HomeMy WebLinkAbout20010445.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST THOMAS MITCHELL AND ALLEN AND MARY HEFFERMAN FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Thomas Mitchell, owner, and Allen and Mary Hefferman, tenants, VI #0000179, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of February, 2001, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Thomas Mitchell, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until June 13, 2001, to allow adequate time for the property owners to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. She asked if they could have an extension. She stated that the ground is alot harder than they had anticipated and therefore, it was taking longer to make the holes for the posts. She asked for a 60 day extension. I told her that I would indeed grant the 60 day extension. I told her I would be out there either towards the end of this week or the end of next week to take pictures. Then I would come back again in around 60 days to take more pictures. If substantial progress had been made then we could even consider an additional extension if need be. He informed me that his son-in-law (Mrs. Hefferman) called him this weekend and told him about the violation. We discussed the violation for several minutes. He asked exactly what needed to be done to completely bring the property into compliance. I told him the "derelict mobile home" needs to be restored and permits obtained or needs to be removed. I also told him that there were numerous derelict vehicles and camper/trailers and miscellaneous debris (wood, metal and trash) that needed to be removed or screened from all adjacent property owners and public rights-of-way. I told him that if he was planning on doing a standard wooden privacy fence then he would not need to submit a plan, but otherwise they would need to submit a "Screening Plan" for staff to review and approve or deny. He said that he would be at the Violation Hearing (Feb. 13, 2001 @ 1000). I explained where it was going to be held.
