Dear Rob,
There exists a on-going problem where we ask for your intervention and gt chtuce.
Excel Energy has a natural gas compressor station in the South East corner of Weld County
Roads 4 and 19.
Since March 3,1999,we(local residents within 1 mile of Roads 4 & 19)have been
experiencing high noise levels and ground transmitted vibrations into our homes. We have been in
constant contact with Excel representatives and engineers,yet after two years the problem exists.
Excel's people(they admit to the problem)have been very receptive and have 1.e,plained
what the cause is and what they are trying to do to rectify the problem. Since 1990 Excel has
put-on-line even more and larger compressors that are only making the situation vimhe".
Each of the residents exact degree of irritation and disruption appears to tlu picated upon
the distance they are from the source. My borne emits a "resonating"audio and piltylicall vibration
with varying intensity....we all expierence the same problems only to different degtirl,
Neighbors are being awoke at night believing they are experiencing an earpli a with their
house vibrating and windows flexing,others experience the noise only and so-for, ] ny complain
of headaches and tension caused by the constant resonating vibrations.
What is it that can be done? Who is responsible to correct? What are our ors to enjoy
our home and property without interference by adverse conditions affec ' }lives

Dear Mr. Griebling:
Enclosed is a copy of a letter I received from Mr. Larry A. Johnson. Mr. Johnson expresses
concerns and complaints regarding a natural gas compressor station located at the southeast
corner of Weld County Roads ("WCR's")4 and 19. Mr. Trevor Jiricek of the Weld County
Department of Health and Environment suggested that I send this copy of Mr. Johnson's letter to
you to see if the Oil and Gas Conservation Commission staff would respond.
I respectfully request that you ask one of your staff members to respond to Mr. Johnson and to
contact Mr. Jiricek or one of his staff members if a trip to the site it planned.

Re: Mr. Larry A. Johnson's Noise complaint
Excel Energy's Natural Gas Compressor Station, WCR's 4 and 19
Dear Mr. Masden:
The Oil and Gas Conservation Commission (COGCC ) received your letter that requested that
the COGCC respond to Mr. Larry Johnson's compressor station noise complaint. COGCC Weld
County Inspector Linda Pavelka met with Mr. Johnson at the site on April 5, 2001 to discuss and
evaluate his concerns. During this meeting it was determined that the site was operated by
Excel Energy and was part of a gas transmission facility. The COGCC does not have any
enforcement or regulatory authority over this facility. The COGCC regulatory authority is limited
to gas gathering systems directly related to exploration and production activities. We regret that
we were not able to resolve Mr. Johnson's complaint. Attached is a COGCC Complaint Report
which details our response in this matter. I discussed this situation with Mr. Trevor Jiricek of the
Weld County Department of Health and Environment who is investigating if something can be
done through the Weld County permit issued for this facility.

THE COGCC RECEIVED A LETTER FROM WELD COUNTY COMMISSIONER ROBERT MASDEN ASKING THE COGCC TO RESPOND TO A
COMPLAINT HE HAD RECEIVED FROM MR JOHNSON CONCERNING A COMPRESSOR STATION/GAS PLANT LOCATED AT THE SOUTHEAST
CORNER OF WCR ROADS 4 AND 19. A COPY OF MR JOHNSON LETTER TO COMMISSIONER MASDEN WAS ATTACHED. THE LETTER
RELATED NOISE PROBLEMS AT THE EXCEL ENERGY SITE GOING BACK TO MARCH 3, 1999. THE COMPLAINT WAS REFERRED TO COGCC
WELD COUNTY INSPECTOR LINDA PAVELKA FOR FURTHER ACTION ON 4/3/01. LINDA CALLED MR JOHNSON 4/3/01 AND SET UP A MEETING
WITH HIM ON THE SITE ON 4/5/01. UPON MEETING WITH MR JOHNSON,LINDA DISCUSSED THAT THE COGCC DID NOT HAVE ANY
JURISDICTION OVER EXCEL ENERGY OR THIS SITE. COGCC JURISDICTION IS LIMITED TO GAS GATHERING SYSTEMS. THE COGCC DOES
NOT HAVE ANY JURISDICTION OVER GAS TRANSMISSION LINES OR THE COMPANIES THAT OPERATE THEM. LINDA OFFERED TO TAKE A
SOUND MEASUREMENT. MR JOHNSON RELAYED THAT THE PLANT WAS COMPARATIVELY QUIET AS THE WEATHER WAS WARM AND THE
VIBRATIONS/NOISE GENERALLY OCCURED DURING COLD WEATHER WHEN THE PLANT WAS RUN AT FULL CAPACITY. LINDA OFFEREDTO
LOAN THE NOISE METER TO HIM SO THAT THE NOISE COULD BE MEASURED AT A LATER DATE. MR JOHNSON TALKED WITH LINDA ABOUT
ALL OF THE DIFFERENT AGENCIES AND PEOPLE HE HAD CONTACTED IN THE PAST WITH NO SUCCESS. HE EXPRESSED HIS FRUSTRATION
THAT PEOPLE WERE JUST HANDING HIM AROUND LIKE A "HOT POTATO". LINDA SUGGESTED THAT HE MIGHT TRY CONTACTING THE
PUBLIC UTILITIES COMMISSION. MR JOHNSON WAS ALSO WORRIED THAT THE PLANT MIGHT BE EXPANDED. LINDA TOLD HIM THAT WELD
COUNTY WOULD PROBABLY HAVE TO APPROVE PLANT EXPANSIONS. MR JOHNSON ALSO STATED THAT STATE REPRESENTATIVE PAM
RHODES WAS ALSO THE EXCEL ENERGY PLANNING DEPARTMENT MANAGER BUT HE HAD NOT CONTACTED HER YET LINDA SUGGESTED
THAT MR JOHNSON CONTACT MS RHODES AND GIVE HER A CHANCE TO ADDRESS HIS CONCERNS. UPON LEAVING LINDA AGAIN
REITERATED THAT SHE DID NO KNOW WHICH AGENCY HAD ENFORCEMENT AUTHORITY FOR NOISE LEVELS AT THIS SITE. MR JOHNSON
HAD ALREADY CALLED THE EPA WITHOUT MUCH SUCCESS AND FELT THAT THERE WAS A LOOPHOLE IN THE SYSTEM.
