RE: GRANT REQUEST TO VACATE A PORTION OF ROAD IN LOTS 1 AND 2
OF THE SE4 SE4 OF SECTION 4 , TOWNSHIP 5 NORTH, RANGE 66
WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has received a
request to vacate a portion of road in Lots 1 and 2 of the SE4
SE4 of Section 4 , Township 5 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado, and
WHEREAS, after study and review of this matter, the Board
desires to vacate said portion of road, and
WHEREAS , the Board deems it advisable that the Weld County
Attorney prepare a Quit Claim Deed concerning this vacation of
that portion of road in Lots 1 and 2 , and
WHEREAS , said Quit Claim Deed shall be executed by the
Chairman of the Board and recorded in the office of the Weld
County Clerk and Recorder.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the request to vacate
a certain portion of a road in Lots 1 and 2 of the SE4 SE4 of
Section 4 , Township 5 North, Range 66 West of the 6th P.M. , Weld
County, Colorado be, and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the Weld County
Attorney prepare a Quit Claim Deed concerning that portion of
road in Lots 1 and 2 of the SE4 SE4 of Section 4 , Township 5
North, Range 66 West of the 6th P.M. , Weld County, Colorado,
said Quit Claim Deed to be executed by the Chairman of the Board
and recorded in the office of the Weld County Clerk and Recorder.

Enclosed please find plot plan for our property which is lot 1 and 2
of Western Hills, Weld County. Located in the S.E.14 S.E.', of section
4, township 5 north, range 66 west of the 6th P.M. The site is
rectangular, except for slightly irregular east property line. Front-
age includes 150 feet. To the east there is 20 feet dedicated road-
way.
I am asking the Board of Commisioners to vacate this dedicated road-
way, and convey this property to NCC Construction Company. This
dedicated property has been used by our firm for storage of con-
struction material. I feel that this dedicated property is of no
use other than what it is being used for now. The elevation on this
property is very irregular, there is about a 30 foot drop from
Highway 34. In order to construct our office building! we have had
to do considerable amount of fill. There is a proposed alley to the
backside of our property, and access to adjoining properties. We
have maintained proposed property for approximately 12-years.

Dear Mr. Carlson:
The Greeley Planning Commission at its January 10, 1984, meeting
reviewed the request by Northern Colorado Constructors to vacate the
29 foot wide right-of-way north of the State Highway at approximately
60th Avenue. The Commission recommended no objections to the request .
