HomeMy WebLinkAbout20010202.tiff RESOLUTION RE: APPROVE MINOR RESUBDIVISION, S #585, TO RELOCATE A PROPERTY LINE - CATHOLIC CHARITIES AND COMMUNITY SERVICES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 22nd day of January, 2001, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Catholic Charities and Community Services, for Minor Resubdivision, S#585, to relocate a property line 17 feet to the north, on the following described real estate, to-wit: Lots 10 and 11, Espanola Subdivision; being located in the NW1/4 NE1/4 of Section 36, Township 6 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing on January 22, 2001, John Moore, represented said applicant, and WHEREAS, Section 24-5-30.C of the Weld County Code provides standards for review of said Resubdivision, S #585, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendation of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24-5-30.A of the Weld County Subdivision Ordinance. 2. The request is in conformance with Section 24-5-30.C of the Weld County Code, as follows: a. 24-5-30.C.3.a - The lot line revision complies with the approved recorded Final Plat. No utility easements have been designated on the Espanola Subdivision plat and therefore will not be affected. b. 24-5-30.C 3.b - The application complies with the adopted rules, regulations, and ordinances currently in force affecting the subdivision. No utility easements have been designated along the property line to be relocated because utility easements were not required when the Espanola Subdivision was platted in the 1920's. The proposed residence will meet offset requirements for the A (Agricultural) Zone District per Section 23-3-50.C of the Weld County Code. The Resubdivision Plat shall be recorded in the Office of the Weld County Clerk and Recorder. The map plat shall be prepared in accordance with Section 24-4-40.D.6 through 24-4-40.D. 7 of the Weld County Code. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 22nd day of January, A.D., 2001. This request is being made jointly and with the full cooperation of Catholic Charities and Community Services and Mr. Alvin Garcia, both owners of the property in question. In September of 1999, Mr. Alvin Garcia(owner of Lot 11) discovered and notified Catholic Charities of a 27 foot encroachment onto Catholic Charities property (Lot 10) in the Espanola Subdivision. After discussion and reviewing numerous options, it was agreed that the affected property would be split, and the South 17 Feet of Lot 10 would become the property of Mr. Garcia and be Quit Claimed to him by Catholic Charities. The remaining 10 feet of the encroachment would be rectified by Mr. Garcia in the form of moving a fence and hedge. This lot line adjustment is agreeable to both parties. We request that this alternative to this encroachment be approved by the Department of Planning Services and it is the most agreeable to all parties concerned. INC. n - oRE/e., i MINUTES OF THE WELD COUNTY UTILITIES ADVISORY COMMITTEE A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday, December 14, 2000, at 10:00 a.m., in the Conference Room of the Weld County Planning Department at 1555 N. 17th Avenue, Greeley, Colorado. Members Present Douglas Dalton Excel Energy Don Magnuson Cache la Poudre Irrigating Mark Peterson St. Vrain Sanitation Gary Sandau La Salle Fire Protection District Also Present: Chris Gathman, Planner; Trisha Swanson, Secretary. CASE NUMBER: S-585 APPLICANT: Catholic Charities and Community Services PLANNER: Chris Gathman REQUEST: Minor Subdivision to adjust property line LEGAL: Lots 10&11, Espanola Subdivision(Part of the NW4NE4 of Section 36,Township 6 North, Range 66 West of the 6th P.M., Weld County, Colorado. LOCATION: West of WCR 27, south of WCR 74 Chris Gathman, Planner, presented Case S-585. Mr. Gathman noted that the lot line adjustment between Lots 10 and 11 of Espanola Subdivision is to correct the encroachment of the house on Lot 10 onto Lot 11. Mr. Gathman noted that the lot line will be moved 17' to the north. Chris Gathman also noted that the subdivision was platted in the 1920's and did not require the utility easements at that time. Doug Dalton noted that the gas and electric were already in place. Mark Peterson noted that the change may require Lot 10 to move their sewer stub. Chris Gathman noted that he would note this to the applicant. Mark Peterson asked if the movement of the lot line will cause Lot 10 to no longer conform. Mr. Gathman noted that the County Attorney stated that this will still conform as the lot was an existing non-conforming lot. Mark Peterson moved to accept the plat. Doug Dalton seconded the motion.
