435 RESOLUTION RE: APPROVE MINOR RESUBDIVISION, S #603, FOR THE VACATION OF ROAD RIGHT-OF-WAY ON 2ND STREET BETWEEN MILDRED AND MAIN STREET, AS PLATTED IN THE UNINCORPORATED TOWN OF GALETON, COLORADO -JOHN AND BARBARA YOUNG WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 5th day of November, 2001, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application of John and Barbara Young, P.O. Box 752, Galeton, Colorado 80622, for a Minor Resubdivision for the vacation of road right-of-way on 2nd Street between Mildred and Main Street, as platted in the Unincorporated Town of Galeton, Colorado, on the following described real estate, to-wit: 2nd Street right-of-way between Lot 24, Block 3, and the vacated 20 feet adjacent to Lot 13, Block 4, in the Unincorporated Town of Galeton, Colorado; being a part of the NW1/4 of the NE1/4 of Section 5, Township 6 North, Range 64 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant was present at said hearing, and WHEREAS, Section 24-5-20 of the Weld County Code provides standards for review of said Minor Resubdivision for the vacation of road right-of-way on 2nd Street between Mildred and Main Street, as platted in the Unincorporated Town of Galeton, Colorado, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24-5-20.E of the Weld County Subdivision Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24-5-20 of the Weld County Code including specifically: a. Section 24-5-20.A - There is right-of-way shown on an approved plat or map that has not been used for its intended purpose in excess of twenty- one (21) years. The enclosed application/petition contains in excess of the required 70 percent of the signatures of the landowners adjacent to the proposed vacation. c. Section 24-5-20.C - The vacation is compatible with the surrounding area and uses, is consistent with efficient and orderly development, is consistent with the Weld County Comprehensive Plan, and does not deprive any parcel of adequate access to a public road or street right-of- way. d. Section 24-5-20.D- The vacation of any right-of-way may require the reservation of an easement for public utility or drainage purposes in order to meet the easement requirements of Section 24-7-60. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Weld County Department of Planning Services for a Minor Resubdivision for the vacation of road right-of-way on 2nd Street on the hereinabove described parcel of land be, and hereby is, granted, reserving unto the public a utility easement being 25 feet in width, subject to the following conditions: 1. The Weld County Department of Planning has no reservations in granting the applicant's request for vacation. Don Carroll, Public Works, asked to review the maps. He is concerned that if the property is vacated, it should revert back, half to the north owner and half to the south owner. Mr. Anderson stated that Mr. Young, applicant, owns both properties, north and south. Mark Peterson, St. Vrain Sanitation, asked about sewer provision. Applicant said they were provided on the west side of Road 51. Don Magnuson, Cache La Poudre Ditch, asked whether the it was a trunkline, and sewer or septic. Applicant stated sewer. Don Carroll inquired whether there were any utilities to deal with in line? Applicant replied there were not. Don Carroll also expressed concern about vacating and problems in might cause for future growth. He gave examples of recent growth in Deerfield and New Raymer. Mark Peterson then expressed concern about future growth in this area and how granting the vacation could be quite costly to future homebuilders needing sewer services. After general discussion regarding sewer provision and future growth, Mark Peterson made a motion to approve the vacation with the reservation of a 25 foot utility easement on the south side of the property, conditional upon receipt of a letter from the Galeton Sewer Department outlining the master sewer and water plan, which would determine whether there was a potential need for easement in the future.
