RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST JOANNA AUTOBEE FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, JoAnna Autobee, VI #0000125, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of May, 2001, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, JoAnna Autobee, property owner, and Raymond Fischer, representative,
were present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until May 10, 2001, to allow adequate time for the property owner to
bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0000125 be, and hereby is, referred to the Weld County
Attorney's Office for legal action against JoAnna Autobee to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until May 10, 2001, to allow adequate
time for the property owner to bring the subject property into compliance.

Currently, there is a violation of Chapter 23, Article III (3) , Division 1,
Sections 23-3-20, 23-3-30, 23-3-30 .F, 23-3-30.I and Chapter 23, Article IV(4) ,
Division 3, Section 23-4-130 and Chapter 29, Article VII (7) , Section 29-7-10 of
the Weld County Code. To bring the property into compliance the property owner
shall obtain a building permit to bring the property into compliance with ZPMH-
2215 . Additionally, the Noncommercial junkyard consisting of derelict vehicles,
metal barrels, wood, appliances and miscellaneous debris shall be completely
screened from all adjacent properties and public rights-of-way.
The Department of Planning also recommends that the County Attorney authorize
legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert
with the identified parties .

Dear Mr. Fischer and Ms. Autobee:
The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting with
the Board of County Commissioners on April 10, 2001, at 10:00 a.m., to consider the violations occurring on
the property. As we discussed the above mentioned property is in violation of the following Section(s)of the
Weld County Code:
Chapter 23,Article Ill, Div 1 "A(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.F "MOBILE HOME subject to the additional requirements of Article IV,Division 3 of this Chapter."
Section 23-3-30.1 "Noncommercial junkyard."
Chapter 23,Article IV, Div 3 "Mobile Homes"
Section 23-4-130 "No MOBILE HOME may be located or relocated in the County after August 25, 1981,except
in accordance with this Division,including the issuance of any zoning permit which may be required by this Section.
Each MOBILE HOME located or relocated in the County after said date must have a BUILDING permit fora MOBILE
HOME issued pursuant to Chapter 29 of this Code. An application for any zoning or building permit for a MOBILE
HOME required by this Division shall include the following:"
Chapter 29,Article VII "Mobile,Manufactured or Factory-Built Home Permits"
Section 29-7-10 "Permit required."
-No mobile, manufactured or factory-built home, as defined in this Building Code, may be located or relocated
within the County without a building permit issued by the Building Official.
To bring the property into compliance the following option(s)are available:
The"Noncommercial Junkyard"consisting of derelict vehicles,wood,scrap metal and miscellaneous debris shall
be removed or screened from adjacent properties and public-rights-of way. Additionally,one of the conditions of
the Mobile Home which is currently permitted through a Zoning Permit for a Mobile Home"ZPMH-2215"was to
obtain a building permit.
This meeting will take place in the County Commissioners' Hearing Room, First Floor,Weld County Centennial
Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance
to answer any questions the Board of County Commissioners might have about the violations.
Please also be advised that I will be taking video from the road or adjacent properties the day before the Violation
Hearing (indicated above).
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation including the action necessary to correct the violation, and
that you were given sufficient time to remedy this violation. If you have any questions concerning this matter,

The Department of Planning Services'staff has reviewed this request and approves this request for the
following reasons:

The applicant has submitted a petition in favor of the request. The petition contains the signatures of 100%
of the surrounding property owners within 500 feet of the property where the mobile home is proposed to
be located.
The Department of Planning Services'staff recommendation for approval is conditional upon the following:
1. The applicant shall apply for a building permit for the mobile home and shall comply with
all installation standards of Chapter 29 of the Weld County Code, applicable to mobile
homes, prior to locating the mobile home on the property.
2. - Prior to the occupancy of the mobile home, the mobile home shall be connected to an
approved sewage disposal system and a adequate water supply. The applicant shall
provide proof of adequate water and proof and sewer connection documentation to the
Department of Planning Services.
3. The mobile home shall not be occupied until such time that the applicant has complied
with Conditions 1 and 2 stated above.
•
4. Derelict manufactured (mobile) home: a manufactured (mobile) home that is partially or
totally damaged by fire, earthquake, wind, or other natural causes, or is in a state of
general dilapidation,deterioration,or decay resulting from improper lack of maintenance,
vandalism,or infestation with vermin or rodents. Any such derelict manufactured(mobile)
home shall be returned to and maintained in the condition as originally established on site
and as inspected by the Weld County Building Inspection Department, or it shall be
removed from the site.
5. All derelict vehicles located on the property must be operational with current license plates,
be screened from all adjacent properties and public rights of way, or be removed from the
property. All other items considered to be part of a noncommercial junkyard must also be
removed from the property or screened from adjacent properties and public rights-of-way.
6 The property is in violation of Chapter 23 of the Weld County Code, (Violation
#0000125).The applicant shall schedule a final inspection with the Weld County Zoning
Compliance Officer.
7. Site Specific Development Plan and Use by Special Review Permit(USR-567), shall be
vacated. If the applicant wishes to pursue the recreational facility in the future, a new
application for a USR shall be applied for and approved by the Board of County
Commissioners.
8. The concession stand located on the site, currently being used as a residence, shall no
longer be used for overnight housing for any person or as an income source by the
applicant for rental once the applicant has received a Certificate of Occupancy for the
mobile home. The restrooms shall also no longer be used for private use. All utilities
located to both the concession stand and restrooms shall be disconnected once a
Temporary Certificate of Occupancy has been received. The Weld County Building
Inspection Department shall conduct an inspection to ensure the disconnections, and a
Certificate of Occupancy shall be issued at this time.
-9. Should noxious weeds exist on the property or become establishes as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Section 15-1-10 of the Weld County Code.
10. The applicant shall maintain compliance with Section 23-4-200 of the Weld County Code
at all times.

RE: Property located in part of the NW4 NE4 of Section 36, T6N, R66W of the 6'h P.M., Weld County,
Colorado.
Dear Ms. Autobee:
On August 17, 2000, a site inspection was conducted on the above mentioned site for a request for a Mobile Home
to be used as a Principle Dwelling (ZPMH-2215). The Department of Planning has concerns with this property and
the Development Standards of the Site Specific Development Plan and Use by Special Review Permit(USR-567),for
a Recreational Facility, approved on April 17, 1984.
The following Development Standards from USR-567, are currently in violation with the Weld County Zoning
Ordinance: #1, #4, #5
Development Standard #1 states: "The permitted use shall be a recreational facility as described in the application
materials on file with the Department of Planning Services."
As stated in the application, the use was to be for softball, little league baseball, football and soccer leagues, and a
50'x 50'playground at the northeast corner of the park. There is not a playground currently on site. The use has been
for softball practice. The development of this site was to be completed in 1990, to include restrooms, dugouts and
bleachers. Although there are bleachers, they are unsafe, there are not dugouts and not public restrooms.
Development Standard #4 states: "The concession stand shall conform to the rules and regulations governing the
sanitation of food service establishments in the State of Colorado. The concession stand shall obtain a license and
approval from the Weld County Health Department."
Currently, the concession stand is being used as a primary residence. Gary Hague from the Department of Health
and Dave Sprague from Weld County Building Inspection inspected the site, and found several violations. All
requirements and codes need to be addressed to bring this standard into compliance with current Building and Health
codes. I have included copies of both inspection reports.

Development Standard#5 states:"The facility shall have a minimum of one(1)portable toilet for women and one(1)
portable toilet for men. An adequate number of portable toilets shall be used, serviced and cleaned regularly in such
a manner that they do not cause a nuisance or public health problems. A septic system to handle the sewage load
shall be installed when domestic water is brought to the site."
Upon inspection, the women's side of the restroom facility is available, but it appears that it is being used as a private
restroom. The men's side of the restrooms is not in use and is being used for storage. Both restrooms need to be
brought up to code and be made available to the public. Please contact Building Inspection for a listing of current code
requirements.
The Weld County Departments of Planning, Health, and Building have concerns with the current conditions that exist
at this site. The use must come into compliance with the Conditions of Approval and Development Standards of USR-
567 within 30 days of the receipt of this letter, or a Probable Cause Hearing will be scheduled before the Board of
County Commissioners. If the Board determines there is sufficient probable cause to warrant further action, a Show
Cause Hearing will be scheduled. At the Show Cause Hearing, the Board of County Commissioners shall consider
- revoking Use by Special Review permit.
I have enclosed the Conditions of Approval and Development Standards, along with the Building Inspection findings
that shall be brought into compliance. A copy of the Health Department's conditions were given to you on August 17
for the concession stands at the site inspection by Gary Hague.

violation of Section 30 of the Weld County Building Ordinance. No building or structure regulated by
this code shall be erected, constructed, enlarged, altered,repaired,moved, improved, removed, converted,
or demolished unless a separate building permit for each building or structure has been first obtained
from the Weld County Building Inspection Department. In addition to the required permits, it is required
that you also comply with the Weld.County Zoning Ordinance.

Dear Ms. Autobee & Mr. Fischer:
The uses on the above described property are being considered as a zoning code violation of Sections of the Weld
County Zoning Ordinance. Listed below are the following active violation(s) as we discussed on the telephone:
31.3.9 "Noncommercial Junkyard" consisting of at least one derelict vehicle, wood, and
miscellaneous debris.
31.3.3 "Mobile Home subject to the additional requirements of Section 43, Mobile Homes•
Accessory Dwelling Units."
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we
have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from , May 17,
2000, to correct this zoning violation. Failure to do so will result in this office scheduling the violation before
the Board of County Commissioners to consider whether to refer the violation to the County Attorney's Office
for legal action.

It has come to the attention of the Department of Planning Services'staff that the uses on your property may not
be in compliance with the Weld County Zoning Ordinance. The potential noncompliance with the Zoning
Ordinance is 31.19 "Noncommercial Junkyard" consisting of derelict vehicles, wood, fencing materials, and
other miscellaneous debris and 31.3.3 "Mobile Home subject to the additional requirements of Section 43,
Mobile Homes; Accessory Dwelling Units."
Please call me within five working days of the date of this letter to review these concerns with me or a thirty-day
