HomeMy WebLinkAbout20010449.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST WAYNE MAGNUSON FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Wayne Magnuson, VI #0000301, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of February, 2001, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Wayne Magnuson, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until February 13, 2002, to allow adequate time for the property owner to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. Subject: Property Located @ 15920 WCR 47LaSalle Co. Tuesday, Aug. 4, 2000, there was a major fire at this address. The fire burned one of the double wide mobile homes and spread into the abandoned vehicles and assortment of junk equipment. This parcel of twenty acres is about 1/3 covered with old semi tractors and trailers plus numerous pickup trucks and automobiles. There are two old tanker trailers that appears to have been used to transport asphalt or materials of this nature. We live on the 40 acres bordering the East side of this property. Our concern is that with the unknown materials and the intensity of the Ere last week; our property and other nearby properties could be damaged. We are also concerned about any hazardous materials that might be stored in containers or in the vehicles scattered around the property. I spoke to Lee,the Assistant County Attorney, about this problem.He referred me to you. He informed me that Mr. Magnuson had been previously sited for old tires being stored on the property. I believe that the conditions that exist at this property could be very hazardous and is also a place that can harbor undesirable vermin I would think that the zoning for this property would not allow for the storage of and accumulation of junk vehicles and other junk items. I bring this matter to your attention hoping for a resolution. I have others that say that they would be witnesses and we would be witnesses also.
