following action: Contractors were originally notified in DAL 187 in August 2000 that this amendment would occur. For fiscal year 2000-2001, the payment of the additional $17/client/year to contractors is contingent upon State approval of submitted plans of approximately 2-3 pages addressed in the contract, Page 3 of 17, Paragraph E(3) and in DAL 181 dated June 6, 2000. Payment of the complete $855/client/year, the first of which will contain a correction of back pay to the July 1, 2000 contract term beginning date, will be sent to contractors at the first payment practicable following approval of the submitted plan and signature by the Contractor and State of the enclosed amendment. Almost all of the required plans have been submitted and have been approved. The amendment includes the following specific changes: ➢ Replacement of the first sentence of Exhibit E, Page 1 of 3, Paragraph (1)(c) that is in the original contract with the new paragraph, "On approval by the State of the Single Entry Point District Home Health Implementation Plan; addressed on Page 3 of 17, Paragraph 2(a) E 3(3), Line 1; submitted by the contractor, contract shall receive payment of an additional $17 per client for clients served throughout the period from July 1, 2000 through June 30, 2001 under the payment methodology described in Exhibit A to this contract." ➢ . Replacement of Exhibit E, Page 3 of 3, Paragraph (3) that is in the original contract with the new paragraph titled "Monitoring of Skilled Care Provider (Home Health) Service Utilization". "The mission of the Department of Health Care Policy&Financing is to purchase cost effective health care for qualified,low-income Coloradans." http://www.chcpf.state.co.us Paragraph 2E of the FY 00-01 contract has been rendered moot by the regulation not passing prior to December 31, 2000 and will not be taken into account for FY 00-01 for establishment of eligibility to receive $855 per client per year. We wish to make the additional payments of$17 per client for clients serviced through the period of July 1, 2000 through June 30, 2001 as soon as possible, but can do this only after completion of these amendments and meeting the requirements of this amendment. Please obtain the signatures and return three signed copies (original signatures on all copies) of the amendments as soon as possible. In completing these amendments, it is important that certain requirements are followed: • Enter the full legal name of your organization as it appeared on the original signed contract. • The signature should be that of the person authorized to commit (sign contracts for) the organization. • "Name" should be followed by the typed or printed name of the signatory. • "Title" is the title of the signatory. • Enter your Federal Employer Identification Number which must match the same number obtained from the signatory page of the original contract. • Circle the title of the person authorized to attest contracts for your organization and obtain the attesting seal.
