FREDERICK WATTENBERG, et al., Defendants. ORDER THIS MATTER is before the Court on Plaintiffs Motion for Default Judgment Against Defendants Rose Marie Barham Kitchel and Ruth Elizabeth Barham Hass filed April 18, 2001. On January 16, 2001, and May 7, 2001, Defendant Hass filed letters with the Court. In its Trial Brief filed May 14, 2001, Plaintiff lists Defendant Hass among the Defendants "who have filed responses." Accordingly, Defendant Hass is not in default and I will DENY the Motion for Default Judgment as to her. Defendant Kitchel, on the other hand, was served on January 2, 2001, pursuant to Fed.R.Civ.P. Rule 4. She has not answered the Complaint nor has she entered an appearance in this action. The Clerk of the Court therefore entered default against her on April 26, 2001. Plaintiffs Motion represents that Defendant Kitchel is neither an infant or incompetant person. Pursuant to Fed.R.Civ.P. 55, I will therefore GRANT the Motion for Default Judgment against Defendant Kitchel. Accordingly, it is ORDERED that Plaintiffs Motion for Default Judgment Against Defendants Rose Marie Barham Kitchel and Ruth Elizabeth Barham Hass filed April 18, 2001, is e'd/isei eno .�'� e-4:25- D/ GQ2e.. 6,4 / 2001-1720 • GRANTED IN PART and DENIED IN PART. It is granted as to Rose Marie Barham Kitchel and denied as to Ruth Elizabeth Barham Hass. It is FURTHER ORDERED that Defendant Rose Marie Barham Kitchel has no interest, estate nor claim of any kind whatsoever in the Property that is the subject of this action. It is FURTHER ORDERED that as to Defendant Rose Marie Barham Kitchel, Plaintiff Asphalt Paving Co. is the owner in fee simple and entitled to possession of the Property which is the subject of this action.
