HomeMy WebLinkAbout20013147 RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO NOVEMBER 7, 2001 TAPE #2001-48 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, November 7, 2001, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner M. J. Geile, Chair Commissioner Glenn Vaad, Pro-Tem Commissioner William H. Jerke Commissioner David E. Long Commissioner Robert D. Masden Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther E. Gesick Director of Finance and Administration, Donald D. Warden MINUTES: Commissioner Masden moved to approve the minutes of the Board of County Commissioners meeting of November 5, 2001, as printed. Commissioner Long seconded the motion, and it carried unanimously. READ ORDINANCE BY TAPE: Commissioner Vaad moved to read Code Ordinance #2001-8 by tape. Commissioner Masden seconded the motion, which carried unanimously. ADDITIONS TO AGENDA: The following was added under New Business: 3) Consider Contract for Law Enforcement Assistance Fund (LEAF) Grant and authorize Chair to sign [2001-3148] CONSENT AGENDA: Commissioner Vaad moved to approve the consent agenda as printed. Commissioner Long seconded the motion, and it carried unanimously. PRESENTATIONS: RECOGNITION OF SERVICES, SHERIFF'S OFFICE - HENRY WELLS: Chair Geile read the certificate recognizing Henry Wells for ten years of service in the Weld County Sheriff's Office. Sheriff Ed Jordan accepted the award on behalf of Mr. Wells, who was not present. RECOGNITION OF SERVICES, 2000 DRIVERS SAFETY AWARD -CORONER'S OFFICE: Chair Geile read the certificate recognizing the Coroner's Office for having no county auto accidents for the past two years. The Coroner's Office was also presented with a trophy. (Switched to Tape #2001-49.) 2001-3147 BC0016 COMMISSIONER COORDINATOR REPORTS: Commissioner Masden commented the County received a letter from Bob Brooks, Executive Director for the Department of Local Affairs, indicating the County will be awarded $600,000.00 under an Energy Impact Grant, for the final phase of Weld County Road 49. Chair Geile commended Commissioner Masden and Mr. Warden for their efforts in this matter. PUBLIC INPUT: There was no public input. WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: All Funds $438,993.80 Commissioner Masden moved to approve the warrants as presented by Mr.Warden. CommissionerJerke seconded the motion, which carried unanimously. BIDS: PRESENT BIDS: Mr. Warden stated there are no bids to present. APPROVE WINTER SEEDING FOR VARIOUS LOCATIONS BID-DEPARTMENT OF PUBLIC WORKS: Mr.Warden stated the Department of Public Works recommends approval of the low bid from Aquatic and Wetlands, Inc., in the amount of $40,840.00. Commissioner Vaad moved to approve said bid as recommended by staff. Commissioner Masden seconded the motion, which carried unanimously. NEW BUSINESS: CONSIDER APPOINTMENT AND REAPPOINTMENTS TO JUVENILE COMMUNITY REVIEW BOARD: Commissioner Vaad moved to appoint Carla Cronk and reappoint Gil Trujillo,Tracey Powell, Kristin Erwin, Janice Brown, and John Cordova to the Juvenile Community Review Board, with their terms to expire November 1, 2004. Commissioner Masden seconded the motion, which carried unanimously. FIRST READING OF CODE ORDINANCE #2001-8, IN THE MATTER OF REPEALING AND RE- ENACTING, WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION, CHAPTER 5 REVENUE AND FINANCE, CHAPTER 9 INFORMATION SERVICES, AND CHAPTER 23 ZONING, OF THE WELD COUNTY CODE: Mr. Barker stated the amendments to Chapter 2 will delegate authority to the Director of the Department of Public Health and Environment to approve Agreements for Sampling and Analysis of Drinking Water and Sampling and Analysis of Pollutant Discharge. Section 2-3-10 regarding previously denied land use applications will be amended to specify that the substantial changes in the facts and circumstances regarding the application, must be subsequent to the original decision of denial. There is also a new section which specifies the procedures which must be followed to for a substantial change application. Mr. Warden stated Chapter 5 will be amended to go to the State maximum amount for inventory of$5,000 on all items,with the exception of all real property. He stated this is in accordance with the State Auditor's guidelines and GASB 34. He further stated Chapter 9 will be amended to include the Workstation Remote Control Policy. He explained this policy details the process allowing Information Services to take control of a staff computer. Mr. Warden stated the policy addresses confidentiality, and this process will make computer repairs in the County more efficient. Mr. Barker stated Chapter 23 will be amended to provide an additional enforcement mechanism to suspend a Use by Special Review Permit and impose a civil penalty if the applicant does not comply with the Development Standards. He stated the amendment under Chapter 29 involves clarifying that the Board of Appeals referred to in the Uniform Code of the Abatement of Dangerous Buildings, is the same as the Code Board of Appeals. He further stated the Department of Building Inspection will be authorized to act as the exclusive inspection agency for Weld County regarding manufactured homes. Sections 29-2-90.B.6.a through 6.g will be deleted regarding foundations. There are also various fee changes which will be incorporated through this Minutes, November 7, 2001 2001-3147 Page 2 BC0016 amendment. In response to Commissioner Vaad, Mr. Barker stated Sections 29-2-90.B.6.a through 6.g will be stricken because the manufacturers set forth the requirements for anchors and ties. Commissioner Jerke commented that although most of the issues included in this revision are non-controversial, he is concerned with so much unrelated content being listed under one code revision. He suggested a work session be scheduled to allow the Board to review the changes in detail. Mr. Barker stated the various items were compiled throughout the year and were combined to economize on publishing costs. Commissioner Masden concurred and stated that although he realizes this process saves money,he would like to consider the individual items separately in the future, and in this case, he would like a schedule a work session to review the various items in detail. Mr.Warden stated there are two supplements each year and this combines various housekeeping matters. Commissioner Vaad commented a work session to discuss the content would allow staff to continue compiling the items while informing the Board of all the various issues. Commissioner Jerke moved to approve Code Ordinance #2001-8 on first reading. The motion was seconded by Commissioner Vaad, and it carried unanimously. CONSIDER CONTRACT FOR LAW ENFORCEMENT ASSISTANCE FUND (LEAF) GRANT AND AUTHORIZE CHAIR TO SIGN: Ken Poncelow, Sheriff's Office, stated grant funding was approved and under this contract the Sheriffs Office will purchase a new intoxilizer and breath testers, as well as provide overtime compensation for DUI enforcement. In response to Commissioner Jerke, Mr. Poncelow stated the equipment will be used by the County traffic officers or regular deputies, and no new employees will be hired. Responding to Commissioner Vaad, Mr. Poncelow stated this money is for Weld County only. Commissioner Vaad moved to approve said contract and authorize Chair to sign. Commissioner Long seconded the motion, which carried unanimously. PLANNING: CONSIDER CANCELLATION AND RELEASE OF COLLATERAL FOR SITE PLAN REVIEW, SPR#302- DANIEL AND DEBRA BAKER: Kim Ogle, Department of Planning Services, stated the Department of Planning Services conducted a site investigation on October 15, 2001, and he gave a brief description of the location of the site. Mr. Ogle stated the Department of Public Works has also inspected the transportation items and has no conflict with releasing the collateral funds. Mr.Ogle explained the property was in violation; however, the property owner has submitted an amended site review plan, and the Department of Planning Services recommends the Certificate of Deposit be released. Commissioner Jerke commented excessive dust is created by the motor cross track located at the rear of this property, and he feels it may be a hazard for traffic on 1-25. Commissioner Vaad stated the motor cross was allowed for family use only and that issue can be addressed further when the new permit comes forward. Don Carroll, Department of Public Works,stated the applicant has completed a hard-surface parking lot,concrete slabs at the doors, and a culvert. No public testimony was offered concerning this matter. Commissioner Jerke moved to cancel and release the collateral for Site Plan Review, SPR#302, for Daniel and Debra Baker. The motion, which was seconded by Commissioner Masden, carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. Code Ordinance #2001-8 was approved on first reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
