HomeMy WebLinkAbout20010808 RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST JOANNA AUTOBEE FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, JoAnna Autobee, VI #0000125, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of May, 2001, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, JoAnna Autobee, property owner, and Raymond Fischer, representative, were present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until May 10, 2001, to allow adequate time for the property owner to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. Derelict manufactured (mobile) home: a manufactured (mobile) home that is partially or totally damaged by fire, earthquake, wind, or other natural causes, or is in a state of general dilapidation,deterioration,or decay resulting from improper lack of maintenance, vandalism,or infestation with vermin or rodents. Any such derelict manufactured(mobile) home shall be returned to and maintained in the condition as originally established on site and as inspected by the Weld County Building Inspection Department, or it shall be removed from the site. 5. All derelict vehicles located on the property must be operational with current license plates, be screened from all adjacent properties and public rights of way, or be removed from the property. Dear Ms. Autobee: On August 17, 2000, a site inspection was conducted on the above mentioned site for a request for a Mobile Home to be used as a Principle Dwelling (ZPMH-2215). The Department of Planning has concerns with this property and the Development Standards of the Site Specific Development Plan and Use by Special Review Permit(USR-567),for a Recreational Facility, approved on April 17, 1984. The following Development Standards from USR-567, are currently in violation with the Weld County Zoning Ordinance: #1, #4, #5 Development Standard #1 states: "The permitted use shall be a recreational facility as described in the application materials on file with the Department of Planning Services." As stated in the application, the use was to be for softball, little league baseball, football and soccer leagues, and a 50'x 50'playground at the northeast corner of the park. There is not a playground currently on site. The use has been for softball practice. The development of this site was to be completed in 1990, to include restrooms, dugouts and bleachers. Although there are bleachers, they are unsafe, there are not dugouts and not public restrooms. Development Standard #4 states: "The concession stand shall conform to the rules and regulations governing the sanitation of food service establishments in the State of Colorado. The concession stand shall obtain a license and approval from the Weld County Health Department." Currently, the concession stand is being used as a primary residence. Gary Hague from the Department of Health and Dave Sprague from Weld County Building Inspection inspected the site, and found several violations. All requirements and codes need to be addressed to bring this standard into compliance with current Building and Health codes. I have included copies of both inspection reports. 1 Development Standard#5 states:"The facility shall have a minimum of one(1)portable toilet for women and one(1) portable toilet for men. An adequate number of portable toilets shall be used, serviced and cleaned regularly in such a manner that they do not cause a nuisance or public health problems. A septic system to handle the sewage load shall be installed when domestic water is brought to the site." Upon inspection, the women's side of the restroom facility is available, but it appears that it is being used as a private restroom. The men's side of the restrooms is not in use and is being used for storage. Both restrooms need to be brought up to code and be made available to the public. Please contact Building Inspection for a listing of current code requirements. The Weld County Departments of Planning, Health, and Building have concerns with the current conditions that exist at this site. The use must come into compliance with the Conditions of Approval and Development Standards of USR- 567 within 30 days of the receipt of this letter, or a Probable Cause Hearing will be scheduled before the Board of County Commissioners. If the Board determines there is sufficient probable cause to warrant further action, a Show Cause Hearing will be scheduled. At the Show Cause Hearing, the Board of County Commissioners shall consider - revoking Use by Special Review permit.
