RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST DANIEL AND DEBRA BAKER FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Daniel and Debra Baker, VI #0100106, are allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of August, 2001, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Daniel and Debra Baker, property owners, were present at said hearing,
and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until October 1, 2001, to allow adequate time for the property owners
to landscape and screen the property, and to exclude the dirt bike track from this violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0100106 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Daniel and Debra Baker to remedy the violation of the
Weld County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until October 1, 2001, to allow
adequate time for the property owners to landscape and screen the property.
BE IT FURTHER RESOLVED by the Board of County Commissioners, that the dirt bike
track be, and hereby is, excluded from this violation.

Dear Mr. & Mrs. Baker
The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting with
the Board of County Commissioners on August 14,2001, at 10:00 a.m.,to consider the violations occurring on
the property. As we discussed the above mentioned property is in violation of the following Section(s)of the
Weld County Code:
Chapter 23,Article 11,Div 3 "Site Plan Review"
Section 23-2-150 "Intent and applicability."
Section 23-2-150.1 "Any approved Site Plan Review shall be limited to the items shown on the Site Plan Review map.
Major changes from the approved Site Plan Review map shall require the approval of an amendment of the Site Plan
Review map by the Department of Planning Services. The Department of Planning Services is responsible for
determining whether a major change exists. Any changes shall be filed in the Department of Planning Services with
the Site Plan Review file. (Weld County Codification Ordinance 2000-1)"
To bring the property into compliance with the Site Plan Review (SPR-302) the following Conditions of
Approval shall be completed:
Currently,the property is in violation of its current Site Plan Review.
1.a.2.) A fencing plan must be submitted to the Department of Planning Services and shall include the location of
the fence and gate behind the landscaping. The fencing shall be painted green or brown to blend with the landscaping.
All outside storage must be screened from all adiacent properties and public rightsof-way.
1.c.3.) Sufficient space shall be provided in loading/service areas to accommodate the vehicles being loaded or
unloaded without encroachment upon neighboring property or rights-of-way. All loading/service and parking areas
shall be paved.
1.c.15.) Landscaping materials as indicated in the approved landscape plan shall be maintained at all times. Dead
or disease plant materials shall be replaced with materials of similar quantity and quality at the earliest possible time.
1.c.18.) No parking or staging of vehicles outside of the delineated parking areas is allowed.
While I realize that you have an Improvements Agreement extending the date of completion of some aspects of your
site requirements,according to the Resolution date October 16,2000,the only aspect that was granted an extension
was the"Private Road Maintenance". The Resolution did not address an extension for the required screening or
landscaping.
Additionally,a dirt track has been constructed. This is not an allowed use through your current Site Plan Review or
through your zone district.
This meeting will take place in the County Commissioners'Hearing Room,First Floor,Weld County Centennial
Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance
to answer any questions the Board of County Commissioners might have about the violations.
Please also be advised that I will be taking video from the road or adjacent properties the day before the Violation
Hearing (indicated above).
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation including the action necessary to correct the violation, and
that you were given sufficient time to remedy this violation. If you have any questions concerning this matter,

It has come to the attention of the Department of Planning Services' staff that the uses on your property may not
be in compliance with the Weld County Zoning Ordinance. The potential noncompliance with the Zoning
Ordinance is failure to meet the standards set forth in your Site Plan Review "SPR-302". While it is my
understanding that you have posted new "Collateral" extending your time until next year, a "Noncommercial
Junkyard" is not allowed in per your zoning. This means that the "Noncommercial Junkyard" consisting of
derelict vehicles,tires, appliances,automotive parts and miscellaneous debris must be screened. There are also
additional concerns regarding your "Site Plan Review" in regards to your road accesses and approved sign. I
can not find any building permits for the sign. Please contact me as soon as possible so that we may go over
these more thoroughly.

a minimum of 24 feet wide to accommodate two-way traffic. Customer/visitor parking
adjacent to the office area shall be paved and striped. The approach to the overhead doors

3. A Site Plan Review Nat shall be prepared after the Site Plan Review application is approved. The
plat shall be submitted to the planner and be ready for recording at the Weld County Clerk and
Recorder's Office within 30 days of approval. The shall meet all requirements of Section 23.2.1.22
and 23.2.1.23 of the Weld County Zoning Ordinance. The plat shall be no larger than 24" X 36".
4. Prior to the release of the Certificate of Occupancy:
a. A final inspection of the occupancy will be required by a member of the LaSalle Fire
Protection District.
b. The applicant shall have in place, all paving,parking and utilities. (Planning)
