RE: TESS Communications Notice to Discontinue Its Intent to Offer
Communications Services
Dear Commissioners:
This letter is to notify you that TESS Communications of Colorado, Inc. (TESS) has
asked the Colorado Public Utilities Commission (PUC) for approval to discontinue its
intent to offering basic local telephone service in the St. Vrain subdivision effective on
or about April 19, 2001. TESS proposes to stop construction on telecommunications
facilities offering local telephone service and work cooperatively to transition basic
local telephone service(s) to Qwest Communications International, Inc., (Qwest), the
provider of last resort.
Anyone may object to this proposal by sending a letter to the Colorado Public Utilities
Commission, 1580 Logan St., OL2, Denver, CO 80203. You may also object to this
proposal by calling the PUC at 303-894-2000, or 1-800-888-0170 if you are outside

2001. Your written request to intervene must follow Rules 20, 21, and 22 of the
Commission's Rules of Practice and Procedure and any other rules that apply. You
can request a copy of these rules from the Commission.
The PUC may hold hearings on TESS' proposed actions. If the Commission holds
hearings, it will decide what actions, if any, are allowed. Members of the public may
attend any hearing and make a statement under oath about the proposed action even
if they did not submit a written objection or intervention.
If you want to know if and when hearings are held, please submit a written request to
the PUC at the above address. Your written request for hearing notice must be
submitted to the PUC at least 10 calendar days before the proposed effective date of
April 19, 2001.

Please be assured that basic local telephone service will still be available to St. Vrain occupants
whatever the outcome of TESS' requested action. If TESS' request to discontinue its intent to
offer local telephone service is granted, another telephone company will offer service.
According to Colorado State law and the Public Utilities Commission Rules regarding regulated
phone service TESS will compensate residents of the St. Vrain development for this
inconvenience in several ways. First, until Qwest installs phone service, TESS will reimburse the
consumers for Qwest's installation or activation fee for local services, if any. Second, should a
St. Vrain resident's service be delayed for more than sixteen days, TESS will pay for a wireless
alternative in the interim. In addition, on the 31"day from receipt of a St. Vrain resident's order,
TESS will reimburse the monthly rate for each month or partial month service is not established.
TESS sincerely regrets any inconvenience to St. Vrain customers resulting from this delay.
