Department of Public Health and 1 Environment CASE NO.: Z-562 NAME: Margaret Ruhge • The Weld County Department of Public Health and Environment has reviewed this proposal. The applicant proposes to change the zoning from agricultural to industrial (1-3)zone. The property currently has two houses sharing a common septic system under permit SP-0000193. The application also identifies two wells on the property. The rezoning application does not state any proposed industrial use at this time. Therefore, the commercial and industrial uses in the development will be subject to the Site Plan Review process once they are identified. We will conduct additional review of those uses at that point. If the existing water and/or sewer services are to be utilized as part of the development of the property, the Department will require that those services be reviewed by a Registered Professional Engineer for adequacy at that time. Comments madutiolg this phase of the process may not be all inclusive, as other concerns or issues may arise during the remaining application process. COMMENTS: External Roadways: WCR 2.5 is designated as a local roadway in the Weld County Transportation Plan. The plat shows that the minimum required 30 feet of right-of-way north of the quarter section line has been dedicated. WCR 27 is designated as a collector in the Transportation plan and will require a minimum 80 feet of right-of-way. The US 85 Access Plan requires major intersection improvements due to the reduction in allowed turns at US 85 and WCR 2.5. Additional right-of-way will be required for intersection improvements. A 20'reservation for this additional right-of-way will need to be shown on the change of zone plat for both WCR 2.5 and WCR 27. During the design process for the final plat phase, road and intersection improvements can be determined and the necessary right-of-way can be dedicated. Internal Roadways: This parcel has access to the subdivision road to the west. There is also an access road north of this parcel. Collector roadways are only allowed six access points per mile. There are already six access points on WCR 27 in this mile segment. No additional access will be permitted on WCR 27. The existing residential access will be re-evaluated based on the future use. All access points that change use must be re-evaluated. In addition, the proximity of the driveway to the new intersection may not be feasible. Storm Water: A drainage report was not submitted. It would be more appropriate to require the drainage study at the time of Site Plan Review. Traffic Impacts: A traffic impact report was not submitted. It would be more appropriate to require the traffic impact study at the time of Site Plan Review. RECOMMENDATION: Approval DEVELOPMENT CONDITIONS (If Approved): ❑ A 20' right-of-way reservation for road and intersection improvements shall be shown on the zoning plat. ❑ A note shall be added to the plat notifying any purchaser that the residential driveway will not necessarily be allowed when a sight plan is submitted for review. ❑ The drainage and traffic impact studies shall be waived until the Site Plan Review. A Weld County Change of Zone Application, Rezoning Questionnaire, Existing and Proposed Zoning maps, prepared by Alpha Engineering and a Soil and Mineral Survey, prepared by Terracon were included in the referral. The site is topographically flat and located on approximately 11.4 acres of land in an industrially developed section of Brighton, Colorado. The site appears to be previously irrigated due to its use as an agricultural property. CGS is in general agreement with the observations presented in the Terracon soil survey at the site. This referral does not appear to qualify as a "subdivision", however, the proposed water supply for the property appears to be existing wells. Based on the information that you provided, there are two existing wells on the property. • Permit no. 234064 was issued on June 15, 2001 for the registration of an existing domestic well used for ordinary household purposes inside 2 single family dwellings, fire protection, the watering of domestic animals and poultry and the irrigation of not more than 1 acre of home gardens and lawns. • Permit no. 55901-F was issued on June 15, 2001 for the registration of an existing well decreed in Division 1 Water Court case no. W-2889 for the irrigation of 11 acres in the W1/2 of SE1/4 and E1/2 of SW1/4 of NE1/4, all in Section 31, Township 1 North, Range 66 West, 6th P.M.. Since the proposed uses for the wells were not identified, our office cannot verify if these wells can service the parcel.
