STARK, whose mailing address, for purposes of this Deed, is 1803 Garfield Avenue, Loveland, Colorado 80538 ("Grantors") , and MAMA TYSON LLLP, a Colorado Limited Liability Limited Partnership, the mailing address of which, for purposes of this Deed, is Post Office Box 158, Timnath, Colorado 80547 ("Grantee") . WITNESSETH: That Grantors, for and in consideration of the sum of Ten Dollars ($10.00) and other good and valuable consideration, to Grantors in hand paid by Grantee, the receipt of which is hereby confessed and acknowledged, have granted, bargained, sold, and conveyed, and by these presents do hereby grant, bargain, sell, convey, and confirm unto Grantee, its successors and assigns, forever, the real property, together with all improvements, if any, situate, lying, and being in the County of Weld, State of Colorado, which is legally described as follows (the "Property") : Lots A and B of Recorded Exemption No. 0707-12-1-RE1175 recorded July 17, 1989, in Book 1238 as Reception No. 2185448, being the NE1/4 and all that part of the NE1/4NW1/4 of Section 12 lying North, East, and above the Cross Cut Lateral Ditch, all in Township 7 North, Range 66 West of the 6th P.M., County of Weld, State of Colorado. (Street Address: 40527 Weld County Road 37, Ault, Colorado) With the exception of one share of the capital stock of The Water • • ; ,. 'Supply & Storage Co. , which Grantors are retaining, TOGETHER WITH all rights, title, and interest of Grantors in and to all water ( and water rights, ditches and ditch rights, wells and well rights, } ., reservoirs and reservoir rights, laterals and lateral rights, and water decrees belonging or in any way appertaining to the Property, including, but not by way of limitation, three (3) irrigation wells referred to as Stark Well No. 1-13971, Stark Well No. 2-13972, and Stark Well No. 3-13973 as decreed by Water Court, Water Division I, State of Colorado, in Case No. W-1552; and one (1) domestic well referred to as Stark Well No. 1 as decreed by. Water Court, Water Division I, State of Colorado, in Case No. W-7164. TOGETHER with all and singular the hereditaments and appurtenances thereto belonging, or in anywise appertaining, and the reversion and reversions, remainder and remainders, rents, issues, and profits thereof, and all estate, right, title, interest, claim, and demand whatsoever of Grantors, either in law or equity, of, in, or to the Property, with the hereditaments and appurtenances. TO HAVE AND TO BOLD the Property above bargained and described with the appurtenances unto Grantee, its successors and assigns, forever. And Grantors, for themselves and their heirs, personal representatives, and assigns, do covenant, grant, bargain, and agree to and with Grantee, its successors and assigns, that at the time of the eneealing and delivery of these presents they are well seized of the Property; have good, sure, perfect, absolute, and indefeasible estate of inheritance, in law, in fee simple; have good right, full power, and lawful authority to grant, bargain, sell, and convey the same in manner and form as aforesaid; and that, except as hereinafter provided, the same are free from all former and other grants, bargains, sales, liens, taxes, assessments, and encumbrances of whatever kind or nature soever; and Grantors do hereby warrant the title to the same, except and subject to the following: 1 . All easements and rights-of-way in place or of record. 2. Ali oil, gas, or other mineral leases, reservations, or exceptions of record. • 3.
