RESOLUTION 235 RE: APPROVE VACATION OF SPECIAL REVIEW PERMIT#311 -JOHN M. HOCHMILLER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated , the Board did approve Special Use Permit#311 for the Storage of Junk Cars and Trucks for John M. Hochmiller on the following described real estate, to-wit: E1/2 W1/2 NE1/4 of Section 32, Township 3 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request from John M. Hochmiller, 19640 County Road 28, Hudson, Colorado 80642, to vacate said Special Use Permit#311, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Special Use Permit#311 be, and hereby is, vacated. However, I think you are correct in doing srp provided (1) it is consistent that we did not require a USR for Gerrity in the same zone district provided they went through SRP (2) the building is not inside the current sup area >>> Kim Ogle 07/28/00 07:00am >>> Lee Hockmiller operates Active Truck Parts, Inc. , located on CR 28 near Tire Mountain. In 1976 he was approved to operate through a Special Use permit (SUP 311) . The property is zoned I-3 . In 2000, Hockmiller submitted a building permit application for one 6400 square foot building for the dismantling of truck parts. (He has five other buildings on site, including a primary residence, modular home, warehouse, shop and wash bay. The wash Bay was permitted by Staff in January 1997) My question is which permitting application should Hockmiller proceed with to ti permit his additional building? As he is in the I-3 Zone District, normally a Site Plan Review would be done. Given that his previous permitting process was a SUP, should the USR application govern. I realize that the SPR was not available at the time of his original application, thus I am leaning towards the SPR.
