RE: APPROVE THREE EXCLUSIVE WATERLINE EASEMENTS DEDICATION
AGREEMENTS AND ONE DRAINAGE UTILITY EASEMENT DEDICATION
AGREEMENT AND AUTHORIZE CHAIR TO SIGN - CITY OF GREELEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with three Exclusive Waterline Easement
Dedication Agreements and one Drainage Utility Easement Dedication Agreement between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, and the City of Greeley, with terms and conditions being as stated in said
Dedication Agreements, and
WHEREAS, after review, the Board deems it advisable to approve said Dedication
Agreements, copies of which are attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the three Exclusive Waterline Easement Dedication Agreements
and one Drainage Utility Easement Dedication Agreement between the County of Weld, State
of Colorado, by and through the Board of County Commissioners of Weld County, and the City
of Greeley be, and hereby are, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said Dedication Agreements.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 12th day of December, A.D., 2001.

Included with this transmittal are four easements for the above project that need to be signed and
recorded prior to us submitting revised drawings to the City of Greeley. Three of the easements
are for waterlines running to fire hydrants. These will be maintained by the city. The fourth
easement is for the revised layout of the East Jail Detention Pond.

Know all men and women by these presents that Weld County, Colorado; herein referred to as
"Grantor"hereby grants and conveys to the City of Greeley; an exclusive waterline easement;
herein referred to as "Easement".
Said Easement is described as:

This grant shall be binding upon the heirs, executors, administrators, successors, and assigns of
the parties hereto.

Legal Description
A permanent easement located within Tract"A" of the Weld County Business Park
P.U.D. as recorded in the office of the Weld County Clerk and Recorder in Book 1212,
Reception No. 2158271. Said easement being a strip of land 20 feet in width lying 10
feet on each side of the following described centerline, located in the Northwest Quarter
(NW1/4) of Section 31, Township 6 North, Range 66 West of the 6th Principal Meridian,
within the City of Greeley, County of Weld, State of Colorado, being more particularly
described as follows:
Commencing at the North Quarter Corner(N1/4) of Section 31, and considering the
North line of the Northwest Quarter of said Section 31 to bear North 89°34'39"West,
with all bearings contained herein being relative thereto; thence along said North line,
North 89°34'39" West a distance of 696.19 feet to the Northwest Corner of the Weld
County Sheriff's Administration Building Site; thence continuing along said North line,
North 89°34'39" West a distance of 240.32 feet; thence South 00°25'21" West a distance
of 50.00 feet to a point on the South right-of-way line of"O" Street and the True Point of
Beginning of this easement.
Thence continuing South 00°25'21" West a distance of 128.34 feet to the Point of

Legal Description

DRAINAGE UTILITY EASEMENT
DEDICATION AGREEMENT
Know all men and women by these presents that Weld County, Colorado; herein referred to as
"Grantor"hereby grants and conveys to the City of Greeley; a permanent drainage utility
easement; herein referred to as "Easement".
Said Easement is described as:
See"Drainage Report, Weld County North Jail Phase 2 Expansion&Weld County Sheriff s
Administration Building, Revised December 4, 2001,Prepared by Ketterling,Butherus&Norton
Engineers, Greeley, CO" for property and easement locations, which have been approved by the
Grantee. These areas within the Easement shall be used for the purpose of providing stormwater
detention capacity of 92,633 CF as identified as the East Jail Pond and shall not be converted to
other uses in the future. The Grantor shall maintain the drainage facilities in good working order.
Good working order is defined as a drainage system with properly maintained structures and side
slopes free of debris, impoundments or alterations to the flow of drainage. The Easement shall
permit the right of ingress and egress over and across the Grantor's property by the Grantee for
inspection and to complete any needed maintenance to restore the drainage facilities in good
working order. Upon failure of the Grantor to properly maintain the drainage facilities in good
working order, this agreement shall permit the Grantee, with due notice, to restore the drainage
facilities to good working order. Grantor will reimburse all costs incurred by the Grantee in
restoring the drainage facilities to good working order.
This grant shall be binding upon the heirs, executors, administrators, successors, and assigns of
the parties hereto.
In witness whereof, the Grantor has hereunto set their hands and sea on this 12th day of
