HomeMy WebLinkAbout810283.tiff RESOLUTION RE: APPROVAL OF AMENDMENT TO SPECIAL USE PERMIT NO. 401 - CONTINENTAL PIPELINE COMPANY, 1750 WESTLAND ROAD, CHEYENNE, WYOMING 81001 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado , and WHEREAS, on May 6 , 1981 at 2 : 00 o'clock p.m. , the Board of County Commissioners of Weld County, Colorado held a hearing to consider the request of Continental Pipeline Company, 1750 Westland Road, Cheyenne, Wyoming 81001, for an amendment to Special Use Permit No. 401, and WHEREAS, the parcel of land on which said amendment to Special Use Permit No. 401 is requested is described as follows: The Northwest Quarter of the Northwest Quar- ter of Section 2 , Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, the amendment to Special Use Permit No. 401 con- cerns the deletion of Development Standard #12 which is in regard to the latticework in the chain link fence, and WHEREAS, the Board reviewed the request and the recommenda- tions of the Weld County Planning Commission and finds that said request for an amendment should be approved. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that Special Use Permit No. 401 be, and hereby is, amended by the deletion of Development Standard #12 concerning the latticework in the chain link fence. Town of Frederick Recommendations of the referral entities are addressed or included in the attached Development Standards. The Planning Commission recommendation for approval is conditional upon the following: 1 . The attached Development Standards being recommended and approved for the Special Use Permit. 2. No building or electrical permits shall be issued on the Special Use Permit area until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delivered to the office of the Department of Planning Services. 3. (b) Four (4) 15 horsepower electric motors necessary to drive four horizontal centrifugal pumps may be installed in conjunction with pumping crude from the trucks to the two 500 bbl tanks and subsequent pumping from the two 500 bbl tanks through the A.C.T. units. 9. The hauling of crude oil by trucks to the facility shall essentially be limited to daylight hours, with exceptions occurring during possible emergency situations. 10. An earthen dike shall be constructed around the existing storage tank to ensure containment of any possible oil spills and exclusion of any foreign fluids from adjacent property. This dike will also serve as containment for the two proposed 500 barrel tanks. 11 . The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting, maintenance and weed control . 12. Aluminum fence lattice shall be interwoven with the existing six-foot chain link fence around the facility to provide property landowners with visual screening. 13. The facility shall comply with all State and County Health Standards and Regulations pertaining to air quality, water quality, noise emission and sanitary disposal systems. 14. Safety and fire protection will be as prescribed by the Ft. Lupton Fire Protection District and Industry Standards and other applicable rules and regulations of governmental bodies having jurisdiction on the premises. 15. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an . amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. However, the Staff feels that this request would require notification of surrounding property owners and a hearing before the Planning Commission and the Board of County Commissioners.
