RESOLUTION RE: ACTON OF THE BOARD CONCERNING LEGAL ACTION AGAINST RICHARD AND SHARON SEWALD FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Richard and Sharon Sewald, VI #0100053, are allegedly in violation of the Weld County Code, and WHEREAS, on the 2nd day of April, 2001, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Richard and Sharon Sewald, property owners, were present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to dismiss said violation. Currently, there is a violation of Chapter 23, Article III (3) , Division 3, Sections 23-3-230, 23-3-230 .B, 23-3-230 .B.2, 23-3-220.B.4, 23-3-220 .E and 23-3- 230 .E and Chapter 29, Article III (3) , Sections 29-3-50 and 29-3-320 of the Weld County Code. To bring the property into compliance the property owner shall complete and submit a Site Plan Review and complete and submit a Building Permit application, before any additional "Rave" Events occur. This means an approved Site Plan Review and recorded plat and an approved and issued Building Permit shall be addressed before an additional event. The Department of Planning also recommends that the County Attorney authorize legal action against any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties . Reed Date: March 30, 2001 Subject: Jams Raves Sheriff Jordan, Following is a summary of activity at Jams, 6010 W. 10th St. and action taken to date. On January 13, 2001 a Rave was held at Van C /Jams at 6010 W. th St. in Greeley, Co. Weld County Planning and Zoning became aware of the activity as a result of an article in the Greeley Tribune. Richard and Sharon Sewald were sent a letter on February 15, 2001 by Zoning Code Compliance Officer Beth Salzman. This letter was to advise that the Rave violated the Use Permit for the location. The Sewalds were further advised that they would need to apply for a new use permit to avoid any further violations. On February 17, 2001 the Weld county Sheriffs Office received a Suspicious Activity call. Upon arrival Deputies found that a Rave was in progress at Van C / Jams. On this date a total of 4 deputies were on scene resulting in a combined time of 2hrs. and 14 minutes. Deputies on scene were Clint Leager, Josh Noonan, Sam Kaneta and Bruce Martin. On February 24, 2001 Weld Count Deputies responded to a loud music complaint and again found a Rave in progress at Van C / Jams. On this incident there were 5 deputies on scene. Deputies Josh Noonan, Sam Kaneta, Bruce Martin, Clint Leager and Greg Broswell. Total combined time for this call was 1 hr. 49 minutes. On March 14, 2001 I accompanied Zoning Compliance Officer Beth Salzman to Van C where a second letter was hand delivered to Richard and Sharon Sewald. this letter again advised the Sewald's of zoning violation and advised them to apply for a change in their use permit. I also spoke with the Sewald's concerning the issue. I advised them that the Sheriffs Office had Public Safety concerns. These concerns are due to the foot traffic of the persons attending these events, parking on the north side W. 10 th St. and crossing over a high traffic area with very limited lighting. On March 17, 2001, Deputies responded to Van C/Jams on another Rave. At this time deputies were told that there were over 700 and approaching 800 people in attendance. After discussion with Sheriffs Office on duty supervisors the deputies informed the Rave promoter that he would need to close: This was done due to an attendance in excess of 500 people and a reasonable expectation that it would last more than 5 hours. Deputies also issued county summons to the Sewalds and Rave promoter Ha Quang Hau for violation of Weld County Ordinance 12 - 1- 20 for not obtaining an assembly permit. According to the case report on this incident, WC01-1335, there were 9 Weld County Deputies and 5 Greeley Police Officers on scene at this incident. There were also reported to be approximately 6 arrests of people leaving the Rave. The arrests ranged from drug possession to car theft. In addition there were 2 Weld County Reserve Officers in the area. These Reserve Officers were conducting a traffic survey by counting cars, using radar and video taping. According to the list I received 30 vehicles passed by the location on W. 10th St in approximately a 1 hour time frame with an average speed of 42.5 MPH. In addition to the regular vehicle traffic the video demonstrates the public safety issue of the people on foot crossing the road way causing traffic to slow down. The video also shows the empty bottles and paper left behind in parking lots of area businesses. On March 19, 2001 a meeting was held at the County Attorneys Office to discuss the issues surrounding these incidents. The meeting took place in the office of the planning department at 1555 N. 17th Avenue, Greeley, Colorado. At that time, we discussed the issues regarding the building at 6010 West 10th Street. They informed us of some of the changes that would need to be done before it would be authorized to allow electronic music events. Bethany had said that day, to write a letter agreeing that we would not have or hold any more electronic music events. In writing this letter, that the violations would be dropped. This would be until the property would be brought up to code for such activities and approved by the planning and zoning department. You have continued to conduct public dances in the building on the property without an approved site plan and in violation of numerous provisions of the building requirements of the Code. The most recent public dance occurred on the site on March 17, 2001. Because of safety concerns relating to the use of the property and the building in this fashion, this case has been scheduled before the Board of County Commissioners on April 2, 2001, at 9:00 a.m., to consider the violations occurring on the property. As we discussed the above mentioned property is in violation of the following Section(s) of the Weld County Code: Chapter 23,Article III, Div 3 "Commercial Zone Districts" Section 23-3-230 "C-3(Business Commercial)Zone District." Section 23-3-230.8 "Uses Allowed by Right." Section 23-3-230.8.2 "Uses Allowed by Right in the C-2 Zone District." Section 23-3-220.8.4 "Nightclubs,bars,lounges and taverns." Section 29-3-320 "Change in use." - "Changes in the character or use of a building shall not be made except as specified in Section 3405 of the UBC.(See Section 29-3-50 A of this Chapter.)" • To bring the property into compliance the following option(s) are available: A Site Plan Review shall be submitted showing the proposed use as a"Nightclub/Dance Hall",instead of "SPR-227"which currently shows the use as a"used car lot." Additionally,a Building Permit shall be obtained allowing the structure to be constructed to the standards established per the type of use occurring. Lawyer Cris Campbell represents Ha Hau, the owner of Triad Dragons Productions, which organized the rave Saturday night at a west Greeley building. Sheriff's deputies shut the party down because the producers had no permit. Hau was issued a summons, which his attorney said he will fight in court. Since the Drug Enforcement Agency "had a workshop for police showing them how to shut down raves, law enforcement has targeted raves as a source of Ecstasy," Campbell said. "But you can find Ecstasy everywhere — frat houses are full of Ecstasy, so are high schools — but they target the raves." Ecstasy is known as a party drug, less expensive and less lethal than cocaine, but the death of a high school girl in Boulder earlier this year caused law agencies to go after rave parties more than ever, Campbell said. The Greeley sponsors of the rave last Saturday claim they violated no laws and their party was drug-free. Sharon Sewald and her husband, Richard, own the Van-C truck accessories shop and Jams skateboards businesses in the 6000 block of 10th Street, and last weekend's party was in their former office building at 6010 10th St. The party was broken up early Sunday because as many as 1,000 young people were crowded into the building, and deputies said they responded to reports of noise violations. "There were no noise violations," Sharon Sewald said Wednesday. "The party was finally shut down for reasons of safety because there were too many people in the building." Although sheriff's deputies said no security guards or medical people were on duty, Sewald said the company that held the event had 10 security guards and two emergency medical technicians at the party. She also said it was a "no-alcohol, no smoking and no-drugs event." Two security guards searched patrons before they entered the building, Sewald said. No drugs were involved." She compared the raves to the teen rebellions of the 1960s, only without the drugs. But one teen who calls herself a "raver" said Wednesday that despite the precautions, drugs are getting into the raves. "They're intended to be drug-free," said Kimberly McMurry of Windsor, "but nine out of 10 times, there are drugs in there. The kids who carry in the drugs always find a way to get around the searches." She and her boyfriend, Robert Tullus, would like to see more efforts to get the drugs out of the parties before they are shut down permanently. Campbell also said the Weld County sheriff's deputies who closed down the party last weekend violated county ordinances. Sheriff department officials did not return calls for comment Wednesday. "It was a deliberate indifference to the law," Campbell said. "The law says the party had to exceed five hours, and they ignored that. They changed the rules due to rave hysteria." He will argue interpretation of the county ordinance when his client appears in Weld County Court. The Sewalds won't have another rave on their property for a few weeks, Sharon Sewald said, because the county building code states they have to install a sprinkler system in the building and reverse the doors, so they open outward. We had another large one this weekend (031701) that was shut down as an unlawful assembly using criminal statutes but doubt that will fly far. It got tense when we announced the gathering was shut down with the crowd chanting "Fuck the cops" but the DJ helped get cooler heads in the crowd to prevail. We can document there were over 700 paying at the door and officer reported another 200 had shown up to attend while we were trying to shut it down. GPD made one drug arrest for possession of "ruffies" (date rape drug) , a couple of DUI arrests, and one kid for aggravated motor vehicle theft because he stole a car in Denver-metro to drive up here (They had several cars working that area and we had an entire shift tied up if they were needed) . Tickets at the door were $45 and $20-25 if purchased in advance. The math tells why these are so popular with promoters. I'm told the huge majority of attendees were from Denver-metro and Boulder. Three parking lots--two in the city--were littered. They were parking in the Wells Fargo and Rafferty's lots and across 10th Street (we took video) . Attendees were walking to Hillcrest Liquor and buying alcohol (I assume legally) . This is a situation ripe for serious consequences and I'm concerned unless we deal with this effectively, it is just the beginning for other such events elsewhere. The owner claims no responsibility because he alleges he has leased the property to the promoter. The promoter claims the property owner is the one responsible for whatever zoning issues need to be resolved and his attorney is saying 12-1-20 Assembly Permits doesn't apply because the gatherings are planned for less than 5 hours. In reading the ordinance, it looks like a loophole. We just need to insure there are no more raves there and need to get Planning, Commissioners, and County Attorney on the same page to work within what resources we have. The rave party at the Van-C building, 6005 10th St., was broken up by Weld County Sheriff's Office deputies early Sunday. Almost 1,000 people were in one building, a sheriff's manager said Monday. Police have said rave parties have a reputation for high drug use and related medical problems. When the sheriff's deputies stopped the rave at 1:30 a.m. Sunday, they first estimated about 800 people were inside the building. "But now we think it was closer to 1,000," Les Cogswell said. "Deputies who opened the door said it looked like steam rolled out of the building, and the door was wet with sweat." Police also arrested two people in the area for investigation of driving under the influence, but they probably weren't at the party, officers said later. Greeley police spokesman Sgt. John Gates said officers stopped two cars leaving the party. In one, driver Robyn Slade, 21, of Boulder was found with what officer said was a small amount of marijuana and a small bottle of the date-rape drug gamma hydroxybutyarate (GHB). Her passenger, Erik Christensen, 21, also of Boulder, was charged with a felony: possession of GHB with intent to distribute. Gates said several capsules were found under Christensen's seat, and he was allegedly filling them with the GHB drug. He was also found in possession of a small amount of marijuana. The date-rape drugs, GHB and Rohypnol, have been used to knock women unconscious so they can be raped. Gates said arrests for possession of the drugs are rare in Greeley, but this is not the first time the drugs have been found here. The name was not available of a third person, in another car, who was arrested for possession of a drug Sunday morning. The organizers of the party, The Triad Dragon Co. of Denver, may have to answer to violations of county ordinances. Parties that have more than 500 people attending or last longer than five hours must have a permit.
