HomeMy WebLinkAbout20010834 03 RESOLUTION RE: ACCEPT PETITION AND AUTHORIZE VACATION OF A PORTION OF RIGHT-OF- WAY ON WELD COUNTY ROAD 6 - ROCKY MOUNTAIN WILDLIFE CONSERVATION CENTER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Road Petition from the Rocky Mountain Wildlife Conservation Center, 1946 Weld County Road 53, Keenesburg, Colorado 80643, a copy of which is attached hereto and included by reference, requesting vacation of a portion of right-of-way on Weld County Road 6, being more fully described as follows: The public road right-of-way lying 30 feet on either side of the section line between Sections 21 and 28, Township 1 North, Range 64 West of the 6th P.M., Weld County, Colorado WHEREAS, the County Attorney's Office and Public Works Department have recommended approval of said request since that portion of Weld County road right-of-way is not needed for the safety and welfare of the traveling public, and WHEREAS, the adjoining landowners were mailed ten days notice by the Clerk to the Board of a public hearing set for April 11, 2001, to consider the vacation of that portion of Weld County road right-of-way which is described above, and WHEREAS, any persons owning dedicated and recorded easements and rights-of-way for the use of the right-of-way to be vacated, if any, may continue such use after formal vacation by Weld County, and WHEREAS, the Board of County Commissioners heard testimony and reviewed all other evidence presented therein by staff and the public, and WHEREAS, the evidence showed that the vacation of that portion of Weld County road right-of-way which is described above will not leave any land adjoining the roadway without an established public road or private access easement connecting the land with another established public road, and WHEREAS, the Board of County Commissioners deems it advisable to vacate said portion of Weld County road right-of-way, with said vacation to become effective upon recording as required below. Box 758 , FEB 1 6 2001 i Greeley, CO 80632 L _J ELD COUNTY` RE: Vacating Portion of County Road Easement ATTORNEY'S OFFICE Dear Commissioners, As Director of Rocky Mountain Wildlife Conservation Center, I would like submit a request to vacate a portion of a county road easement. The easement in question is located in the southeast portion of Weld County, and more specifically would be that portion of WCR 6, which is located between WCR 53 & 55. The stated easement is one mile in length and has not been developed. Currently a developed portion of WCR 6 exists between WCR 55 & WCR 67, and another developed portion exists between WCR 47 & WCR 49. However, the easement between those two existing roads remains undeveloped. I can only assume the area went undeveloped between these two portions because of naturally occurring and man-made obstacles - which would make road development very difficult - such as flood plains, irregular topography, swamps, and irrigation canals. As some of you may remember, we are a state and federally licensed non-profit wildlife sanctuary. We have been rescuing captive wildlife for over 21 years now and have a very unique facility in Weld County, which borders a portion of the easement in question. Our current operation(on 65-acres) is located on the south side of this easement—and just recently- a RMWCC Board of Director purchased the adjacent land on the north side of the easement (60-acres)... with the intention of donating the land to the Center. With our intention of conjoining these two parcels - for the purpose of having continuous access for the animals and more open space for the Center- we would like to ask that you consider vacating this segment of the county easement. In addition, as this one-mile stretch of easement isn't developed and serves no benefit to the county or the local property owners, I have also included with this application, letters from two other adjoining property owners who wish to vacate this segment of easement in question.
