A public hearing was conducted on April 25, 2001, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 6, 2001, and duly published April 11, 2001, in
the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request of Moriah
Holsteins,LLC,do Marcy Daniels-Gruber,fora Site Specific Development Plan and Amended Use
by Special Review Permit #1140 for an Agricultural Service Establishment and Livestock
Confinement Operation (dairy expansion to 4,000 head with four accessory to farm mobile homes)
in the A(Agricultural)Zone District. Lee Morrison, Assistant County Attorney, made this a matter
of record. Julie Chester, Department of Planning Services, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the record
as written. Ms. Chester gave a brief description of the location of the site, and stated eight referral
agencies responded favorably or proposed conditions, and she has received no correspondence
from the surrounding property owners. In response to Chair Geile, Ms. Chester stated the four
mobile homes will house up to 15 employees, and she explained the definition of "family" does
place some restrictions on who can reside together in a single family dwelling. She further stated
the Board can also determine what is allowed, and noted the mobile homes will be permitted as
accessories to the farm and will fall under slightly different regulations. Ms. Chester stated the
accessory to the farm has to be substantiated on an annual basis to prove the residents are

principally employed at the site. Mr. Morrison stated the term"family" does not necessarily mean
that the residents are related, but rather share the common household expenses. In response to
Commissioner Jerke, Ms. Chester stated the Conditions of Approval require the applicant to meet
the requirements of the Platte Valley School District, which is requesting an impact fee to be
determined based on the potential impact of the residents. She stated the applicant should provide
the Department of Planning Services staff with documentation from the School District if there are
any special provisions for the impact fees. In response to Chair Geile,Trevor Jiricek,Weld County
Department of Public Health and Environment, stated the applicant anticipates building new
lagoons. He stated the lagoons currently rely on evaporation, the applicant has submitted
preliminary plans, and they do not propose land application on the site.
Marcy Daniels-Gruber represented the applicant and stated they would like to expand the dairy to
stay current with dairy trends. In response to Chair Geile, Ms. Daniels-Gruber indicated the
location of the completed lagoon and proposed lagoons, and stated she has been working with an
engineer for design of the new lagoons. Ms. Daniels-Gruber stated the site is serviced by a one
and one-half-inch water pipe, and they still need to meet with the Central Weld Water District to
determine if that will be adequate. Responding further to Chair Geile, Ms. Daniels-Gruber stated
she has reviewed and agrees with the Conditions of Approval and Development Standards.
No public testimony was offered concerning this matter. In response to Chair Geile, Don Carroll,
Department of Public Works, stated Weld County Road 46 is a local gravel road with 60 feet of
right-of-way,which Weld County maintains. He stated the current traffic count is approximately 119
vehicles per day, and noted there is an oil and gas disposal service located at the intersection of
Weld County Roads 46 and 53; however, there will be no truck traffic adjacent to the dairy. Mr.
Carroll stated the haul route for the oil and gas facility is chemically stabilized in accordance with
their road maintenance agreement. Responding to Chair Geile, Mr. Jiricek stated if the applicant
is not able to obtain an adequate water supply,they will not be able to proceed with the expansion.
Commissioner Vaad moved to approve the request of Moriah Holsteins, LLC, do Marcy Daniels-
Gruber,for a Site Specific Development Plan and Amended Use by Special Review Permit#1140
for an Agricultural Service Establishment and Livestock Confinement Operation (dairy expansion
to 4,000 head with four accessory to farm mobile homes)in the A(Agricultural)Zone District,based
on the recommendations of the Planning staff and the Planning Commission, with the Conditions
of Approval and Development Standards as entered into the record. The motion was seconded
by Commissioner Jerke, and it carried unanimously.
