RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI0100061 AGAINST BRETT AND CHRIS REESE FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Brett and Chris Reese, VI #0100061, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of December, 2001, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Brett and Chris Reese were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. In order to continue the "VanWinkles Cave" Bed and Breakfast, a Use by Special Review permit and a Building Permit shall be obtained; otherwise,the business shall cease to operate. If you choose not to have a Bed and Breakfast,we would need a letter from you stating your intentions. Also the structure could not be advertised through any means(i.e.telephone book, website, newspaper, etc.). If you choose to obtain the necessary permits, and they are approved and a plat is recorded,the Bed and Breakfast would be allowed to continue.
